DonBea@aol.com Will Registered February 17, 1890 Will Book H , Page 493 I, William Beatty, Big Beaver Township, County of Beaver, and State of Pennsylvania, being of sound mind, memory,and understanding, hereby make my last Will and Testament, revoking any will heretofore made And First, I direct that all my funeral expenses and any other indebtedness be paid by my executors hereinafter named as soon after my decease as possible and as to any estate as I die possessed of, I dipose of the same as follows: First, I devise to my son, William G. Beatty, his heirs and assigns, the southern part of my farm in Big Beaver Township, the same containing seventy five acres, more or less, and bound on south by lands of Joseph Shannon, east by Lake Erie Railroad Company, north the other part of my farm, formerly owned by Matrons (?) Beatty, and on the west by lands of Joseph Shannon. The said William G. Beatty to hold the above seventy five acres in trust, as follows, to wit Subject to the charge of two thousand dollars until he shall have paid the said two thousand dollars to the children of John F. Beatty, deceased, one thousand dollars to Cora J. Beatty, and one thousand dollars to John F. Beatty, when each arrives at full age, and I further direct that the said William G. Beatty shall pay no interest on said two thousand, made a charge on his farm and bequeathed as aforesaid, and in case of the death of either Cora J. Beatty or John F. Beatty before arriving at full age, the share herein willed to the deceased, shall go to the survivor, and in case of death of both, before they arrive at full age, their share shall be divided equally among William G. Beatty, Richard James Beatty, Alice Farris, Molly Cox, and William B. Newell. Second. I order and direct that my executors hereinafter named, shall, after the expiration of five years from my decease, sell at either public or private sale, as he may deem to the best interest of my estate, the remaining portion of my real estate not hereinfore bequested, and divide the proceeds of the sale thereof equally among Richard James Beatty, Alice Farris, Molly Cox, and William B. Newell. And I further order, that until the termination of the said five years aforesaid, my son William G. Beatty , shall farm the said portion of my farm ordered to be sold, and shall, subject to the promise hereafter made, pay in money to Richard James Beatty, Alice Farris, Molly Cox, amd William B. Newell, the one third of what he raises thereon, the said one third to be divided equally among the ones it is directed to be paid, but in case my wife, Sidney Beatty, shall claim the one third of the rent of said land ordered to be sold, as dowry, then I direct that William G. Beatty shall pay the same to said Sidney Beatty, and not the legatees aforementioned. And I further order, that in case oil or gas should be found on said farm ordered to be sold, as aforesaid, by virtue of a lease now made by me, that the possessors, or their assigns shall pay the royalty to my executor, and he shall divide the same equally among those to who the proceeds of the sale of said farm are herein bequeathed. And I further order that my wife, Sidney Beatty, shall have a room in our dwelling house on the piece of land devised to William G. Beatty as long as she may live and shall also be maintained and supported by the said William G. Beatty Third. I order and direct that my executor shall dispose of my personal estate according to law, and after payment of all debts, shall divide the balance equally among William G. Beatty, Alice Farris, Mollie Cox, amd William B. Newell Fourth. I direct that my executor shall, as soon after my decease as possible, at either public or private sale, that certain lot of ground in Big Beaver Township consisting of about a quarter of an acre on which the Primative Methodist Church had erected a building for worship, but which reverted to me by reason of said church ceasing to use same, and I direct that the proceeds of said sale shall be equally divided among William G. Beatty, Richard James Beatty, Alice Farris, Mollie Cox, and William B. Newell. Fifth. I hereby appoint Richard James Beatty testamentory guardian of William B. Newell and require said guardian to give necessary and sufficent bond for the faithful performance of his duties, and I further order that in case that William B. Newell should die before he arrives at full age, then his share to which he is entitled by the terms and conditions of this will, shall be equally divided among William G. Beatty, Richard James Beatty, Alice Farris, and Mollie Cox And lastly, I hereby constitute and appoint William G. Beatty sole executor of this, my last will and testament and give him full power and authority to make and execute all deeds of conveyance and all other papers that may be necessary to convey said two tracts of land heretofore directed to be sold, said power is to be exercised by said executor without any application to the Orphans Court And I further give said executor full authority to make, execute and deliver all deeds and conveyances and all other papers that may be necessary to execute and deliver on the full settlement of my estate And further, I order and direct that in the case of either the death of Mollie Cox or Richard James Beatty without issue, that the share going to such deceased shall be divided equally among William G. Beatty,,Alice Farris, and William B.
