All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/bedford/ ________________________________________________ Bedford County, Pennsylvania Deed Book AF, Page's 403 - 405 Dated 17 April 1858, Recorded 14 February 1859 THOMAS DICKEN and CATHERINE his wife to and SAMUEL ELLIOTT This Indenture made the seventeenth day of April in the year of all or Lord one thousand eight hundred and fifty eight, Between THOMAS DICKEN and CATHERINE his wife of the State of Maryland, Allegheny County of the one part and SAMUEL ELLIOTT of Cumberland Valley, Bedford County, State of Pennsylvania of the one part, Witnesseth, that the said THOMAS DICKEN and CATHERINE his wife for and in consideration of the sum of twenty two hundred dollars lawful money of the United States of America unto them will and truly paid by the said all SAMUEL ELLIOTT at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted, bargained, sold, aligned, enfeoffed, released, and confirmed and by these presents do grant, bargain, sell, aligned, enfeoff, release and confirm unto the said SAMUEL ELLIOTT his heirs and assigns all that tract or parcel of land situate in Cumberland Valley, Bedford County as follows, which was surveyed in the name of JOHN CAMP and the greater part Patented to the said JOHN CAMP on the 28th day of November 1796 Beginning at a locust north 69 degrees and West 113 1/2 perches to a stone pile with the 26 degrees West 58 perches to post north 10 degrees West 66 perches to a chestnut oak South 30 degrees West 41 pr, to chestnut oak South 22 East 62 perches to white oak South 64 degrees East 94 perches to post north 26 degrees East 16 perches to post South 64 degrees East 20 to post north 28 degrees East 42 perches to post South 77 degrees East 18 perches to stone pile north 31 degrees East 94 perches to Beginning, containing 118 acres and 6_ perches joining lands of DANIEL SLIGER, ELIAS HARDINGER and the heirs of PHILIP HARDINGER and others, also one tract of mountain land bounded as follows, Beginning at a {?} Thence north 42 degrees East 59 perches to a white oak thence north 22 degrees West 29E perches to a rock thence north 30 degrees East 15 perches to stones thence by land called JACOB SLIGER, north 60 degrees West 190 perches to stones thence South twenty degrees West 102 perches to stones thence South 68 1/2 degrees East 170 perches by land of ROBERT SAMPEL now GEORGE a and JOHN ELLIOTT to Beginning, containing 96 acres and allowance the same being a part of a large tract surveyed in 1799 on warrant dated 10 April 1794 to JOSEPH SAMPLE etc. etc. Together with all and Singular the improvements, ways, woods, waters, water - courses, rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders, rents, issues and profits there of and also all the estate, rights, titles, interests, property, claim and demand whatsoever of them the said THOMAS DICKEN and CATHERINE his wife in law, equity or otherwise howsoever of, in and to the same and every part thereof to have and to hold the said premises, hereditaments, and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said SAMUEL ELLIOTT his heirs and assigns forever, And the said THOMAS DICKEN and CATHERINE his wife for themselves, their heirs, executors and administrators do by these presents covenant, grant and agree to and with the said SAMUEL ELLIOTT his heirs all and Singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said SAMUEL ELLIOTT his heirs and assigns against them the said THOMAS DICKEN and CATHERINE his wife their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend, In Witness whereof the said parties to these presents have hereunto interchangeably set their hands and seals the day in year first above written, signed THOMAS DICKEN, CATHERINE DICKEN Sealed and delivered in the presence of PETER {?}, ANDREW GROWDEN Received the day of the date of the above Indenture of the above named SAMUEL ELLIOTT the consideration money in full by me. I ANDREW GROWDEN do hereby certify that on the 17 day of April A.D. 1838 before me personally came the above named THOMAS DICKEN and CATHERINE his wife and acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such, She the said CATHERINE being of full age and by me examined separate and apart from her husband and the full contents of the said indenture having been first made known to her did upon such separate examination declare that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the same without any coercion or compulsion of her said husband.
