This Indenture Made the seventh day of February in the year of our Lord one thousand seven hundred and ninety three. Between Neal McMullen of the Town of Bedford in the County of Bedford and State of Pennsylvania, Mason and Elizabeth his wife of the one part. And James Heydon of the Town County and State aforesaid. Merchant of the other part. Whereas the Honorable John Penn, the younger, Esquire one of the late Proprietaries of the Province of Pennsylvania and the Counties of New Castle Kent and Sussex on Deleware by Anthony Butler of the City of Philadelphia Gentleman his attorney duly constituted by Letter of attorney under his hand and seal for this special purpose executed bearing date the twenty ninth day of April in 1788 recorded at Philadelphia in Letter of attorney Book No 2 Page 368 and intended to be recorded in the several Counties of the said Commonwealth and the Honourable John Penn the Elder Esquire late the other Proprietary of the said Province of Pennsylvania and the Counties of New Castle Kent and Sussex on Deleware by John F Mifflin of the City of Philadelphia aforesaid Esquire Counsellor at law his attorney constituted by Letter of attorney under his hand and seal for this special purpose executed dated the nineteenth day of November in the year of our Lord 1787 recorded at Philadelphia in the same book No 2 Page 364 and likewise intended to be recorded in the said several Counties by Indenture bearing date the tenth day of August in the year of our Lord one thousand seven hundred and ninety two duly signed and executed by the said Anthony Butler and John F Mifflin for the consideration therein received did grant, bargain, sell, release and confirm unto the said Neal McMullen A Certain Lot or piece of ground situated on the north side of Pitt Street in the town of Bedford aforesaid marked in the General Plan of the said Town No 176 Containing in Breadth East and West on the said Pitt Street Sixty feet and extending that Breadth from the said Street into the Raystown branch of the Juniata River Bounded Southward by Pitt Street aforesaid Westward by Lot No 177. Northward by the said Branch Juniata River Eastward by Lot No 175. To hold the said Lot or piece of Ground with every the Hereditaments and Appurtenances thereunto belonging unto the said Neal McMullen his heirs and Assigns for ever as in and by the said recited Indenture will more fully and at large appear reference thereunto being had. Now this Indenture Witnesseth That the said Neal McMullen and Elizabeth his wife for and in consideration of the sum of Thirty eight pounds twelve shillings and six pence lawful money of Pennsylvania unto him the said Neal McMullen in hand well and truly paid the receipt and payment whereof is hereby acknowledged. Have granted, bargained, and sold, aliened, enfeoffed, released and confirmed and by these presents Do grant bargain, and sell alien, enfeoff, release and confirm unto the aforesaid James Heydon his heirs and assigns all that the above described Lot or piece of Ground and premises situate lying and being as aforesaid Together with all and singular the buildings. Improvemints Hereditaments Appurtenances whatsoever to the same belonging or in any wise appertaining and the reversions remainders rent issues and profits thereof. To have and to hold the aforesaid described Lot or piece of ground and premises with every the Hereditaments and Appurtenances whatsoever to the said Lot or piece of Ground belonging or in any wise appertaining. ( Under and Subject to the rents and resurvations in the above recited Indenture particularly mentioned and reserved. ) To the only proper use and Behoof of him the said James Heydon his heirs and assigns for ever. And the said Neal McMullen and Elizabeth his wife for themselves their heirs Executors and Administrators Do hereby covenant and promise to and with the said James Heydon his heirs and Assigns that he the said Neal McMullen and his heirs hereby bargained and sold premises against the said. Neal McMullen and his heirs and against every other person or persons whatsoever lawfully claiming or to Claim the same (under the resurvations aforesaid ) shall and will warrent and for ever defend. In Witness wherof the said parties to these presents have hereunto interchangeably set their hands and Seals the day and year first above written.
