I, John Mcvicker esquire, High Sheriff of the of the county of Bedford, in the commonwealth of Pennsylvania, send Greeting: Wheras Joseph L Morrison [lately] in the county court of common pleas, holden at Bedford, for the county of Bedford, before the judges of the same court, to wit: of November term, in the year of our Lord one thousand eight hundred and forty four by the judgment of the same court, did recover against Elijah Adams as well as a certain debt of Six hundred and ninety three dollars and sixty four cents lawful money of the United States, as also one dollar and twelve cents which to the said Joseph L Morrison were adjudged in the same court, for the debt and costs aforesaid. AND WHEREAS, afterwards by a writ of the Commonwelth aforesaid of feri facias, issued out of the court of common pleas aforesaid, tested the twenty ninth day of August in the year of our Lord, one thousand eight hundred and forty four and to me~~~~~~~~~~~~ directed, It was commanded, that of the goods and chattels, lands, and tenements of the said Elijah Adams ~~~~~~~~~ in my bailiwick, I should cause to be made and levied the debt & costs aforesaid, which the said Joseph L Morrison ~~~~~~~~~~~~ had recovered against the said Elijah Adams ~~~~~~~~ as aforesaid, ant that I should have that money before the judges of the county court of common pleas aforesaid, the Second Monday of November [then] next, to render to the said Joseph L Morrison ~~~~~~~~ in the said writ named, and the said writ. By virtue of which the said writ of fieri facias of the lands and tenements of the said Elijah Adams [ he having no goods and chattels in my bailiwick wherewith to satisfy execution] I seized and took in execution one lot of ground situate in the Borough of Bedford with a double two story Log & weatherboard house with two kitchens attached, a stable and a well of water thereon erected adjoining lots of Heydens heirs & others ~~~~~~~~~ AND WHEREAS, by an inquisition indented, and to the said writ of fieri facias annexed taken at the Sheriffs Office on the first day of February in the year of our Lord, one thousand eight hundred and forty five by the oaths and affirmations of twelve good and lawful men of my bailiwick it was found that the rents, issues and profits of the above mentioned Lot seized and taken in execution by virtue of a writ aforesaid, were not of a clear yearly value, beyond all reprises, sufficient within the terms of seven years, to satisfy, the debt & costs in said writ mentioned, the execution of which writ, at the day and place therein mentioned together with the inquisition made thereon, and to the said writ annexed, as aforesaid, returned to the judges aforesaid, and that the said premises remain in my hands unsold for want of buyers. And Whereas (afterwards) by a writ of venditioni exponas of the said commonwealth; issued out of the court of common pleas aforesaid, tested the fifth day of February in the year of your Lord, one thousand eight hundred and forty five and to me directed, I was commanded that the lands and tenements aforesaid, so taken in execution as aforesaid, I shall expose to sale, and that I should have the money thereof, before the judges aforesaid, at Bedford aforesaid the fourth Monday of April (then) next, to render to the said Joseph L Morrison ~~~~~~~~ for the debt and costs in the said writ mentioned, and the said writ. And whereas, I the said sheriff, having given due and public notice of the time and place of sale, did on the twenty eighth day of April in the year of our Lord one thousand eight hundred and forty five expose the lands, tenements and premises to sale, by public venue or outcry, and sold the same to Lawrence Jamison of Bedford county for the sum of seven hundred and twenty five dollars Bidden for same NOW KNOW YE, that I John McVicker Esquire, Sheriff of the said county, for and in consideration of the aforesaid sum of Seven hundred and Twenty five dollars lawful money of the United States, to me in hand paid, by the said Lawrence Jamison at or before the ensealing and delivery hereof, the receipt whereof is hereby acknowledged, have granted, bargained and sold, and by these presents, according to the directions, and by force and virtue of the said recited writs, of the laws of Pennsylvania , in such cases made and provided, do grant, bargain, and sell, unto the said Lawrence Jamison ~~~~~~~ his heirs and assigns, all that the said above mentioned and described Lot ~~~~~~~~~~~~ Together with all and singular the buildings, barns, stables, gardens, orchards, improvements, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging , or in any wise appertaining, and the reversion and remainders, and the rents, issues, and profits thereof. To HAVE AND TO HOLD to the said described Lot ~~~~~~~~ and premises hereby granted or mentioned, and intended so to be, with the appurtenances, to the said Lawrence Jamison his heirs and assigns, to the only proper use, benefit, and behoof of him the Lawrence Jamison ~~~ Had and held the same, at the time of the judgment aforesaid, according to the form and effect of the said recited writ, and of the acts of assembly of Pennsylvania, in such case made and provided. Writ of Fieri Facias fieri facias Law - A writ of execution authorizing a sheriff to lay a claim to and seize the goods and chattels of a debtor to fulfill a judgment against the debtor. 1
