All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/bedford/ ________________________________________________ Cumberland Valley Township, Bedford County, PA Deed Book G, Pages 776-777 Dated 10 Jan 1809, Recorded 3 Sep 1809 THOMAS KELLY & MARTHA his wife to JOSEPH KELLY This indenture made the tenth day of January Anno Domini one thousand eight hundred and nine between THOMAS KELLY of Cumberland, in Allegany County, Maryland, late of Cumberland Valley Township, in the County of Bedford and Commonwealth of Pennsylvania, Yeoman and MARTHA his wife, of the one part and JOSEPH KELLY of Cumberland Valley Township, aforesaid Yeoman, of the other part - Whereas there was surveyed to a certain EDWARD WOODS on and application and order of survey of the twenty seventh day of September 1766 a certain tract of land situate on the Waters of Evitts Creek in Cumberland Valley Township in the County of Bedford, aforesaid bounded as following viz: - Beginning at a Hickory, thence by land of GEORGE WOODS, south eighty seven degrees, west one hundred and eighty four perches to a white oak, thence by vacant land, south one degree, west sixty five perches to a white oak, south eighteen degrees west, two hundred and eighty eight perches to a white oak, north eighty four degrees, east one hundred and ninety perches to a white oak, north thirty degrees east three hundred and forty six perches to a poplar, north seventy degrees west one hundred and two perches to the place of Beginning, Containing four hundred & forty five acres and fifty seven perches (445+ acres) and the usual allowance of six percent for roads vz; And whereas the said EDWARD WOODS by deed dated the 27th day of January in the 1767 conveyed the same to a certain GEORGE WOODS who by deed dated the fifth (5) day of November 1770 conveyed the same to a certain JOSEPH KELLY who afterwards died intestate -And whereas afterwards viz On the twenty eighth day of May 1805 in pursuance of certain proceedings in the orphans court of the said county of Bedford the said tract of land became vested in the same THOMAS KELLY in fees, as by the Records of the said court will fully appear - Now this indenture witnesseth that the said THOMAS KELLY and MARTHA his wife for and in consideration of sum of two hundred pounds lawful money of Pennsylvania to the said THOMAS KELLY in hand well and truly paid, the receipt whereof is hereby acknowledged - Have granted, bargained, sold, released and confirm and by these presents do grant, bargain, sell, release and confirmed unto the said JOSEPH KELLY, his heirs and assigns a certain part of the said described tract of land being that part thereof whereon the said JOSEPH now lives containing one hundred acres and allowance of six per cent viz included within certain marked line & being the south end of the said whole tract of land. Together with all and singular the buildings and improvements, hereditaments and appurtenances thereunto belonging or in any wise appertaining & the reversions and remainders, rents, issues & profits thereof - To have and to hold the said described one hundred acres and allowance vc - premises hereby granted with the appurtenances unto the said JOSEPH KELLY, his heirs and assigns forever, under and subject to all legal taxes and assessments hereafter accruing thereon -And the said THOMAS KELLY for himself, his heirs, Executors and Administrators doth hereby covenant, promise, and agree to and with the said JOSEPH his Heirs and Assigns that the said THOMAS KELLY the said one hundred acres of land and premises hereby granted with the appurtenances to the said JOSEPH KELLY his Heirs and Assigns against all and every person or persons claiming or to claim the same or any part thereof by from or under him, them or any of them shall and will warrant and forever defend by these presents -In witness whereof the said parties to these presents have hereto interchangeably set their Hands & Seals the same day and year first above written.
