To Whereas, by certain articles of agreement made beteen Abra- D. Watson ham Kerns, and D. William Watson the said Abraham Kerns for and in consideration of the said sum of five hundred dollars to be paid, by said William Watson to said Kerns, the receipt whereof is hereby acknowledged the said Abraham Kerns, covenanted to convey in fee simple to the said William Watson, six tracks, pieces or parcels of land to wit; part of a tract warranted in the name of Margaret Deal, part of a tract in the name of Solomon Deel, part of a track in the name of Christina Deel, part of a tract in the name of George Smouse; one tract in the name of Maria Deel, all surveyed by virtue of war rants dated the eighth day of May seventeen hundred and ninety four and one track in the name of John Farmer, surveyed in (? next few words) frurs uanee of an Order dated the first day of August 1766 on the 9th day of December 17 66 situate on shovers Run Bedford County. And whereas the said Abra ham Kerns and Naomi Kerns, his wife, have by Indenture bearing even date herewith, conveyed to said William Watson, in fee simple, according to the form and effect of the aforesaid Agreement, the first five above des- cribed tracts, pieces or parcels of land as will appear by reference to said deed. Now this Indenture witnesseth, that the said Abraham Kerns (for and in consideration of part of the above mentioned five hun- dred dollars) and Naomi Kerns his wife, doth hereby grant, bargain and bell unto the said William Watson, his heirs and assigns all the above p. 427 above mentioned and described tract of land, warranted in the name of John Farmer a foresaid, containing one hundred seventy six acres and allowance. To have and to hold the said tract of land with all (?) + singular the appurtenances and hesedilaments thereunto belonging, to the said D. William watson, his heirs and a signs forever, for such estate, sight, ti- tle, interest and claim as the grantors hath or had in and to the same and for no other whatever, except only, that the said Abraham Kerns hereby cove- nants for himself, his heirs, excutors and administrators to and with the said D. William Watson, his heirs and a signs, that should the owner of said tract of land (which said Kerns pare based at Treasurers sale) appear and redeem the same within the time limited by the law for such re- demption, then said Kerns binds himself to pay said Watson, his heirs and a signs the sum of one hundred dollars.
