Written: February 6, 1883. KINTON, Hugh by Admin. To KINTON, GEORGE W. [or G.] This Indenture made the 6th day of February in the year of our Lord one thousand eight hundred and eighty-three Between WILLIAM AGNEW, Administrator of all and singular as the goods and credits which were of HUGH KINTON late of the in Bedford County and State of Pennsylvania deceased of the one part, and GEORGE G. KINTON of the township same Bedford County and State of the other part. Whereas the said HUGH KINTON in his lifetime and at the time of his death was seized in his demeanor as of fee of and in a house and lot situate in Napier Township said County and State more fully subscribed here often. And whereas letters of Administration of all and singular the goods, chattels and credits which were of the said HUGH KINTON at the time of his death in due form of law committed unto the said WILLIAM AGNEW and whereas the said Administrator at an Orphans Court held in Bedford in and for the County of Bedford presented a petition setting forth that the same HUGH KINTON died intestate seized in his demeanor as of fact of the following real estate to wit a certain Lot of ground situate in Napier Township bounded on the North by Peter Mowry, on the South by Henry Kerr, containing 3 as. [ACRES] 101 ps [PERCHES] and that the personal estate is not sufficient to pay debts and that it was necessary to sell said real estate for that purpose. Whereas it appeasing manifest unto the Court aforesaid that the personal estate of the said HUGH KINTON was and sufficient to pay his debts it was considered and ordered by the said Court on the 5th day of Dec. A.D. one thousand eight hundred and eight-one that the said real estate be sold according to the prayer of the petitioner. And Whereas in pursuance of the said order, and by force and virtue of the laws of the State in such cre made and provided, afterwards, to wit. On the 5th day of February A.D. 1882, the said WILLIAM AGNEW did expose the same to sale, and failed to sell the same, and returned the attempt to sell to Court, and had from time to time the order of sale continued and did expose the said hereinafter described real estate to sale at public virtue and outcry after giving notice thereof according to law, and sold the same unto the said GEORGE G. KINTON on February 5th, 1883 for the sum of two hundred dollars, he being the highest bidder, and that being the highest and best price bidder for the same, which sold on report; thereof made to the Judge of the Court on the 5th day of February A.D. 1883 was confirmed and it was considered and adjudged by the said Court [?] at the same should be and remain firm and stable forever: and good and sufficient security approved by the said Court for the faithful application for the proceeds of [?] has been duly entered as by the records of the said Court more fully and at large appears. Now this Indenture Witnesseth that the said WILLIAM AGNEW administrator as aforesaid for and in consideration of the sum of two hundred dollars to him in hand paid by the said GEORGE W. KINTON And before the unsealing and delivery the receipt whereof he doth hereby acknowledge has granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these present does hereby grant, bargain, sell, alien enfeoff, release and confirm unto the said GEORGE G. KINTON his heirs and assigns all the following described real estate being a lot of ground situate in Napier Township Bedford County and State of Pennsylvania. Beginning at a pine, thence by land of Peter Mowryís heirs, North seventy three and a half degrees, West thirty degrees and nine tenth perches to a post, thence by other land of John Dollard, North sixty four and a quarter degrees, East fifty and five tenths perches to a post, thence by land of Henry Kerr, South fifteen and a quarter degrees, West thirty four and one tenths perches to the Beginning, containing 3 As & 101 Ps [3 acres and 101 perches] and allowance said real estate having been purchased from John Dollar and wife in the year 1869 March 11th as per deed. Together with all and singular the ways, waters, water-courses, rights, liberties, privileges, hereditaments, and appurtenances which so ever thereunto belonging or in any wise appertaining and the reversions, and remaining rents, issues and profits thereof, and also all the rights, title, interest, property, claim and demand whatsoever of the said HUGH KINTON in his lifetime at and immediately before the time of his decease, in law, equity or otherwise howsoever, of, in and to or out of the same. To Have and to Hold the said [?] [?] hereditaments and premises hereby granted, or mentioned and intended so to be with the appurtenances unto the said GEORGE G. KINTON his heirs and assigns by these present that he the said WILLIAM AGNEW has not done committed or knowingly or willingly suffered to be done, any act, matter or thing whatsoever whereby the premises aforesaid, or any part thereof, in and, shall or may be charged or encumbered in like, charge or estate or otherwise howsoever. State of Pennsylvania Before me the subscriber Justice of the Peace in and for said County personally came the above named. WILLIAM AGNEW, administrator of HUGH KINTON, deceased and acknowledged the above Indenture to be his act and deed and desired the same might be recorded as such according to law.
