Deed Indenture # 07798 June 24, 1823. This Indenture made the twenty-fourth day of June in the year of our Lord one thousand eight hundred and twenty-three. Between JAMES KINTON and JOSHUA PIERSON, Esquires, Executors of the last Will and Testament of THOMAS KINTON late of Napier Township, Bedford County deceased, of the one part and JOSEPH S. MORRISON of the Borough of Bedford and County of Bedford of the other part. Witnesseth that the said JAMES KINTON & Joshua Pierson, Executors as aforesaid for and in consideration of the sum of three thousand one hundred and thirty-six dollars lawful money of the State of Pennsylvania to them in hand, well and truly paid, by the said JOSEPH S. MORRISON at and before the sealing and delivery thereof, the receipt whereof they do hereby acknowledge, and thereof do acquit and forever discharge the said JOSEPH S. MORRISON his heirs, executors and administrators, by these present have granted, bargained, sold, aliened enfeoffed, released and confirmed, and by these present do grant, bargain, sell, alien, enfeoff, release and confirm unto the said JOSEPH S. MORRISON and to his heirs and assigns All that certain tract of patented land called "CANTON" situate on the Raystown Branch of Juniata in Napier Township, Bedford County. Beginning at a pine tree on the bank of the above said Branch, thence by land of GEORGE MULLIN, Esquire, South twenty-six degrees, East one hundred and sixteen perches to a white Oak and South forty- seven degrees, West one hundred and twenty perches to a white Oak, thence by land of JAMES MAXWELL, Esquire [new John Reynolds], South forty degrees, East forty-one perches to a post and South seventy-one degrees, East eighty-one perches to a white Oak, thence by Buffaloe Ridge, North thirty-seven degrees, East two hundred and eight-four perches to a hickory on the bank of said branch, thence up the same by the several courses thereof two hundred and ninety-five perches to the place of beginning. Containing two hundred and thirty-three acres more or less and allowance of six per cent for roads, surveyed in pursuance of an application No. 2527 entered the 23rd January 1767 by JEREMIAH WARDER who by deed duly executed conveyed the same to THOMAS KINTON and who his last will and testament, duly registered in Bedford, dated the 1st February 1777 and proved the 16 March 1779 devised the premises aforesaid to the said THOMAS KINTON, first and above mentionend twhom a patent issued the 19th day of March A.D. 1789 reference to Patent Book No. 14 page 546 will fully [?]. Also a certain other tract of land adjoining the before described tract situate in the township and county aforesaid. Beginning at a white oak South fifty-two degrees, West forty-three perches to a post, South thirty-two degrees, West seventy-four perches to a hickory, South thirty-seven degrees, West forty-one perches to a post, South fifty- three degrees, East seventy-five perches to a post by a locust, thence North thirty-seven degrees, East one hundred and fifty-five perches to a chestnut oak or post, North fifty-two degrees, West seventy perches to the place of beginning. Containing eighty acres be the same more or less and the usual allowance. Which saw last mentioned tract of land was surveyed for said THOMAS KINTON first above mentioned on the fifteenth day of April Anno Dominio one thousand seven hundred and ninety-three on Warrant dated the 18th day of November 1792 both of which said described tracts of land the said THOMAS KINTON died seized of having first made his last Will and Testament and appointed the said JAMES KINTON and JOSHUA PIERSON, Executors thereof will full power and authority to sell and dispose of all his lands. Togehter also with all singular the houses out and houses, barns, stables, gardens, orchards, meadows, fields, fences, ways, woods, waters, water courses, liberties, privileges , hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the revisions and remainder rents, issues, profits thereof, and also, all the estate right title interest, use trust property propepion[?] claim and demand whatsoever of him the said THOMAS KINTON and at immediately before the time of his decease in law or equity or otherwise, howsoever, of in to or out of the same. To have and to hold the said two above described tracts of land hereditaments and premises thereby granted and released or mentioned or intended so to be, with the appurtenances unto the said JOSEPH S. MORRISON his heirs and assigns, to the only proper use and behalf of him the said JOSEPH S. MORRISON his heirs and assigns forever and the same JAMES KINTON and JOSHUA PIERSON Executors aforesaid for themselves their heirs Executors and administrators do severally and not jointly covenant promise grant and agree to and with the said JOSEPH S. MORRISON his heirs and assigns by these present. That they the said JAMES KINTON and JOSHUA PIERSON, Esq., Executors as aforesaid have not heretofore done committed or willingly or willingly suffered to be done or committed any at matter or thing whatsoever whereby the premises hereby granted or any part thereof is are or shall or may be impeached charged or encumbered in title charge estate or otherwise howsoever. Gettys, Esquire, one of the Commonwealth Justices of the Peace of the said County, personally came the above named JAMES KINTON and Joshua Pierson, Esq. Executors above named and grantors therein mentioned and acknowledged the above Indenture to be their act and deed and desired that the same might be recorded as such according to law.
