Written: March 2, 1854 JAMES KINTON to ALLEN KINTON This Indenture made the second day of March in the year of our Lord one thousand eight hundred and fifty four. Between JAMES KINTON of Napier Township, Bedford County and the State of Pennsylvania, farmer and MARY his wife of the first part and their son ALLEN KINTON of the same place, farmer of the second part. Witnessed that the said JAMES KINTON and MARY his wife for and in consideration of the natural love and affection which they have and bear unto the said ALLEN KINTON and also for and in consideration of the sum of two hundred dollars lawful money of the United States of America unto them well and truly paid by the said ALLEN KINTON at and before the sealing and delivery of these present the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these present do grant, bargain, sell, alien, enfeoff, release and confirm unto the said ALLEN KINTON and to his heirs and assigns all that certain tenement and tract of land lying and being in Napier Township, aforesaid, beginning at a post in the public road from Schellsburg to GEORGE MULLEN'S thence by land now held by JOHN WEIDLEIN SMITH three degrees east one hundred and sixty three perches to a fallen black oak thence by land now held by ANDREW EMMET, north sixty five and one fourth degrees, east one hundred fifty two and four tenth perches to a post in said public road along said road and land of this same tract, north thirty seven degrees, west eighteen perches, north fifty two degrees, west fourteen perches, north twenty five degrees, west eight perches, north sixty degrees, west twenty perches, north fifty six perches, north fifty one and one half degrees, west thirty seven perches to a white oak, north eight degrees, west tweny-nine perches, north thirty seven degrees, west eighteen perches to a post the place of Beginning, containing seventy one acres and forty seven perches and allowance of six percent for roads [?] [?], being part of a larger tract of land containing two hundred and thirty one acres one hundred and ten perches and allowance for surveyed in pursuance of a warrant dated the 10th of November 1788 granted to JOHN KINTON to whom the Commonwealth of Pennsylvania by Patent bearing date the 18th day of March 1816 enrolled in Patent Book H., Volume 13, Page 267 confirmed to the said JOHN KINTON his heirs and assigns forever whose right of, in, to the same sundry deeds and assurances in the last duly had and taken became rested in the said JAMES KINTON part hereto his heirs and assigns forever. Together with all and singular the houses, barns, stables, woods, ways, water, water-courses, rights, liberties, privileges here, instruments and appurtenances whatsoever hereunto belonging or in any wise appertaining and the revisions remainders, rents, issues and profits thereof, and all the estate, right, titles, interest , property claim and demand whatsoever of them the said JAMES KINTON and MARY his wife in law equity otherwise however, of in and to the same and every part thereof. To have and to hold the said [?] , tenement and tract of seventy-one acres and forty seven perches of land and allowance and ? and premises hereby granted or mentioned and intended so to be [?] the appurtenances whatsoever thereunto belonging unto the said ALLEN KINTON his heirs, and assigns, to and for the only proper use and behalf of the said ALLEN KINTON his heirs and assigns forever. And the said JAMES KINTON and MARY his wife for themselves, their heirs, executors, and administrators do by these present, covenant, grant and agree to and with the said ALLEN KINTON his heirs and assigns, that they the said JAMES KINTON and MARY his wife and their heirs all and singular the here testament and premises herein above described and granted or mentioned and intending so to be, with the appurtenances unto the said ALLEN KINTON and his heirs and assigns, against them the said JAMES KINTON and MARY his wife and their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend, In Witness whereof this said parties to these present have hereunto interchangeably set their hands and seals dated the day and year first above written. Be it remembered that on the second day of March Anno Domini 1854 before me one of the Justices of the Peace of said County personally came the above named JAMES KINTON and MARY his wife and acknowledged the above Indenture to be their act and deed and desired that the same might be recorded as such, according to law. She, the said MARY being of full age and being by one in due form of law, examined separate and apart from her said husband, and the full contents of the above deed being by me made known to her, she, upon such separate examination, declared that she did voluntarily, and of her own free will and accord seal, and as her act and deed, deliver the same, without any coercion or compulsion of her said husband.
