Deed Indenture # 13145 Robert KINTON, Son of Thomas KINTON & Rachel LARIMORE Dated: Nov. 2, 1839 ROBERT KINTON, heirs To JOHN STRAWSBAUGH This Indenture made this 2nd day of November A.D. 1839 between MARTHA KINTON widow of ROBERT KINTON deceased and JOHN KINTON and Mary his wife, JOSEPHUS FLAHARTY and RACHEL his wife formerly RACHEL KINTON, MARTHA PRICE late MARTHA KINTON, JAMES KINTON, ELIZABETH KINTON, ROBERT KINTON and Elizabeth his wife, JANE KINTON, THOMAS KINTON and Polly his wife, heirs at law the aforesaid ROBERT KINTON deceased all of Richland County and the State of OHIO of the one part and JOHN STRAWSBAUGH of Bedford County, Pennsylvania of the other part. Witnesseth that the part of the first part for and in consideration of the sum of the form of one hundred dollars to them in hand paid by the paid Strawsbaugh part of the second part the receipt whereof is hereby acknowledged and thereof acquit and forever discharge the said JOHN STRAWSBAUGH his heirs executors and administrators have granted, bargained, sold and released and confirmed, and by these present do grant bargain sell release and confirm unto the said JOHN STRAWSBAUGH and to his heirs and assigns, all that certain tract of land situated in NAPIER TWP., Bedford County, Pennsylvania, warranted in the name of SAMUEL CASIN for and containing one hundred and four acres and one hundred and seven perches adjoining lands warranted in the name of James Humphreys and others, being the same tract of land which said ROBERT KINTON deceased by articles of agreement made by THOMAS HUNT his agent with a certain PHILIP SHAFER agreed to sell to said SHAFER for one hundred dollars forty dollars part thereof having been paid by said SHAFER who died without paying the balance and the said Thomas Hunt as agent of paid KINTON and acting as administrator of said SHAFER under the order of the Orphans Court of Bedford County, Penns. Sold said lands to JOHN WEST for fifty one dollars who conveyed the said lands to said THOMAS HUNT who sold the same to said STRAWSBAUGH. Together with all and singular the buildings, improvements, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions, remainders, rents, issues and profits thereof, and all the estate right title interest property claim or demands, whatsoever of them the party of the first part in law or equity or otherwise of into or out of the same. To Have And To Hold the said tract of land above described with all the hereditaments and premises, hereby granted with all the privileges and appurtenances unto the aforesaid JOHN STRAWSBAUGH his heirs and assigns, to their only proper use benefit and behoove of the said JOHN STRAWSBAUGHhis heirs and assigns forever. In Witness whereof the said parties hereunto interchangeably at their hands and seals the day and year first above written. Before me the subscriber one of the associate judges of the Court of Common Pleas of said County, personally came the within named MARTHA KINTON, JOHN KINTON and Mary his wife, Josephus (Joseph) FLAGHARTY and RACHEL his wife, MARTHA PRICE, JAMES KINTON, ELIZABETH KINTON, ROBERT KINTON and Elizabeth his wife, JANE KINTON, THOMAS KINTON and POLLY KINTON and separately acknowledged the signing and sealing of the same to be their voluntary act and deed for the purposes therein expressed and the said MARY KINTON, RACHEL FLAHARTY, POLLY KINTON, and ELIZABETH KINTON wife of ROBERT KINTON and ELIZABETH wife of JAMES, being by me examined separately and apart from their said husbands and the contents to them made fully known they severally acknowledged the signing and sealing of the same to be their act voluntarily without any fear or coercion of their said husbands and that they still therewith content and fully satisfied, Given under my hand and seal this 2nd day of November A.D. 1839. Before them, the foregoing deed appears to have ben signed and acknowledged and whose genuine signature appears thereto affixed was at the time thereof and now is an acting associate Judge within and for the County aforesaid duly commissioned and authorized so to act according to law and in whose official acts as such full faith and credit are we as well in courts of record as elsewere.
