All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/bedford/ ________________________________________________ Bedford County, PA Deed Book B, Page 42-43 Dated 2 Dec 1780, Recorded 26 Apr 1784 JAMES MARTIN to ELISHA PRICE Know all Men by these presents that I JAMES MARTIN of the Township & Providence in the County of Bedford in Pennsylvania Esquire for and in Consideration of the Sum of Seventeen hundred pounds Lawful Money of Pennsylvania unto me in hand paid by ELISHA PRICE of the Borough and County of Chester in Pennsylvania aforesaid Esquire at and before the sealing and Delivery hereof the Receipt and payment whereof is hereby Acknowledged have Granted bargained Sold Released and Confirmed and by these presents do Grant bargain sell Release and & Confirm unto the said ELISHA PRICE his heirs and assigns A Certain Messuage Plantation and Tract of Land situate lying and being on both sides of the River Juanita in the said Township of Providence in the County of Bedford aforesaid about six Miles below the Crossing of Juanita afor'd Containing Three hundred Acres or more adjoining the Lands of ADAM YOUNG down the said river and bounded easterly by the same and Vacant land and adjoining the Land of WILLIAM WILSON up the said River and bounded Westerly by the same and bounded Northerly and Southerly by the same and by Vacant Land which said Tract is now in the Tenure of WILLIAM WILSON and on which Tract there is about Sixty acres of very good bottom for Meadow some peach Trees and other fruit trees a log Dwelling house a few acres of Land Cleared and Fenced in and the rest thereof Good Timber Land Together with the Houses Buildings Improvements Woods Meadows Ways Waters Water Courses Fishings Fowlings Huntings minor mineral Rights Liberties Privileges Heriditaments and appurtenances whatsoever therein to (belonging or in anywise appertaining and the Reversions and Remainders Rents issues and property thereof To Have and To Hold the said Messuage Plantation And Tract of Three hundred Acres (or more) of land - Heriditaments and Premises hereby granted or mentioned so to be with the Appurtenances unto they said ELISHA PRICE his heirs and Assigns To the only proper use and behoof of him the said ELISHA PRICE his heirs and assigns for ever Under and Subject to the purchase Money and Quit Rents if any thereby to the Chief Lord or Lords of the fee thereof And I the said JAMES MARTIN for myself my heirs Executors & Administrators do Covenant & promise and grant to and with they said ELISHA PRICE his heirs and Assigns by these presents that I the said JAMES MARTIN and my Heirs the said Messuage Plantation and Tract of land Heritidaments and premises hereby Granted or mentioned so to be with the Appurtenances unto the said ELISH PRICE his heirs and Assigns against me the said JAMES MARTIN and my Heirs and against all and Every other person and persons whatsoever Lawfully Claiming or which shall or may Claim the same or any part thereof (the Lords of the fee in respect of the original Purchase Money & Quit Rents or afas'd only Excepted) shall and will warrant and forever defend by these presents and that I the said JAMES MARTIN shall and will within one year from the date hereof will and sufficiently procure the said hereby Granted Tract of land to be well and accurately Surveyed and Marked and Described and the draught of which Survey under the hand of the Surveyor will cause to be Delivered unto the said ELISHA PRICE at my own proper cost and Charges or in case of his Death within one year then to be Delivered to his heirs and assigns and for the true performance of all and Singular the Covenants and Agreements aforesaid I do hereby bind myself my heirs Executors and administrators unto the said ELISHA PRICE his Executors administrators and assigns in the Penal Sum of Thirty four Hundred pounds Lawful Money of Pennsylvania firmly by these presents. In Witness whereof I have hereunto set my hand and seal the second day of December in the year of our Lord one thousand seven hundred & Eighty. JAMES MARTIN Sealed and Delivered in the presence of us JOHN GARDNER, JOHN GRIFFITH Received the day of the date of the above deed poll of the above named ELISHA PRICE Esqr. The sum of Seventeen hundred pounds Lawful Money of Pennsylvania bring the full Consideration Money for the above granted Land & premises I say received. Witness & unto £1700 per me. JAMES MARTIN. JOHN GARDNER, JOHN GRIFFITH Commonwealth of Pennsylvania ss: Be it remembered that JOHN GARDNER Esquire personally appear before the Honorable THOMAS McKEAN Esquire Chief Justice of the Commonwealth of Pennsylvania aforesaid on the fifth day of March in the year of our Lord one thousand seven hundred & Eighty & in at the City of Philadelphia and made oath that the said JAMES MARTIN Esq the within Named Grantor sign seal and Deliver the within Conveyance as his Act & Deed that the same JOHN GARDNER Subscribed as a Witness to the Execution thereof of his own proper handwriting and that he also saw JOHN GRIFFITH Subscribe his Name thereunto another witness thereof In Testimony whereof I the said Chief Justice hath hereunto set his hand & seal the same day & year above said.
