Sipes to Mary Jane Cobles Dated July 9th, 1894 Colerain Township For Consideration of $240.00 #33699 [Hand written deed (_____) Conveys words or words unable to be read on original document.] This indenture made on the Ninth day of February in the year of Our Lord One Thousand and Eight Hundred and Eighty - Ninety One. Between James H. Sipes and Louisa F. Sipes of West Providence Township, Bedford County, Pennsylvania, as parties of the first part, and Mary Jane Cobles of the Township of Colerain, County of Bedford and State of Pennsylvania, the foresaid, the second part. Witnesses to this: That the said parties of the first part, fore most in consideration of the sum of Five Hundred Dollars, lawful money of the United States of America, unto them well and truly find said party of the second part, at and before unsealing and delivery of these presents the receipts where by here acknowledged, have agreed, bargained, sold, in lieu; _____ ______released, conveyed and confirmed, and by these presents, confirmed, and by these presents do grant, bargain, sell, in lieu_________, release, convey, and confirm unto the said party of the second part her/him, I assign all that certain piece or lot of ground situated in the Township of Colerain in the County of Bedford and State of Pennsylvania, bonded and descended as follows: To within the beginning at an apple tree on the Eastern bank of Rainsburg Run near where it empties into Cove Creek, north eighty four degrees, east twenty benches to the apple tree at the public road, then hence north sixteen degrees east twenty-four and four tenths benches with the public road center of the bridge on Cove Creek thence south fifty seven degrees west thirty and eight tenth benches to the place of the beginning, containing two acres reserving nevertheless the free and unrestricted rights to the water for the use of the mill immediately below, which Henry H. Smith and Susannah his wife, by their deed dated and sealed the fourth day of June AD 1869. Granted and conveyed to them the same said. Nancy Smith her/him assigns and conveyed by Joseph Amos Clerk of Orphans Court to James H. Sipes, in pursuance of a order of the Orphans Court of Bedford County made on this date September AD 1889, as well means fully appears and references being that to Orphans Court Docket. Together with all and singular building improvements, ways, waters, water courses, rights, liberties, privileges, here and ___________ and ________ what so ever in this unto belonging or in _____________ _____________ and the remains and remainder, rents, issued and profits there of, and all the estate, rights title, interest, property, claim, and demand whatsoever of the said parties of the first part, in lieu _____or otherwise________affirm, and to the same and every part thereof. To have and to hold the said tract or lot of land, here filaments and promises hereby granted or mentioned and intended as to _______ wish the apart courses unto the this said second party of the second part her heirs and assigns to and for the proper use be host of the said party of the second part her heir and assigns forever. And they the said James H. Sipes and Lousia F. Sipes, his wife, the said part of the first for their heirs, executor, administrators, to but this present, convant, grant and agree to with hereditaments and premises herein above described and granted or mentioned and intended as to be with the _______ unto the said party of the second part heirs and assigns against them the said parties of the first part and their heirs and against any and all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and from defend. I am witness whereof the said parties of the first part to these presents have set their hands and seals. Dated this day and year first above written, signed and sealed and delivered in the presents of us: Job Sherin, G.W. Richey Commonwealth of Pennsylvania, Bedford County Also I witnessed on the Ninth day February AD 1894 before me the Justice of the Peace for Bedford County, Pennsylvania came to the above mentioned James H. Sipes and Louisa F. Sipes his wife, and acknowledged the above indenture to be this act and deed, and desired the same to be recorded as such. The said Louisa F. Sipes, being of full age, and by me examined separate and apart from her said husband, will and ascend, sign and seal, and as her seal and deed, deliver the same without any concern or compulsion of her said husband.
