Page 333, 334,335. Deed Indenture # 11840. Written: April 17, 1851 Geo. WERTZ heirs} To } Samuel S. Stuckey} This Indenture made the seventeenth day of April in the year of our Lord one thousand eight hundred and fifty one. Between MARY TAYLOR by her son JOHN TAYLOR her attorney lawfully constituted such by letter of attorney under her hands and seal leaving seal the sixth day of April A.D. 1839. THOMAS WERTZ and EVE his wife, ELIZABETH WERTZ since intermarried with JAMES KINTON, ROSANNAH WERTZ since intermarried with PETER MOWRY and ARAMINTA WERTZ heirs of GEORGE WERTZ late deceased all of Napier Township, Bedford County and State of Pennsylvania of the one part and Samuel S. Stuckey of the same place of the other part. Witnessed that the said MARY TAYLOR by her attorney JOHN TAYLOR as aforesaid, THOMAS WERTZ and EVE his wife, JAMES KINTON and ELIZABETH his wife, PETER MOWRY and ROSANNAH his wife and ARAMINTA WERTZ heirs as aforesaid for and in consideration of the sum of nine hundred and thirty three dollars and one third cents to them in hand paid by the said Samuel S. Stuckey at and before the unsealing and delivery here of the receipt where of they do hereby acknowledge and there of acquit and forever discharge the said Samuel S. Stuckey his heirs, ancestors and administrator by these present have granted, bargained, sold, aliened, enfeoffed, released and confirmed and by these present do grant, bargain, sell alien, enfeoffed, release and confirm unto the said Samuel S. Stuckey and to his heirs and assigns all that contain message and tract of land situate in Napier Township aforesaid in Millegans Cove on the Raystown branch of the Juaniata branch and described as follows to wit __ Beginning at as past thence by land part of this tract more in the tenure of THOMAS WERTZ, south sixty-one degrees, east one hundred and seventy perches to a chestnut, thence by land of Nicholas Night, north by forty-four degrees, east eight-nine perches to a large chestnut oak, thence by same north eighteen degrees east eight-two perches to a hickory, thence north fourteen degrees, west one hundred and forty-four perches to a black oak, thence by surveyed lands north sixty-four degrees, west thirty-two perches, to a Spanish Oak, thence by land of Soloman Adams, south thirty-five degrees, west one hundred and thirty-nine perches to a white oak and thence by land of John McCormick south twenty-nine and five thirds degrees west one hundred and twenty-one perches to the beginning containing two hundred and forty-four acres and the ranch allowance of six percent for roads [?] being a part of the same track of lands which the Commonwealth of Pennsylvania in Patent Book "H" Volume 36, Page 209, for the consideration therein mentioned did grant and confirm unto GEORGE WERTZ aforesaid since deceased in fee who being so thereof lawfully seized died Intestate leaving issue MARY, THOMAS, ELIZABETH, ROSANNAH, and ARAMINTA the afore named heirs and intermarried as aforementioned to whom the same by the laws of Pennsylvania did descend and come --- Together with all and singular Ahes [?] the houses and horses, buildings, [?], stables, ways [?]: woods, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or many wife appertaining and the reversions and remainders rents issues and profits thereof and also all the estate right little interest property claim and demands whatsoever of them the said MARY, THOMAS, ELIZABETH, ROSANNAH and ARAMINTA heirs as aforesaid in law or equity as the wise howsoever of into as and of the same. To have and to hold the said messeagos tenement and tract of two hundred and forty-four acres of lands hereditaments and promises hereof granted or mentioned or intended so to be with the appurtenances unto the said Samuel S. Stuckey his heirs and assigns to the only proper use and behalf of the said Samuel S. Stuckey his heirs and assigns forever.. and the said MARY, THOMAS, ELIZABETH, ROSANNAH and ARAMINTA heirs as aforesaid for themselves their heirs, executors and administrators with covenant, promises, grant and agree to and with the said Samuel S. Stuckey his heirs and assigns by these present that they the afore named heirs and their heirs the said aforementioned and described messnageos [?] tenement and tract of lands hereditaments and premises hereby granted or mentioned as intended so to be with the appurtenances unto the said Samuel S. Stuckey his heirs or assigns against them the said MARY, THOMAS, ELIZABETH, ROSANNAH, and ARAMINTA heirs as aforesaid and their heirs and against all and every other person and persons whomsoever lawfully claim [?] to claim the same or any part there of. Shall and will Warrant and forever Defend by these present. In witness whereof the Said parties to these present have [?] to us their hands and seals dated the day and year first above written signed and sealed May 14th 1841 by one sealed and delivered in the presence of us John P. McVicker as Justice of the Peace in and for the County of Bedford the within named PETER MOWRY and ROSANNAH his wife and acknowledge the within Indenture to be there act and deed and desired that the same might be recorded as such according to Law that ROSANNAH being of full age and by me duly examined separate and apart from her said husband and the contents thereof being first made known to her declare that she did voluntary and of her own free will and accord seal and as his act and deed deliver the said Indenture without any coercion or compulsion of her said husband ñ In testimony whereof I have hereunto set my hands and seal the fourteenth day of April 1837.
