Page 336, 337. # 11842 Written: January 31, 1845 John WERTZ heirs } To } Samuel S. Stuckey } This Indenture made the thirty-first day of January one thousand eight hundred and forty-five. Between Elizabeth WERTZ, George WERTZ, Hawthorne ADAMS and Mary wife of the County of Beaver in the State of Pennsylvania and ELIZA WERTZ wife of Christopher WERTZ of the City of Allegheny in the State of aforesaid by their attorney in fact the said CHRISTOPHER WERTZ of the said City of Allegheny lawfully constituted such by their Power of Attorney duly executed and acknowledge bearing date of the 17th day of June 1844. The said CHRISTOPHER WERTZ being the legal heirs and representatives of JOHN WERTZ late deceased of the one part and Samuel S. Stuckey of Bedford County and State aforesaid of the other part. Witnessed that where as contain GEORGE WERTZ late of Napier Township in Said County of Bedford (deceased) being in his lifetime seized of a certain tract of land containing two hundred and forty-four acres situate in said Township of Napier now Harrison+ bounded by lands of Hezekiah Miller on the east, THOMAS WERTZ heirs on the south, and by others on the north and west and whereas the said GEORGE WERTZ died testate [intestate] and by his will and Testament did devise and bequeath the aforesaid tracts of lands to his daughter ARAMINTA and whereas ? ?[this needs to be checked] of the heirs of GEORGE WERTZ being dissatisfied therewith. The said ARAMINTA by her contract with the other heirs aforesaid did by her contract dated some two years since did as her act and deed agree to and [?] the heirs aforesaid. That the said lands should be sold and each heir become equal in the distribution of the proceeds of said sale and amongst others of the heirs of said GEORGE WERTZ (deceased) was JOHN WERTZ and whereas the said JOHN WERTZ is since deceased and leaving issue and legal heirs at law the said CHRISTOPHER, GEORGE and MARY who is intermarried with HAWTHORNE ADAMS. Now Know all men by these present that we ELIZABETH WERTZ, GEORGE WERTZ, HAWTHRONE ADAMS and ELIZABETH wife of the CHRISTOPHER by our lawful attorney the said CHRISTOPHER WERTZ and also the said CHRISTOPHER WERTZ personally for divers ? good cause and especially for the sum of one hundred and sixty-one dollars lawful money of the Unites States to us in hand paid by the said Samuel S. Stuckey the receipt whereof is hereby acknowledged have released demised and by these present [? ?] release and forever [?] claim to the said Samuel S. Stuckey his heirs and assigns all and [?] our claims , right, title, interest in property of whatsoever vested in us as the legal heirs and representatives of the said JOHN WERTZ deceased under and by virtue of the contract made of the said ARAMINTA WERTZ with the heirs of the said GEORGE WERTZ deceased. Hereby forever discharging to and [?] claim whatsoever of all our right, little, interest, property, claim or demand whatsoever of into or out of the same. As fully and entire to all intent and purposes hereby intended until the said Samuel S. Stuckey and the said ELIZABETH WERTZ, GEORGE WERTZ, HAWTHORNE ADAMS and MARY his wife and ELIZA WERTZ, wife of CHRISTOPHER WERTZ by their agent the said Christopher and the said Christopher WERTZ for themselves their heirs and assigns as hereby release, quit, claim and forever discharge any claim or right whatsoever in them their heirs or assigns bested to the said Samuel S. Stuckey fully and entirely discharging themselves from any claim whatsoever here after of into or out of the said promises hereby released and discharged. SS Personally appeared before me the subscriber as Justice of the Peace in and for said County by Christopher WERTZ the Grantor in the above Deed of Trust Claim and acknowledged the same to be his act and deeds and desired that the same might be recorded as such according to law.
