We encourage links to the state and county table of contents. ---------- DEED INDENTURE between Christian Wertz and Henry Deer (1807) ---------- Deed Indenture # 3152 Book G, Page 511, Bedford Twp., Bedford Co., PA Written: September 9, 1807 CHRISTIAN WERTZ To HENRY DEER "This indenture made the ninth day of September, in the year of Our Lord One Thousand Eight Hundred and Seven between HENRY DERR of Bedford Twp, Bedford Co, and State of PA, Yeoman, of the one part and CHRISTIAN WERTZ, of the said Twp, county, and state aforesaid, of the other part, Witnesseth. Whereas the said HENRY DERR, by eight certain obligations bearing equal date, (herewith or liencige all) hands the (borne or same) unto the said CHRISTIAN WERTZ in the sum of four hundred pounds lawful money of PA. Conditions for the payment of two hundred pounds, like lawful money, in the manner following. Viz, twenty five pounds to be paid on the first day of Sept, 1808, the further sum of twenty five pounnds on the first day of Sept, 1809, the further sum of twenty five pounds on the first day of Sept, 1810 (etc. in the same manner until) and the further sum of twenty five pounds lawful money aforesaid to be paid onto the said CHRISTIAN WERTZ on the first day of Sept, 1815. Now this Indenture, Witnesseth, that the said HENRY DERR, as well for and in consideration of the aforesaid debt or sum of two hundred pounds, lawful money aforesaid, and for the latter receiving the payment thereof, to the said CHRISTIAN WERTZ, his executors, administrators or assigns in discharge of the said jecited (?) obligations as also for and in the consideration of the further sum of five shillings lawful money aforesaid to him the said HENRY DERR in hand paid, the receipt whereof is hereby acknowledged hath granted, bargained, sold, aliened. enfeossed (?), released and confirmed, and by these presents, other grant, bargain, sell, alien enfeoss, release and confirm unto the said CHRISTIAN WERTZ, his heirs, and assigns, the following bounded and described tract of land call "LUZERNE" situated on the West side of the RAYS TOWN BRANCH of the JUNIATA RIVER in Bedford Twp and county aforesaid. Beginning at a post thence by land of SOLOMON ADAMS South fifty nine degrees East eighty five perches to a Post. South one degree and a half West ninety perches to a Thorn Bush, South West forty eight perches to an Elm. Thence by land of JAMES WIXWELL, North seventy three degrees and an half West fifty two perches to a White Oak. Thence by the same (?) and surveyed land South thirty (?) degrees West one hundred and sixty three perches to a White Oak. Thence by surveyed land North fifteen degrees West one hundred and ninety two perches to a post, North seventy nine degrees East sixty perches to a post. Thence by land of JOHN KENTON, South six degrees East thirty eight perches to a Black Oak, and North sixty two degrees East one hundred and sixty perches to the beginning, containing two hundred and twenty three acres three quarters and allowance of sixth. Cert (?) for & which said tract of land was surveyed in pursuance of a warrant dated 25th July, 1794 granted to the said JOHN ANDERSON who by deed dated 2nd June, 1796 conveyed the same to JAMES ANDERSON JR. who by deed dated on the 2nd day of June, 1796 conveyed the same to the said CHRISTIAN WERTZ, with the appurtenances - to have and to hold; the aforesaid Tract of Land, and all and singular the premises hereby granted with the appurtenances unto the said CHRISTIAN WERTZ, his heirs and assigns forever provided always & ever , that if the said JOHN DERR, his heirs, executors, administrators or either of them do and shall well and truly pay or cause to be paid to the same CHRISTIAN WERTZ, his certain attorney, heirs, executors, administrators or assigns, the aforesaid debt or sum of two hundred pounds lawful money, by the installments, herein before mentioned, on the day and times herein before respectively appointed for the payment thereof, according to the said executed obligations without fraud or further delays and without any deflation or abatement whatsoever. That then (but not otherwise) this Indenture and the estate hereby granted, and the said recited obligations, shall, cause, and become absolutely void, any thing therein contained to the contrary, in anywise notwithstanding.
