In the name of God I Jacob Burket considering the uncertainty of this mortal life and being of sound mind and memory (Blessed be Almighty God for the same) do make and publish this my last will and testament in manner and form following (that is to say) first I will and bequeath unto my beloved wife Julian Burket the use and profit of the plantation situate in Union township in the county of Bedford formerly belonging to my father so long as she remains my widow and also two horses and the necessary gears, one plough and harrow so long as my youngest son Jacob stays with her or until he is twenty-one years of age then it is to be sold and divided along with rest of my estate. Secondly it is my wish that all my just debts as shall be by me owing at my death together with my funeral expences and all charges touching the proving of or otherwise concerning this my will, shall in the first place out of my personal estate and effects be fully paid and satisfied. Thirdly it is also my wish if my son Samuel Burket wishes to take the tract of land where he now lives on which I bought of Leonard Berkhimer: also in Union township and Bedford county that he shall have it for four hundred and fifty dollars by paying to my executors two hundred dollars out of said property one hundred dollars in one year after my death and one hundred dollars in one year thereafter to be applied to my just debts if my personal estate should not be sufficient to pay them and if after a final settlement of all my estate, real and personal it appears that my son Samuel paid too much out of said tract of land it shall be paid back to him again out of my real estate, if not enough he shall pay the balance or that there will be an equal divide among all my children namely John Burket; Samuel Burket; Mary Burket; Elizabeth Burket; Thomas Burket; Barbara Burket; Jacob Burket; and Margaret Burket; share and share alike. If my son Samuel Burket refuses to take the said tract of land any of the rest of my children shall have the same offer upon the same conditions. Fourthly it is also my wish that the remainder of my real estate should not be sold until my youngest child is twenty one years of age but shall be rented out by my executor on such terms as he shall think best and then it shall be sold and the proceeds thereof to be equally divided among all my said children share and share alike, so that they all get equal shares of all my estate real and personal. Except those that is not married at my death, they shall have out of my real estate each fourteen dollars in place of a cow that those that are married here already got. Fifthly it is my desire that my beloved wife Julian Burket is to have the stove is in the house, one bed and the table in the house and kitchen as much as she needs. And I make and ordain Frederick Stiffler sent executors of this my last will and testament in witness whereof I have hereunto set my hand and seal the fifteenth day of June in the year of our Lord, one thousand eight hundred and thirty seven.
