THE LAST WILL AND TESTAMENT OF JOHN CRISMAN In the name of God Amen. I John Crisman of the Township of Bedford in the County of Bedford and State of Pennsylvania farmer being weak in body but of sound and disposing and memory and knowing that it is appointed unto all men one to die and that it is their duty so to dispose of their worldly things wherewith it hath pleased God to bless them with in this life so as to make them most beneficial to those who we leave behind us do make ordain constitute and appoint and declare this to be my last Will and Testament. In the first place I recommend my soul to God who gave it and request that my body shall be buried in a decent and Christian like manner at the discretion of my Executors hereafter named. Item, I do order that all my just debts and legal debts be paid by said Executors as soon as convenient and that all debts due to me be called in in the same manner. Item I give and grant and devise unto my dearly beloved wife Hannah fifteen pounds in cash to be paid to her immediately after my decease and twelve pounds annually to be paid by my executors during her natural life to be paid every six months. Her Bed, Desk, Saddle & Bridle, two cows and such household furniture as she may think necessary, of which no appointment shall be made. she is to have the room generally known by my room and the room upstairs immediately above for her use during her natural life with liberty to use the Cellar, Kitchen and Water in common with my son Jeremiah whom I allow to live on the land on which I now live during his mothers life at a reasonable moderate rent (and provided any disagreement should arise as to the amount of the rent) my son Jeremiah is to choose a discreet freeholder who with my Executors are to assertain the rent. Item I give and bequeath to my son Jeremiah one hundred and twenty five pounds lawful money of Pennsylvania his choce of two mares, one plough and harrow my waggon and gears for two horses belonging to the waggon and one cow. My son Jeremiah is to provide hay for his mother's two cows and stabling with sufficient firewood cut by the door for her use also to let her have the use of a horse to ride when she may think proper. Item I give and bequeath to my son William Crisman nineteen acres and seventy nine perches of Land part of a tract on which he now lives in the name of William Lyon to have possession thereof six months after my decease which I had preserved to myself when I conveyed the other part to him. Item I give and bequeath to my son John Crisman seventy five pounds lawful money aforesaid. Item I give and bequeath unto my son Benjamin Crisman seventy five pounds lawful money aforesaid and one cow. Item I give and bequeath unto my daughter Sarah Brown fifty pounds money aforesaid. Item I give and bequeath to my daughter Catharine Flegle fifty pounds money aforesaid. Item I give and bequeath unto my daughter Mary Swager fifty pounds money aforesaid. Item I give and bequeath unto my daughter Rachel Wertz fifty pounds money aforesaid. I give and bequeath unto my daughter Hannah Hull fifty pounds money aforesaid. Item I give and bequeath unto my daughter Ruth Crisman, wife of Elijah Crissman, fifty pounds money aforesaid. Item I give and bequeath unto Abigal my grand daughter one cow one bed bedstead and bedding one spinning wheel and one iron pot. I give and beequeath unto John and Elizabeth children of George Crisman deceased each ten pounds money aforesaid and it is further my will that the tract of Land on which I now live shall be rented by my Executors and in case of disagreement to proceed as aforesaid to my son Jeremiah. Next Spring Jeremiah to have one third of all the Somer and Winter crop that is now growing on the land on which I now live the other two thirds to be delivered in the bushel and one half the hay in the barn or in the stack to my Executors for the use of my estate. Jeremiah is to pay one third of the hands in cutting hawling and threshing thereof and the other expenses to be paid out of my estate by my executors. The tract of land on which I now live I order and direct my Executors or the survivors or survivor of them to sell one year after my wife's decease One tract of Patent Wood land to be sold when my Executors or the survivors or survivor of them adjudge it necessary any time within five years after my decease, the above legacies to be paid to the respective legatees after my wifes decease and sale of the tract of land on which I now live always paying the eldest first as the money may be received by my Executors except as to the cash on hand Bonds Notes and Book accounts and all my movable property not already bequeathed shall be delivered to and among the several legatees or their guardians in proportion to the above bequeaths as soon as the money can be collected and after satisfying the above bequeaths respectively and any surplus should remain it to be divided between my sons and daughters now living two thirds between my sons equal and, the other third between my daughters equal and that the conditions of this my last Will and Testament may be fully executed and completed I do hereby nominate and appoint my dearly beloved wife Hannah and my son William Crisman and Valentine Wertz my Executors. In witness thereof I have hereunto set my hand and seal this twentieth day of May Anno Domini eighteen hundred and five. Personally appeared before me the Subscriber Register for the Probate of wills and granting Letters of Administration in and for said County John Scott and Nathan Hammond the subscribing witnesses to the foregoing will, the said John Scott being duly sworn and Nathan Hammond affirmed do say that they were personally present and heard and seen John Crisman the Testator sign seal and publish pronounce and declare the foregoing Instrument as and for his last Will and Testament, that at the time of doing thereof the testator was of sound and disposing mind and memory according to them they subscribed their names thereto as witnesses at the instance of the Testator and at his request.
