Bedford County, Pennsylvania, probated 1823 November 10th 1822 in the name of God Amen I John Hoy of Bedford County providance township and state of Pennsylvania being sick and weak in body, but of sound mind memory and understanding praised be god for it and considering the certainty of death and the uncertainty of the time thareof and to the end I may be the better prepared to leave this world whenever it shall please God to call me hence to therefore make and declare this my last will and Testament in manner following that is to say, first and principally I commend soul into the hands of Almight God my creator hoping for free pardon and remission for all my sins and to enjoy Everlasting happiness in the heavenly kingdom through Jesus Christ my Saviour my body I commit to the arth at discretion of my executors hearin after named and I give all my messages Lands tenements &c. First I give and bequeth unto my loveing Wife Catharine all my Lands chattles house hould furniture &c. if so be that my grandchildren John or William Hoy will come and take care of my wife while she liveth then I give and bequeth unto either of them all my lands chittles house hold furniture &c After the death and funeral expenses of my wife if so be that neither of them comes to take care of her while she liveth then she is to give and bequeth the same unto whomsoever she will at her death that whosoever take care of her decently while she lives. And I make and ordain Joseph Sparks senior And Joseph Sparks junior and Amos McDonnal Executors of this my last will and Testament. After naming the executors and revoking all former wills &c. In Witness whereof I the said John Hoy have hereunto set my hand only declaring it to be my last will and testament dated the tenth day of November one thousand Eight hundred and twenditwo John "His X Mark" Hoy {Seal} Witness it Present Nicholas Cooper John "His X Mark" Grimes Ann "Her X Mark" Clark Bedford County SS: Came before me the subscriber Deputy Register of Wills & granting letters of Administration in and for said County Nicholas Cooper & John Grimes two of the subscribing Witnesses to the within and foregoing instrument of writing who being respectfully sworn depose & say that they two were personally present & saw & heard John Hoy the testator sign seal publish & declare the within instrument of writing as and for his last will and testament that at the time of doing thereof the said Testator was of sound & disposing mind memory and understanding to the best of deponants knowledge & belief & that they together with Ann Clark subscribed their names as witnesses there to in the presence of the Testator at his request Nicholas Cooper John "His X Mark" Grimes Sworn to & subscribed the fourth day of February A.D. 1823 before George Burd, Depy Regr.
