Will Book IV. Page 125 & 126. Written: March 8, 1854 Probated March 18, 1854 In the name of God Amen. I JAMES KINTON of Napier Township, Bedford County in the State of Pennsylvania being sick and weak in body but of sound mind and memory and understanding praised be God for it considering the certain of death and the uncertainty of the time thereof and to the end I may be the better prepared to leave this world whenever it shall please God to call me hence do therefore make and declare this my last will and testament in manner following that is to say, just and principally I commend my soul unto the hands of Almighty God my creator, and as to such worldly estate wherewith it hath pleased God to entrust me I dispose of the same as follows. I give and bequeath until my beloved wife MARY KINTON one cow in addition to her dower granted by the laws of this Commonweath, I also give and bequeath each of my four daughters, viz: MARIA, MARY JANE, REBECCA, and ROSEANNA each one cow, I give and bequeath unto my son JEREMIAH KINTON seventy-one acres of land with the usual allowances to be taken off of that part of my olds [farmment ?] and adjoining a piece which I sold to my son ALLEN KINTON and for which as deeds have been executed and I direct that my son JEREMIAH KINTON shall pay as consideration of one hundred dollars to my executors in these years after my decease out of and for the land which I bequeath to him above . I also give and bequeath unto my my son SIMON KINTON all the balance of my real land estate with the buildings and improvements thereunto belonging and out of and for which I direct that he SIMON shall pay to his two youngest sisters; viz: REBECCA and ROSEANNA each one hundred dollars as follows: fifty dollars to be paid each in two years after my decease and fifty dollars to be paid each in three years after my death, and I also direct that my son SIMON shall pay my funeral expenses and that he shall maintain and support his mother during her natural lifetime and at her death bury her decently and he is also to pay all just and legal demands against my estate into the hands of my son ALLEN whom I do hereby nominate ? and appoint executor of this my last will and testament and I also give unto my son ALLEN the [?] [?] and unto my son SIMON [?] [?] [?]. I also direct that one hundred dollars to be placed by JEREMIAH into the hands of my executor shall be appropriated towards paying my just debts and should anything be left after paying my estate, it should be paid to SIMON who is first [?] to all my debts and I do hereby revoke and make all other wills by me made [?] and declare this only to be my last will and testament. In witness whereof I the said [?] have to this my last will and testament set my hand and seal the 8th day of March A.D. 1854. Signed, sealed, published and declared by JAMES [x] KINTON the ? testator us and for the last will and his mark testament in the presence of us who in his presence and at his request and in the presence of each other have subscribed our names as witness thereunto. THEODORE KINTON SIMON KINTON Bedford County, Personally appeared before the Register for the probate of wills for ? County, THEODORE KINTON and SIMON KINTON subscribing witnesses to the foregoing instrument of writing who being duly sworn according to law do depose and say that they were present unto law the testator JAMES KINTON signed his name by marking his mark to the same and heard him pronounce and declare and witnessed of writing to be his last will and testament that he desired them to sign their names as witnesses thereto and at the time of doing he the said testator was of sound mind, memory and understanding to the best of their knowledge and belief.
