NOBLE Died 1879 Waterside, South Woodbury Twp. Bedford County, PA Will Book 5, p. 410 I, William J. Noble, of Waterside, South Woodbury Township, Bedford County, Pennsylvania, being somewhat weak and inferior in body, but of sound mind and memory, considering the uncertainty of life, do make this my last Will and testament, as follows. 1st It is my will and I do order and direct that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease. 2nd I give and bequeath to my dear wife, Rosan, all our household and kitchen furniture of every description in and about the house, together with any stock such as a cow, hogs, &c I may own at the time of my decease, also any meat or provisions of any kind on hand, and all articles of property in the house, out- buildings & stable, the above to be her own, and at her disposal as she may think proper, also the house in which we now reside, the lot of ground around and adjoining the house, the stable, out-buildings &c, all my real estate in the Village of Waterside, the same containing about one third of an acre, for and during the term of her natural life, unless disposed of, by her consent, as will herein after be mentioned. 3rd It is my will and I do order, that in case my wife should at any time desire to leave the property on which we reside, and to have it sold, with the intention of purchasing a lower priced property or for any other reason, then the same shall be sold either at private or public sale, as may be thought best, my children to be consulted as to the sale, and for that purpose, should a sale be made, in like manner, I do hereby authorize and empower my Executrix, herein after named or her successor duly appointed to sign, seal, execute, acknowledge and deliver all such deed or deeds of conveyance as may be requisite and necessary for the granting and assuring the same, to the purchaser or purchasers in fee simple: the terms of the sale to be about what is customary on property of the kind to be sold, and of the proceeds arising from said sale, my wife may, should she so desire, apply a part not exceeding two thirds thereof, to the purchase of another property, and take the title in her own name, in trust for my children herein after named as legatees or those of them who are to receive equal shares of my estate after her decease. 4th It is my will and I do order and direct that whatever may remain of my estate after payments of my debts and all legal claims against the same shall be for the use of my wife during life the same to be put to interest or safely invested, said interest for her use, and should it not be sufficient to enable her to live comfortably, or in case of sickness of herself or the family more should be required, she is to use the principal or so much thereof as may be necessary, my intention being that my wife shall be provided for first, knowing she will do as well for the children as may be in her power. 5th After the death of my wife, whatever may remain of my estate, real or personal shall be disposed of as follows: I give and bequeath unto my four daughters, Susan E. Hoenstine, Charlotte B., Maria Jane and Margurite Ellen, in equal shares or parts, after the death of my wife, all of my estate of every nature and kind that may be remaining at that time and should any of my said daughters die before receiving their parts as aforesaid, without leaving a child or children said part or parts shall then go to or be received by the survivors of said daughters, and the children, if any, of those who have died, as under the intestate laws of Pennsylvania, and should my mansion property remain unsold at the death of my wife, it shall then, or as soon as conveniently can be, be sold by the person who may be appointed administrator with the will annexed in the manner herein before mentioned for a sale, by my Executrix. My three sons, James L., John M., and Edward B. (the latter deceased) having already received more than any of my other children, will be likely to get as legatees under my will, (I having advanced to all of them) is the reason for not naming either of them, or their heirs, as an heir or legatee. And lastly, I hereby nominate, constitute and appoint my dear wife, Rosan, to be the Executrix of this my last will and testament, and I do hereby revoke and annul all wills by me heretofore made. In witness whereof, I have hereunto set my hand and seal to this my last will, written on this and the two foregoing pages, the 31st day of March A.D. 1879. Wm. J. Noble, as and for his last will and testament in the presence of us who at his request and in his presence, have signed as witnesses to the same. John J. Noble Jos. E. Noble Bedford County S.S. Personally appeared before me, the Register of Wills &c in and for Bedford County, John J. Noble and Jos. E. Noble the subscribing witnesses to the last will and testament of William J. Noble, dec'd., who depose and say that they were present and heard the said William J. Noble, dec'd, declare the above instrument of writing to be his last will and testament and that he signed the same in their presence; that they signed their names to the same at his request and in his presence and in the presence of each other, and at the time of so doing, Testator was of sound mind, memory and understanding to the best of their knowledge and belief. Shoemaker, Register Filed proven and Letters Testamentary issued to Roseann Noble this 9th day of August A.D. 1879 she being duly sworn according to law.
