I Elijah Perdew considering the uncertainty of this mortal life and being of sound mind and memory blessed be almighty God for the same do make and publish this my last Will and testament in manner and form following that is to say that all my just debts as shall by me owing at my death together with my funeral expenses and all charges touching the proving of or otherwise concerning this my last Will shall in the first place be paid. Item - I give and bequeath unto my beloved wife Mary Perdew one bed, bedding and bedstead, one side saddle and one hundred and seventy five dollars to be paid in manner following that is to say twenty five dollars in one year from time of my death and annually thereafter twenty five dollars to be paid til the one hundred and seventy five dollars be paid which is in lieu of her third as dower. I further say that all the rest of my property both real and personal and all the profits that may arise there from til my youngest child Racheal Perdew becomes of age I say then that all my Estate both real and personal property shall be appraised and sold and equally divided among my nine children, Mary Wigfield, Archibald Perdew, Nancy Casteel, Nathan Perdew, Rebecca Perdew, John Perdew, Charity Perdew, William Perdew and Racheal Perdew. I further say that my executor shall sell all my personal property and pay my debts as it may go and if it does not reach to pay all my debts my said executor is to take unto the rents of my real estate and settle them to the best advantage that he may think proper. I further appoint my son Archibald Perdew my sold executor of this my last Will and testament thereby revoking all other Wills by me made. In Witness whereof I have here unto set my hand & seal the twenty sixth day of February in the year of our Lord one thousand eight hundred and thirty eight. Elijah Perdew Signed sealed published and declared by the above mentioned Elijah Perdew to be the last Will and Testament in the presence of us who at his request and in his presence have subscribed our names as witnesses there unto. William Ruby John Perdew Jacob Gorden. Bedford Co., Pa Personally appeared before me the subscriber register for the probate of Wills and granting letters of Admiinistration in and for said county, John Perdew, Jacob Gorden, two of the subscribing Witnesses to the above instrument of writing and being dully sworn according to law to dispose and say that they were personally present and heard and saw the testator Elijah Perdew sign, seal, publish, pronounce and declare the said instrument of wriing as and for his last Will and Testament, that at the time thereof the testator was of sound and disposing mind, memory and understanding according to the best of deponants knowledge and belief and that they subscribed their names there to as witnesses in the presence of the testator, at his request & in the presence of each other. John Perdew Jacob Gorden Sworn & Subscribed the 29th day of Sept 1838 before John G. Martin, Reg. Be it remembered that on the 22 day of Sept in the year of our Lord one thousand eight hundred and thirty eight Letters of Testamentary were issued to Archibald Perdew executor of the foregoing Will named he having been first duly sworn according to law.
