PRESSEL, late of South Woodbury Township Dated January 11, 1897; probated June 28, 1897 Decedent died June 9, 1897 I, Jacob W. Pressel, of South Woodbury Township, in the County of Bedford and State of Pennsylvania, Yeoman, being of sound mind, memory and understanding, do make and publish this my last Will and Testament, hereby revoking and making void all former wills by me, at any time heretofore made. And first, I direct that my body be decently interred in the Barley Church Cemetery, in Bloomfield Township, and in accordance with the rites and ceremonies of the Lutheran Church dictating, and that my funeral be conducted in a manner by my friends. As to such estate as it hath pleased God to intrust me with I dispose of the same as follows; viz: -- Item. I give and bequeath to my beloved wife Mary Ann Pressel, all my personal property and Real Estate, in her own right that she may have a bounteous living, so long as she bears my name, or till her death if she remains my widow and survives me, And I do hereby direct that my Executor hereinafter named, shall act in conjunction with his mother to sell a portion of all of my Personal Property and Real Estate during her life towards paying debts, of which I die seized, either at public or private sale or sales to the best advantage which may then be offered. And advise that he or they avoid attorneys commissions and costs, and to effectuate this my will, I do hereby vest in my Executor hereinafter named full power and authority to dispose of my Real Estate in fee simple or otherwise, also to deed the same in as full and large a manner in every respect as I could do if living. Item. If my beloved wife Mary Ann Pressel survive me, and she and my Executor find it necessary towards her support or the payment of debts, to dispose of part or all of my Real Estate if she so desire or from other just causes should sell, I desire that she control the balance of money arising from such sale or sales in her right during her life time, or so long as she remains my widow, as she hereby ahs the right to protect her self. Further, I direct and it is my desire that the net proceeds of my personal and real estate, heretofore ordered by me to be sold at public or private sale or sales, either before or after my beloved wife's death shall as to remainder and residue be divided into eight equal shares as soon as it can be done, share and share alike, among my eight lawful heirs, namely, Elmira Lamborn, Malinda Stufft, Loyd Pressel, William Pressel, Harry Pressel, Jane Furry, Reuben Pressel and Hattie Pressel. If they shall all survive wife, and I. And shall any of my above named legal heirs die before this distribution leaving children of their body, I desire then that said children shall have th[at] of Mother or Father divided equal among them and shall Reuben or Hattie die before marriage or without issue, I desire their share be divided equally among their brothers or sisters or their issue. And lastly, I hereby constitute and appoint my said wife Mary Ann, and my son Loyd Pressel, to be my Executrix and Executor of this my last will and testament. As stated, I desire that my said Executor shall act in conjunction with his mother the Executrix, and after her death or marriage, he shall dispose of all personal property and real estate remaining unsold to the end as above I have directed. And he shall have the full sum of Seventy five dollars to cover all his trouble and expenses in and about the settlement of my estate. Also a full share of the balance as an heir. In witness whereof, I Jacob W. Pressel, the Testator, have to this, my will, written on one sheet of fools cap paper, have set my hand and seal, this Eleventh day of January A.D. 1897. Jacob W. Pressel, as and for his last will and testament, in the presence of us, who have hereunto subscribed our names at his request as witnesses thereto in the presence of the said testator, and of each other. David R. Longenecker B.F. Jamison Bedford County, SS: Personally appeared before me Ed. R. Horne, Register for the probate of wills, &c, in and for said County, David R. Longenecker and B.F. Jamison, the two subscribing witnesses to the last will and testament of Jacob W. Pressel, late of South Woodbury Township, deceased, who being duly qualified according to law, depose and say that they were personally present and saw and heard the above named testator, sign and seal, pronounce and declare the foregoing instrument of writing as and for his last will and testament, that they signed their names as witnesses at the request of said testator and in his presence and in the presence of each other, and at the time of so doing said testator was of sound mind, memory and understanding to the best of deponents knowledge and belief. Affirmed and subscribed before me, this 26th day of June A.D. 1897. David R. Longenecker B.F. Jamison Ed. R.
