In the year of our Lord one thousand eight hundred and forty one considering the uncertainty of this mortal life and being of sound and perfect mind and memory, blessed be Almighty God for the same, do make and publish this my last will and testament in manner and form following, that is to say: First I commit my body to the grave and my soul to the Lord who gave it, further my will is that my wife Nancy Truax [is] to have and to hold all my real estate during her natural life. Further my will is that my wife Nancy Truax shall have my bay mare, two cows and four sheep, and two beds and the kitchen furniture, further my will is that my son Thomas Truax shall live on the place and farm it and take good care of his mother and my son David Truax during their natural lives, and at his mother's death he shall have the plantation that I now live in, but if he should refuse so to do that my wife Nancy Truax shall have full power to take in whom she chooses. Further my will is that just debts and funeral expenses be paid out of my personal property. Further my will is that my son Thomas Truax shall pay the legatees as follows two years after the death of my wife Nancy Truax my will that my daughter Rebecca Truax the sum of five dollars my son Richard Truax his heirs Nicholas and Hannah Truax each two dollars and fifty cents, my son Samuel Truax deceased his son Washington Truax two dollars and fifty cents, my son Jacob Truax's heirs Maryan and Jacob Truax, each two dollars and fifty cents my son Stilwell Truax five dollars, my daughter Mary Truax the sum of Fifteen dollars my daughter Elizabeth wife of George Clevenger five dollars, my daughter Pertheny wife of Elijah Palmar five dollars, my son John Truax five dollars, my daughter Ruthy wife of Samuel Mellott five dollars my son Asa Truax five dollars, my daughter Rachel wife of John Killen five dollars, my daughter Mahala wife of Joseph Clark five dollars my son Nathan five dollars my daughter Sarah wife of Obed Mellott five dollars, and further I appoint and will that the residue and remainder real and personal shall at the death of my wife Nancy Truax shall remain in the hands of my son Thomas Truax to have and to hold all the appertinence belonging thereto. Further that I appoint my son Stilwell Truax and son in law John Killen my lawful Executors of this my last will and Testament. Moses Starr and Jeremiah Mellott subscribing witnesses to the foregoing instrument of writing who being duly sworn do say that they were present when Jacob Truax acknowledged the same and heard him pronounce and declare said instrument of writing to be his last will and Testament, that he desired them to sign their names as witnesses thereto, and that at the time of so doing he the said Testator was of sound and disposing mind memory and understanding to the best of their knowledge and belief deponants further say that they cannot positively say that the will was signed in their presence.
