All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Diana Quinones audiana@msn.com November 30, 2005, 4:35 am Source: Register Of Wills, Reading, Berks County Pa Written: August 9, 1816 At an Orphan's Court held at Reading in and for the County of Berks on the ninth day of August in the year 1816 before the Honorable Robert Porter, Esquire, President and James Diemer and George Ege, Esquire, Judges of the said court: Upon the petition of Elisha GEIGER, who is guardian of the persons and estates of Mary, Catharine, Sarah, George, John and Hannah of Christian MOORE late of the township of Robeson in said county deceased, setting forth that the said Christian Moore died intestate leaving a widow named Mary and six children to wit; the children before named being all minors; that the said intestate at the time of his decease was seized in the demesne as of fee of and in one messuage and tract of land situate in Robeson Township aforesaid containing 60 acres be the same more or less, bound by lands of Daniel BITTER, Jacob WICKLINE and others, also of and in a tract of land in the same township aforesaid containing 68 acres bounded by lands of Jacob WICKLINE, Conrad MOORE (Jr.) and John MOORE and Henry MOORE with the appurtenance. And therefore praying the court to award an inquest to view the same and make partition of the said premises with the appurtenances to and among the children and representatives of the said intestate in such manner and in such proportion as by the laws of this Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole; but if such partition cannot be thereof made as aforesaid then to value and appraise the same and make report of their proceeding herein according to law. The Court here do awards an inquest to make partition of the said premises with the appurtenances in the said petition mentioned whereof Christian MOORE, the intestate, therein named died seized to and among the children and representatives of the said intestate in such manner and in such proportions as by the laws of the Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole, otherwise, to value and appraise the same. And it is further ordered by the Court here, that a writ issue to the Sheriff commanding him to summon an inquest for the purpose aforesaid returnable before the judges of this Court the eighth day of November year next and the same writ said accordingly. Afterward to wit, at an Orphan's Court held in Reading in and for the county of Berks on the eight day of November in the year 1816 before Robert Porter, James Diemer and George Ege, Esquires, Judges, etc., Peter Hurands, Esquire High Sheriff of the County of Berks made return of the said writ in the words following to wit: To the judges within named that by virtue of the written writ to me divided having first duly warned the parties, I took with me twelve honest and lawful men of my bailiwick and went to the lands and all and singular the premises therein mentioned and by their oaths finding the same could not be parted and divided to and among the parties in the said writ named, without prejudice to or spoiling the whole thereof have valued and appraised the same as by the within writ. I am commanded as by the schedule hereunto annexed appears to answer Peter Hurand Sheriff. Inquisition indented and taken at Robeson Township in the County of Berks, the twelfth day of September in the year 1816 before Peter Aurand, Esq., High Sheriff of the county aforesaid by virtue of a writ of partition or valuation to him directed and to this inquisition annexed by the oaths of David Bright, Daniel Fichthorn, William High, Henry Gourman, John Lotz, Jon Miller, Jacob Dick, John Kendal, William Fricker, Schemiah Lewis, Thomas Ach and George Foch - twelve free honest and lawful men of his bailiwick who on their and affirmation aforesaid respectively do say that they went to the messuage tenement and two tracts of land whereof Christian MOORE, in the said writ named, died seized and then and there did find that the same could not be parted and divided, to and among the parties, in said writ named, without prejudice to or spoiling the whole thereof, and therefore the inquest aforesaid upon their oaths and affirmations as aforesaid have valued and appraised the same at the same at the sum of three thousand and two dollars. In Testimony whereof as well the said Sheriff as the inquest aforesaid have to their inquisition, interchangeably set their hands and seal dated the day and year first above written: Peter Aumond, Sheriff (seal) Jacob Dick (seal) John Kendall (seal) Wm Fricker (seal), Schemiah Lewis (seal), Thomas Ach (seal), George Foch (seal), David Bright (seal) David Fichthorn (seal) William High (seal), Henry Bowman (seal) John Lotz (seal), J Miller (seal). Whereupon on the said return and valuation on, on being read, was confirmed by the Court same day. Elijah GEIGER, guardian of all the heirs of the said intestate appeared in Court and refused to accept of the said real estate at the valuation thereof, whereupon the Court ordered the property to be sold by Administration on the second Saturday in December next at two o'clock in the premises. After the public sale, one parcel of 60 acres sold to Daniel Bitler; and the second tract of 68 acres sold to Adam Wickline and Henry Ludwig. Sometime abt 1822, the guardian for the children, Elisha Geiger, changed, and Adam Weidner, Cumru, was made guardian for Catharine and Sarah. John Westly was made guardian for George, John and Hannah. Additional Comments: Christian MOHR/MOORE was son of Conrad and Margaretha Kieler MOHR. It has not been determined who his wife Mary was. She was also known as Anna Maria. He had died intestate in Robeson with 2 tracts of land which were eventually sold. One daughter, Catharine MOORE, married Evan BECHTEL, and died intestate in Reading abt 12/1823, probably because the sale of her father's property resulted in money coming to her. Unforunately, there were no papers in the Reading file showing distribution of the proceeds from the sale of the 2 tracts of land in Christian's estate.
