This Indenture Made the twenty first day of April in the Year of Our Lord One Thousand seven hundred and seventy five between Peter Fetherolf of Hereford Township in Berks County and Province of Pennsylvania Innkeeper and Margaret his Wife of the one Part and David Strauss of Longswamp Township in the said County Miller of the other part. Whereas the Honourable the Proprietaries of the said Province by the Patent bearing date the nineteenth day of August in the Year of Our Lord one thousand seven hundred and Sixty One for the consideration therein did grant and confirm unto Andrew Maurer his heirs and assigns A certain tract of land situate in Hereford Township aforesaid by Metes and bounds in the said Patent mentioned Containing Two hundred and thirty seven Acres & sixty four perches as in and by the said in part Recited Patent Recorded in the Office for Recording Deed at Philadelphia in Patent Book AA, Vol 2, page 365, Relation being thereunto had will more fully appear. And Whereas the said Andrew Maurer and Anna Barbara, his wife by their Indenture of the lease bearing date the ninth day of May in the Year of Our Lord one thousand seven hundred and sixty four for the Consideration therein mentioned did grant and confirm unto Nicholas Seidle his Heirs and Assigns A Certain Tract or Piece of Land (part of the said above described Large Tract granted by the said Recited Patent) by Metes and bounds in the said Indenture mentioned containing Fifty Acres as in and by the said Indenture Reference thereunto had will more fully appear. And Whereas the said Nicholas Seidle and Anna Maria his wife by their Indenture of Release bearing date the twenty first day of May in the Year of Our Lord one thousand seven hundred and sixty four for the consideration therein mentioned did grant and confirm unto William Russ his heirs and Assigns as in and by the said Indenture Recourse thereunto had will more fully appear. And Whereas the said William Russ and Elizabeth his wife by their Indenture bearing date the twenty fifth day of February in the Year of Our Lord one thousand seven hundred and sixty seven for the Consideration therein mentioned did grant and confirm the said last above described Tract of Fifty Acres of Land unto the said Peter Fetherolf (party hereto) and to his Heirs and Assigns as in and by the said in past Recited Indenture Reference thereunto had will more fully appear. Now this Indenture Witnesseth that the said Peter Fetherolf and Margaret his wife for and in Consideration of the sum of Five Hundred and Fifty Pounds Lawful Money of Pennsylvania to them in Hand well and truly paid and delivery of these Presents the Receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said David Strauss his Heirs Executors Administrators and Assigns by these presents they the said Peter Fetherolf and Margaret his Wife have granted bargained sold Released and confirmed and by these presents for the consideration Money aforesaid do Grant bargain sell release and Confirm to the said David Strauss his Heirs and Assigns All that Grist Mill Saw Mill Messuage or Tenement Plantation and Tract of Land situate lying and being in the Township of Hereford and County of Berks aforesaid bounded and described as follows Beginning at a stone in a Line of George Seiler's Land Thence by the same South West one Hundred and eighteen Perches to a Stone set for a Corner of George Masteller's Land Thence the the same North twenty three degrees West fifty Perches and four tenths of a perch to a stone and North fourteen degrees East Sixty perches to a Stone Thence by Vacant Land North East fifty five Perches to a Stone Thence by Land of Peter Shell and Conrad Shoub south east eighty perches to the place of Beginning Containing Fifty Acres of Land (being the same piece or Tract which was granted to the said Peter Fetherolf in and by the said last above Recited Indenture as aforesaid) Together with the Houses Out Houses Barns Stables Gardens Orchards fields Fences Ways Woods Waters Water Courses Rights Liberties Privileges Hereditements and Appurtenances whatsoever thereunto belonging or in anywise appertaining and that . . . . and Remainders Rents Issues and Profits thereof and also all the Estate Rights Title Interest Use Possession Property Claim and demand whatsoever either in Law or equity of them the Said Peter Fetherolf and Margaret his Wife and their Heirs of in and to the same and every part thereof To have and to hold the said Grist Mill Saw Mill Messuage or Tenement Plantation and Tract of Fifty Acres of Land Hereditaments and Premises hereby granted or mentioned or intended to be granted with all the Appurtenances unto these said David Strauss his Heirs and assigns forever. In Witness whereof the said parties to these presents have hereunto Interchangeably set their Hands and Seals dated the day and year first above written. Peter Federolf and Margret (her mark) Federolf. Sealed and delivered in the presence of Balser Geehr and Henry Christ. Received the day of the date of the above written Indenture of the above named David Strauss the sum of Five Hundred and Fifty Pounds lawfull Money of Pennsylvania it being the full consideration Money above-mentioned and given for the said Premises. I say received by me Peter Federolf. Witness Present at the Signing Balser Geehr, Henry Christ, Berks County. The 10th Day of August Anno Domini 1775 before me Henry Christ Esquire, one of the Justices of the Court of Common Pleas in and for the said County of Berks, personally appeared Peter Federolf and Margaret his wife the Grantor above named and acknowledged the above written Indenture to be that act and Deed & desired the same to be Recorded as their Deed according to Law she the said Margaret being of full Age and Secretly (apart from her said husband) by me examined and the Contents thereof being first made known to her voluntarily consented. Recorded and this Record & the original diligently compared and found to agree exactly Word for Word the Nineteenth day of October Anno Domini 1775.
