Will of Christian Kintzi/Kintzy, 1 Jul 1843

NOTE: in the original, German version of this will the name is
consistently spelled Kintzi, while in the English translation it is
spelled both Kintzi and Kintzy.

Translation of the will of Christian Kintzy

In the name of God, Amen, I the undersigned Christian Kintzi of
Alsace township, Berks County and State of Penna. farmer, make and
declare herewith these presents, while I have my understanding,
memory & power of judgment for which I thank God heartily, to be my
last will & testament, namely.

First. I give and bequeath herewith to my son Samuel Kintzy and to
his heirs and assigns forever, the Plantation on which I at present
reside, with the whole harvest, of all which at the time of my
decease is in the ground on the same, or grows thereon situate in
Alsace township aforesaid, adjoining lands of Daniel [?David] Smeck
and Henry Smeck, Abraham Fies, Peter Hartman, Jacob Hartman and
Abraham Hartman, containing two hundred and twenty five acres more or
less, however on the following conditions, that the Plantation shall
be adjudged to him at eight thousand dollars.

Second. I give and bequeath herewith to my son David Kintzy and his
heirs and assigns for ever my Plantation on which he himself at
present resides, with all that at the time of my decease is in the
ground or grows thereon, situate in the aforesaid Alsace township
Berks County adjoining land of Wm. Hinnershitz, John Ulrich, John
Bernhart, Frederick Hartman, Jacob Shalter & others, containing one
hundred and seventy three acres, more or less. Further, I give and
bequeath herewith to my said son David & to his heirs and assigns for
ever a tract of hewn off timber land, situate in the aforesaid Alsace
township, adjoining land of Michael Ulrich, Jacob Gehret [?Gebret] &
John Maser [?Moser], containing twenty acres more or less, however on
this condition, that the two tracts of land shall be adjudged to my
son David at seven thousand dollars.

Thirdly. I order & direct herewith that as soon after my decease as
it is convenient, all the rest of my remaining property be sold, and
converted into money, in case my five children cannot agree on an
equal division among themselves without such sale, and the same shall
then be added to the fifteen thousand dollars which my two sons have
to pay out of their land as above provided, whereupon the whole shall
be divided in five equal shares, and one such fifth part I give and
bequeath herewith to each of my five children, namely, one fifth part
to my son Samuel, one fifth part to my son David, one fifth part to my
daughter Susanna, the wife of Benjamin Hock [?Hoch], one fifth part to
my daughter Elizabeth intermarried to Valentine Hartman, and one fifth
part to my daughter Sarah intermarried to David B. Kline or to the
heirs of my aforesaid children for ever. But should one or the other,
or more of my children die before me, without leaving bodily heirs,
then shall such childís share fall to his brothers and sisters in
equal shares, should it appear after all the property that I leave
behind is summed up, that my son Samuel & David, or any of them,
according as I have in this will valued & adjudged their land, have
more than one fifth part of the whole of my estate, then shall each
pay the amount that he has to [too] much to his brothers & sisters ,
in four yearly equal payments, and in equal shares, so that at the
end of four years my children have all inherited in equal shares.

Lastly I appoint herewith my aforesaid two sons Samuel and David, and
my son in law David B. Kline Executors of this my last will and
testament.

In witness whereof I have hereunto set my hand & seal this 1st day of
July in the year of our Lord one thousand eight hundred and forty
three.

Berks County ss. On the 30th day of March A.D. 1848, appeared George
D.B. Kline and Wm. Shoener the subscribing witnesses to the foregoing
will and being duly qualified according to law did depose & say that
they were present and saw & heard Christian Kintzy, the testator
therein named, sign, seal, publish and declare the foregoing
instrument of writing as and for his last will and testament, and
that at the time of so doing he was of sound mind, memory and
understanding to the best of their knowledge, observation and belief.
