Will of Aaron Yorgey SHEARER, written May 28, 1910 In the name of God, Amen! I, Aaron Y. SHEARER of Spring Township in Berks County, PA do hereby make and publish this as and for my last will and testament. First - I order and direct that my body be buried at Epler's Church and that a suitable tombstone be erected over my grave. Second - After the payment of all debts, funeral expenses, tombstone and all costs and expenses, the balance or remainder of my entire estate, real and personal which I may own at the time of my death, shall be divided in seven equal shares among my six children and one grandchild to wit, Lillie WERT, William H. SHEARER, Kate FISHER, Howard H. SHEARER, Oliver H. SHEARER, Clara KISSLING and Ruth KISSLING, absolutely. Third - I order and direct my hereinafter named executor to sell at public or private sale, all my real estate which I may own at the time of my death, and divide the proceeds there of among my six children and one grandchild as herein- before directed. Fourth - I appoint my son-in-law Adam FISHER executor of this my will. In witness whereof I have hereunto set my hand and seal this 28th day of May A.D. 1910. Aaron Y. PETITION In the matter of the Probate of the last Will and Testament of Aaron Y. SHEARER, Spring Township, Deceased. The Petition of Adam FISHER respectfully showeth that he is the Executor named in the last Will and Testament of Aaron Y. SHEARER dated the 28th day of May A.D. 1910. That said Aaron Y. SHEARER was a resident of Berks County, State of Pennsylvania, and departed this life at Spring Township in the County of Berks and state of PA on Friday the 19th day of September A.D. 1913, at 11:00 o'clock A.M. The said testator was possessed of personal property to the value of $1,000 and of real estate (less encumbrance) to the value of $5,000 as near as can be ascertained, situated as follows: Farm in Bern Township, Berks Co., PA and Farm in Spring Township, Berks Co., PA. Therefore, the said Adam FISHER respectfully applies for Probate of the said last Will and Testament, and for Letters Testamentary thereon. SHEARER, deceased, and to take my dower or widow's thirds, in both real and personal estate of said decedent, as provided by the intestate laws of the State of Pennsylvania. ULRICH (signature) and Calvin B. BENDER (signature) Appraisers Account of Adam FISHER, executor of the last will and testament of Aaron Y. SHEARER late of Spring Township in Berks County and state of Pennsylvania, deceased: Personal Estate: $520 and an additional $5.50, $84. 63 for Total of $610.13. Real Estate: Spring Township, Berks Co., PA farm sold to Robert E. RISHEL for $3,475.00. Amount of dower charged on the same for the widow of the decedent (1/3) $1,158.33 Balance $2,650.00. Bern Township., Berks Co., PA farm sold to Peter S. KLEINGINNA for $500. Amount of dower charged on the same for the widow (1/3) $166.67. Balance $333.33. Credits: The said accountant asks credit for payments totaling $187.58 made in the sale and settlement of said real estate. Balance due the estate from the Real Estate a Total of $2,462.42. ------------------------------------------------------------------------------- Distribution of the Estate of Aaron Y. SHEARER dec'd. The distribution in this estate must be made as follows: The widow of the decedent, Mary A. SHEARER, having filed her election to take against the will, and having received her Three hundred dollars Exemption, is entitled to one-third of the balance of the personal estate remaining after the payment of debts and expenses, as shown by the account, and what remains must be distributed according to Lillie WERT, William H. SHEARER, Catherine FISHER, Howard H. SHEARER, Oliver H. SHEARER, Clara KISSLING and Ruth KISSLING, in equal shares. The real estate was sold with one-third of the purchase money charged thereon as dower for the widow. The balance in the account from the real estate, must be distributed under the will to the said Lillie WERT, William H. SHEARER, Catherine FISHER, Howard H. SHEARER, Oliver H. SHEARER, Clara KISSLING and Ruth KISSLING in equal shares. B. Y. SHEARER, (signature) attorney for Estate. ----------------------------------------------------------------------------- Contributors Note: Aaron Yorgey SHEARER (b. 31 Oct 1845 d. 19 Sept 1913), son of Samuel Tobias SHEARER and Catherine Derr YORGEY, is buried in Epler's Cemetery in Leesport, PA. His first wife and mother of his children was Emma HIESTER who died about 1877. Vol 13 No 524 shows a marriage license was issued to Aaron Y. SHEARER and Mary A. HORNBERGER on 9 March 1894. They were married on 17 March 1894 by J.N. GEORGE. Ruth KISSLING, was the granddaughter of A.Y. SHEARER, mentioned in the will. Her legal guardian was Adam FISHER who was required by the court to make at least once in every three years a JUST and TRUE account of the management of the property and estate of said minor under his care.
