Vol. 42, p.250: filed 12-11-1909, filed Oct 7, 1909 confirmed 12-28-1909 SUMMARY OF ESTATE SETTLEMENT OF JACOB F. YORGEY 1) Jacob F. YORGEY, was a resident of Berks County, and departed this life at Douglass Township, Berks County, PA on the 24th of September A.D. 1909 at 9:15 o'clock a.m. 2) Jacob F. YORGEY left to survive him the widow, Lydia A. YORGEY, son Leidy H. YORGEY, daughter Matilda RHOADS, Ellen M. SAMSEL, a deceased daughter, and three grandchildren, Clifford SAMSEL, Earl SAMSEL, and Candice SAMSEL. Earl living with the father and the other two living with the widow. 3) The said intestate was possessed of Goods, Chattels, Rights and Credits to the value of $1,200.00 and real estate (less encumbrance) to value of $650, situate in Douglass Township, Berks County, PA containing 65 acres more or less. ----------------------------------------------------------------------------------------- The petition was granted and Lydia A. YORGEY became the administratrix [sic] On October 16, 1909, after as administratrix [sic] Lydia, filed a petition before the Hon. H. Willis BLAND, President Judge of the Orphans Court, to sell the real estate of the deceased Jacob F.YORGEY to settle his debts. The petition of Lydia A. YORGEY, administratrix [sic] of Jacob F. YORGEY, late of Douglass Township, Berks County, Pennsylvania, deceased, respectfully presents: That the said Jacob F. YORGEY died on or about the 24th day of September, 1909, intestate, leaving to survive him a widow, Lydia A. YORGEY, and the following children and grand-children: 1. Leidy H. YORGEY, a son; 2. Matilda RHOADS, a daughter, 3. Ellen M. SAMSEL, a daughter, who predeceased the decedent, leaving to survive her three children: Clifford SAMSEL, Earl SAMSEL, and Candis SAMSEL, all minors without guardian. That the said decedent died seized of and --certain real estate situate in said County, a description of which is hereunto annexed, that the personal estate of said decedent is not sufficient for the payment of his debts as appears by an inventory and appraisement of all the personal estate of said decedent exhibit- ed in the office of Register of said County and by his certification set forth herein. Your petitioner therefore prays the Court to order the Sale of the said real estate for the payment of the debts of said decedent. -------------------------------------------------------------------------------------- State of Pennsylvania, County of Berks I George R. GREGORY, Register, in and for said County, do hereby certify that the amount of the personal property of Jacob F. YORGEY, late of Douglass Town- ship, in said County, deceased, as set forth and exhibited by the Inventory and appraisement of the same filed in this office is $1,526.15. SMITH entered to No. 113 June Term, 1909 for Interest from, April 13, 1909, date of note [amount of] $1,600.00 Promissory note in favor of Sarah GELLAR, with interest to April 1, 1909 [amount of] $420.00 Promissory note in favor of William I. SMITH with interest to April 1, 1909 [amount of] $157.00 Not in favor of Daniel G. GABLE, for $15.00 Book Account, Daniel SCHLEGEL [amount of $11.00 [Total of debts]....................................$2,203.00 ------------------------------------------------------------------------------- Statement of the real estate of said decedent: All that certain Grist Mill, messuage [sic] & tract of land situate in Douglass Township, County and State aforesaid, bordered by lands of William ANDREW, C.W. BRINTZENHOFF, Samuel SCHWENK, now late George R. YORGEY, William GLASE, and others containing 65 acres more or less. The above real estate is subject to a dower of $677.02, the interest whereof is to be paid annually to Louisa Y. FRITZ, during her natural life and after her decease, the principal sum to those legally entitled thereto. The said petition having been presented and read, the Court on advice of Adam B. RIESER attorney for the petitioner grant the prayer of the petitioner and do award an order of sale unto Lydia A. YORGEY administratrix [six] of Jacob F. YORGEY, deceased to expose the within described real estate at public sale on Saturday, Nov. 20, 1909 at 1:30 p.m. on the premises after having filed her bond in the sum of $4,600 with surety to be approved by the Court, and after having given due notice of said sale by advertisement in the Reading Daily Eagle and Berks County Law Journal and by handbills according to law and the Rules of Court. Ten percent of the purchase money to be paid on the day of sale and the balance on or before the 1st of April, 1910, with power to adjourn the sale at that time and place. Returnable, Dec. 11, 1909 at 10 o'clock a.m. By the Court. Willis BLAND, PJ {signature} ------------------------------------------------------------------------------- On December 2, A.D.1909, Lydia A. YORGEY, Administratrix for Jacob F. YORGEY reported to the Hon. H. Willis BLAND, President Judge, of the Orphans Court of Berks County that: "In pursuance of the Order of the 16th day of October A.D. 1909, and after having given public notice of the time and place of holding said sale, at least 20 days before the day appointed therefor, by advertisement in the Reading Daily Eagle,....and the Berks County Law Journal...for three successive weeks, and by affixing handbills in at least 10 of the most public places in the vicinity of said real estate at least 20 days before the sale, I exposed the with- in described real estate to public vendue [sic] on the 20th day of November, A.D 1909, on the premises, and sold the same, ... to wit" "... to Joel F. BRIGEL for the sum of twenty four hundred and fifty dollars ($2,450), which includes a dower of $677.02 , interest for life to Louisa Y. FRITZ and principal heirs of Eli FRITZ, deceased. Also subject to a dower of one third to be charged in favor of Lydia A. YORGEY, the widow, less costs and debts of decedent." "The said purchaser of the above purport being the best bidder and the said sum the highest price bidden for the same, which sale I pray may be confirmed by the Court. Lydia A. YORGEY {signature} ------------------------------------------------------------------------------- Response from the Court: And now to wit: Dec. 28, 1909, The within return having been confirmed... Dec. 11, 1909, and no exceptions having been filed the same is now confirmed absolutely and it is ordered and decreed that the sale so made to the said Joel T. BRIGEL be ratified and confirmed and the premises so sold be and remain to the said Joel T. BRIGEL, his heirs and assigns, firm and stable forever. Sub- ject to the liens of dower as in the within return set forth. By the Court Willis BLAND, JP {signature} ------------------------------------------------------------------------------- Contributors Note: Jacob Fritz YORGEY (b.1848 d.9-24-1909) son of Christian and Matilda (Fritz) YORGEY died intestate, of Catarrh of the stomach, according to Berks County death records, and was buried at West End Cemetery between Charlotte and Hanover Streets. His widow was Lydia A. (Hoffman) YORGEY. The children of Jacob and Lydia were: Ellen YERGEY (b.1-29-1879) m. William D. SAMSEL; Leidy H. (b.9-12-1883) m. Laruqua O. FRITZ; Candace Matilda (b.1-6- 1888) m. Henry Maurice RHOADS.
