Item: Immediately after my death, my Executors shall sell and convert into money, all my personal property, whatever the same may be, whether in possession or in action – and the balance remaining, after paying my debts and the necessary expenses of settling up the Estate, shall be distributed as follows, to wit: to my wife Susannah one third part thereof – the other two thirds to my seven children, William Adam, John Adam, Jacob Adam, Sarah, married to Samuel Oswalt, Elizabeth, married to George Weidenhammer; Susannah, married to Benjamin Breininger; and Mary, married to William Gehret, in equal shares – Item: As soon as conveniently can be after my death, my Executors shall sell, at public sale, all the real estate of which I shall be seised and possessed, at the time of my death; and the proceeds of such sale shall be distributed as follows, to wit: two thirds thereof to my seven children above named, in equal shares, with the exception of Mary, married to William Gehret, from whose share the sum of Four hundred and twenty five Dollars shall be deducted; which said sum I give and bequeath to Henry Kutz, the son of my daughter Mary, by her former husband Henry L. Kutz – and which shall be paid to him by my Executors after he attains the age of twenty one years, at such times and in such sums as they shall deem proper. The remaining one third part of the amount for which my real estate shall be sold, shall remain a lien thereon, and the interest thereof be paid annually to my wife Susannah during her natural life; and after her death the principal to be distributed in equal shares among my seven children above named. The share of the personal property, and the interest of one third part of the proceeds of the sale of the real estate, bequeathed to my said wife Susannah as above mentioned, shall be in lieu and stead of her dower at common law. Item: In case I should die before Henry Kutz, the son of my daughter Mary, attains the age of twenty one years, my Executors shall invest the said sum of four hundred and twenty five dollars, bequeathed to him as aforesaid, upon good security, and upon arriving at said age, to pay the same to him, as before directed, with the interest which may accrue during said investment. Item: The share coming to my daughter Elizabeth, married to George Weidenhammer, both of the real and personal property, shall be for her sole, separate and exclusive use. Item: I give unto my Executors full power and authority, to sign, seal, execute and acknowledge, all such deed or deeds of conveyance, as may be requisite and necessary for granting and assuring the real estate to be sold by them, as before directed, unto the purchaser or purchasers thereof, in fee simple. And in case either of my said Executors should die before the execution of such deed or deeds, the surviving Executor shall have the power to execute the same, as fully and to the same effect as both, if living, could do. Item: It is my wish that my executors shall receive a reasonable compensation for settling up the estate. And, lastly, I nominate, constitute and appoint my two sons Jacob Adam and John Adam, to be the executors of this my will – hereby revoking all other wills by me heretofore made, and declaring this, and no other, to be my last will and testament. In witness whereof, I have hereunto set my hand and seal, the twenty ninth day of March Anno Domini one thousand eight hundred and forty nine. Signed, sealed, declared and published, by the above named Jacob Adam Jacob Adam, as and for [signature] his last will and testament, in presence of us – who at his request and in his presence have subscribed our names as witnesses thereto – Samuel L. Young Paul Hilbert Codicil I Jacob Adam, the above Testator, do hereby make and publish the following Codicil to the above last will and testament, which said Codicil shall be a part thereof, and of the like force and effect as though it had been executed at the same time to wit – It is my will that the share bequeathed to my daughter Susannah, married to Benjamin Breininger, both of the real and personal property, shall be for her sole, separate and exclusive use. In witness whereof I have hereunto set my hand and seal this thirteenth day of September Anno Domini one thousand eight hundred and forty nine.
