All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Karen Jenter jenterkar@aol.com January 28, 2006, 11:05 am Source: Last Will And Testament Written: September 15, 1808 Recorded: November 22, 1808 Peter Eshelman will 1808 In the name of God and in I Peter Eshelman of the Township of Cumru in the County of Berks and in the State of Pennsylvania being in perfect health of and of sound mind disposing mind memory and understanding considering the certainty of death and the uncertainty of the time thereof, and being desirous to settle my worldly accounts and thereby be the better independent to serve this world when it shall please God to carry me home do therefore make and publish this my last will and testament in manner and form following. What is to say, first and principally, I commit my soul in the hand of the almighty God and my body to the earth to be decently buried at the discretion of my executors herein after named. And after my debts and funeral charges are paid, I devise and bequeath as follows: It is my will and order that my daughter Anna Eshelman shall have twenty five acres of my plantation where I now live beginning at the land of Henry Weber running along the line of David Eshelman. It is my will and order that my daughter Elizabeth Eshelman shall have twenty five acres beginning at the land of Henry Weber running along the line of Anna. It is my will and order that my daughter Caterine Eshelman shall have twenty five acres being same twenty five acres she has now in possession already surveyed and deeded. It is my will and order that my daughter Christenah Eshelman shall have twenty five acres beginning at the land of Windle Bowman running a straight line to Andrew Gerdners line. It is my will and order that my sone Martin Eshelman shall have fifteen acres beginning at the land of Windle Bowman Christian Bowman and Conrad Watts a straight line of the land of Peter Russner. It is my will and order that my sone Peter Eshelman shall have twenty five acres beginning at the land of Windle Bowman running a straight line to the land of Peter Russner. It is my will and order that my sone John Eshelman shall have all the remainder of my plantation more or less with the new house and the old house barn, stables and all the improvements there on. It is my will and order that the residence and remainder of my hole estate rails and personal. I leave to my two sones and my three daughters namely Peter, John Anna, Christenah and Elizabeth Eshelman to be divided between the five on these conditions that the afore mentioned five shall pay for my funeral expenses and all my same full debts. It is my will and order that all my children shall pay and equal shear of the purchase money and deeding my land yet not deeded and each one shall be at the expense of dividing his own shear of land from the rest. It is my will and order that if any dispute should rise concerning this my will there shall be three men chosen of a reputable character by the joint agreement of all my children as a majority of them, who shall settle and report which shall be as bonding on all parties as if done in court. It is my will and order that if any of my children should happen to be dissatisfied and should attempt to destroy as set aside this my will by applying to a court or attorney at same in order to affect the same, shall have the sum of five pounds as is whole share and cease all claims and right t his afore mentioned share, which share shall be sold and equally divided among all the rest of my children. It is my will and order that John Eshelman and Anne Eshelman shall be my executors. Lastly it is my will and order that this my will shall set aside and disannounce all former wills made by me, as witness my hand and seal this 15th day of Sept n the year of our Lord one thousand eight hundred and eight. William ÖÖ Registers office Reading in Berks County Nov 22, the 1808 then appoint Christian Barlet and William Hushar to the subscribing witness to the forgoing wil who being duly sworn according to law do declare that they were present together with William Henhan the other subscribing witness and did hear Peter Eshelman the testor sign by making his mark publish, pronounce and declare the form writing as ad for his last will and testament ad that the .time of the signing that he was of sound mind memory and understanding to the best of their knowledge and that they verify believe and further note that Christian Barlet with the mark to the name of William Hushar are there own handwriting therefore subscribe in the presence of each other and in the presence and at the request of the testor ???????
