In the name of God amen, this nineteenth day of February in the year one thousand seven hundred and seventy, I, John FREES, of Robeson township in Berks county and province of Pennsylvania, am weak and sick in body, but of perfect memory and understanding, thanks be unto God therefore, do make this my last will and testament renouncing all others formerly made and done by me heretofore and that in manner following. THAT IS TO SAY: FIRST: My will is that all my just debts and funeral charges be paid by my exeuctors hereinafter named and appointed. SECONDLY: My will is that my beloved wife Catherin shall that the whole management use and profit of this my real and personal estate until my youngest child is 12 years old, then is my executor to appraise my plantation and at that value is my oldest son to take possession of my plantation and whatsoever is coming out of it to the rest of my children, he to have one year free, and afterwards he is to pay ten pounds a year until the whole is paid, what is acrewing of my plantation, and when my oldest son John takes possession of my plantation then he is to give his mother as long as she stays my widow, yearly 10 bushels of rye, and five bushels of wheat, and 100 pounds of pork, and 50 pounds of beef, and sow a quarter of an acre of flax, and the third part of the garden, and fatten and foder the cow as his own, sumer and winder, and provide firewood for her and she shall have a horse to write when she has need of and have her peacable above upon my plantation. But in case my wife should marry again, then is she to be satisfied with her third part of my personal estate and what I have given her per advance, or over her third. But if my son John is not capable to manage my plantation, then is my executor to have full power to sell my plantation at the best rate, and but the money thereof out shall everyone have their share, share and share alike. THIRDLY: To keep my eldest son John out of two shares, I therefore give him per advance, or over and above his equal share, the sum of five pds., currency of Pennsylvania, for his use. FOURTHLY: I five and bequeath unto my beloved wife Catherine, her third out of my personal estate whatsoever, for her own self and use. I give her over and above her third, her bed=sted, beding and what belongs to it, her chest, a mare, and a good cow, and all the rest what is a comng out of my real and personal estate is to be equally distributed among all my children, share and share alike, as they arrive their age, as aforesaid. LASTLY: I made and ordain this my beloved wife and my father-in-law, Peter KNAPPER, to be my only and sole executors, of this my last will and testatment, ratifying this present and no other, to be my last will and testament. Register General's Office, Berks County, Pennsylvania, the twenty third day of April in the year of our Lord one thousand seven hundred and seventy, personally appeared Andreas Beuschlein and Michael Walter, the witnesses to the aforewritten testament and last will and on their solemn oath on the Holy Evangelists, did depose and say that they were present together and saw and heard Johannes FRIES, the testator, sign, seal, publish and declare the said aforewritten will as and for his last will and testament, and that the time of doing thereof, he, the said Johannes FRIES, was of sound mind and to the best of their knowledge, and further that the names Andreas Beuschlein (in German Characters) and Michael Walker thereto subscribed as witnesses in presence of each other and in the presence and at the request of the said testator: signed James Read, D. The petition of Michael FRIES, above the age of 14 and one of the children of John FREES, late of Robeson township, deceased, humbly showeth That your petitioner's father died seized and possessed of a considerable real and personal estate, therefore praying your worships would be pleased to admit him to make choice of some proper person as guardian to take care of his person and estate according to law. signed ----Michael (X) FRIES, his mark Petition: To the worshipful justices at Orphan's Court held at Reading in and for the county of Berks the 30th day of April in the year of our Lord 1781: The petition of Peter LYKING and Catherine, his wife, late Catherina FRIES, one of the Executors of John FRIES, late of Robeson Township in the County of Berks, blacksmith, deceased: HUMBLY SHEWETH: That the said John FRIES lately died seized and possessed of a considerable real and personal estate, and leaving issue 8 children - one of whom, to wit: Jacob - is yet under the age of 14. They, therefore praying your lordships would be pleased to appoint some proper person as guardian to take care of the person and estate of the said minor according to law. And your petitioners will pray: Peter LYKING (X - his mark) Cathrina LYKING (X - her mark) Papers from the Wills office did not show who the appointed guardians were. Additional Comments: NOTE: In 'Marriages of PA before 1810', there is an Elizabeth FRIES married to Michael Walter on Nov 3, 1791 in Phila Co. at St Michael/Zion church, Philadelphia. A Michael Walter had witnessed Johannes's will. It is not known if Elizabeth was related to Johannes Friess. After John died, widow Catharine m Peter LYKING/LIKIN. The FREES children were: Anna Maria b. 8/30/1753 m George MOTZ, Schwartzwald on 1/30/1776 Magdalena b. 12/25/1757 d: unk Johannes/John b.1/4/1759 m Eve Hofman, Rev Boos on 5/6/1783, died Robeson Twp 1815. Catharine b 11/9/1760 m Thomas Gillmor Schwartzwald on 5/10/1782. Sharlotta b 7/4/1762 d: unk Peter b 7/12/1764 m Catharina Engelhardt 12/11/1791 Trin Lutheran, died Centre Co PA Michael b. 11/16/1766 m Elizabeth Klein 10/7/1788, Rev.
