Here are estate papers which were in his file at the Register of Wills office in Reading: Recusal by widow: 11/9/1838 To Abraham Mingle, Esq Register for the Probate of Wills and granting Letters of Administration in and for the county of Berks: Whereas, my late husband, Michael FREES died intestate, whereby the right of the administration of the estate of the said deceased, did devolve upon me, Catherine FREES, widow, and relict of the said deceased: Now know ye that for divers good cause and considerations me thereunto moving, I have released, and hereby do release, all my right and title to the administration of the said estate, and desire that the same may be committed to George FREES. Witness my hand and seal the ninth day of November AD 1838. Signed and sealed in the presence of us: Daniel ???, and Evan EVANS. Catherine X FREES (her mark) Petition for guardian for 4 minor children under age 14: 11/9/1838 To the Honourable John Banks, Esq., President, and his associate, judges of the Common Pleas, of the county of Berks, now composing an Orphan's Court, in and for the said county: The petition of Catherine FREES, widow and relict of Michael FREES, late of the township of Robeson, in the said county deceased, humbley showeth: that your petitioner's said husband left six children, four of whom, to wit: Peter, Isaac, Daniel and Mary FREES, are minors, under the age of fourteen years, and have no guardian to take care of their persons and estates. Your petitioner, therefore, humbly prays your honours to appoint some proper person or persons as guardians of said children, And she will pray &C. Catherine (X) FREES, her mark witness: Evan Evans Nov 9, 1838: guardianship petition of 2 minors over age 14: Petition of John FREES and George FREES, minors above the age of fourteen, who petitioned that they were minors above the age of fourteen and have no guardian appointed to take care of their persons and estate: Appointed Samuel FREES, guardian, approved by the court, for John and George FREES, minors above the age of 14. Nov 12, 1838: guardianship order made: The court appoints Samuel FREES, guardian for Peter; Evan EVANS guardian for Isaac, Daniel and Mary FREES, minors under the age of fourteen. Accounting of deceased's inventory, by George FREES, submitted to the court on 8/9/1839, showed assets of 616.13 and expenses totaling 845.90. Order of sale of the deceased's property in Robeson Twp 8/9/1839: At the Orphans Court held at Reading in and for said county on the 9th day of August AD 1839, before the Honourable John Banks, Esq, President and Matthias S Richards, Esq Associate, judges of said court, after the petition of George FRIES, Administrator of all and singular the goods and chattels, rights and credits, which were of Michael FRIES, late of Robeson, Berks county, yeoman, deceased. Setting forth that the said intestate died leaving a widow and six children to wit: John, George, Peter, Daniel, Isaac, and Mary FRIES who are all minors: that at the time of his decease he was seized in his demesne as of fee of and in a certain messuage tenement and tract of land situate in the township of Robeson bounded by land of Jacob GABRIEL, Jesse POSEY, the Heirs of STOCKER, Evan EVANS and others containing sixty-six acres more or less, that the personal estate of the said intestate is insufficient for the payment of his debts, as by the accompanying schedule appears, and therefore praying the Court to order a sale of the said real estate for the purposes aforesaid. Whereupon the Court on due consideration approve of the security in the bond filed and direct that George FRIES, the administrator aforesaid, do expose the same real estate to sale by public vendue or outcry, on the premises on the fifth day of October next at 1 o'clock in the afternoon with liberty to adjourn as to time and place of sale according to the Law and that he make report of his proceedings herein at the next stated Orphan's Court after such sale. Contributor's Note: The two guardians George FREES/FRIES, (also the estate administrator) and Samuel FREES were brothers of Michael FREES. They were all three the sons of Johannes FREES and Eve HOFMAN of Robeson Twp. Evan EVANS was a neighbor of the deceased, as shown in the description of the property in Robeson.
