Last Will and Testament of Rudolph Haverlich 1843 Berks County - On the 2nd day of October AD 1844 Appeared Elias Leinbach and John M. Dewees witnesses to the written will and being duly affirmed according to Law, did depose and say that they were present and did see and hear the testator Rudolph Heberlig sign, seal, publish, pronounce, and declare the within instrument of writing as and for his last Will and Testament and that at the time of the doing thereof he the said testator was of sound mind, memory and understanding to the best of their knowledge, observation and belief. Michael Kraemer, Deputy Reg. I, Rudolph Haverlich of Cumru Township, Berks County, State of Pennsylvania do make and publish this my Last Will and Testament as follows: The said Rudolph Haverling being weak of body but of sound memory and understanding but considering the uncertainty of this transitory life do make and publish this my last will and testament in manner following: First - It is my will and do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease. Item - I give and bequeath unto my dear wife Anna Maria the following right a authority to wit - The said wife shall have the full power, authority and right of the occupation wherein I and she now live and reside being a one story house and also which was built of as on the plantation and my plantation containing one hundred and forty acres. My said wife Anna Maria shall have the full interest and use benefit of said plantation situate in Cumru Township, Berks County as long as she shall live and during her life she shall receive the interest and right and value of products of said plantation. Item - I do make and ordain that my Executor after my death or decease shall sell dispose at public vendue or autery? Or if he can agree to divide or any way whatsoever of heirs see proper to sell or dispose a certain piece of woodland situate in Cumru Township, Berks County containing about fifty four acres more or less shall divide amongst themselves peaceably share and share alike unto my children except my daughter Cassia intermarried to David Fisher. The children or heirs of my said daughter or my said daughter or daughters children shall receive the worth or share of fifty-four acres and nobody else. Item - I will, make and ordain unto my said daughter Cassia or her heirs or children intermarried to David Fisher shall have, own, occupy, privilege, right, power of a certain messuage tenament and tract of land situate in Cumru Township, Berks County containing eighteen acres more or less which said above property shall only be for the proper use and behalf of my said daughter Cassia as long as she lives and cannot be sold to anybody her, him or children cannot make sale of said property as long as she lives. But after her death her children shall have said property for their use according to my will equal share. But Fisher married to my daughter shall not have any right. I also make and ordain amongst my children share and share alike viz.: Namely John Haverlich, my son, shall have his part or share of the proceeds of my estate. William Haverlich, my son, shall have his equal share of my estate. Catherine, my daughter intermarried to William Matz her share equal. Polly intermarried to John Spatz shall have her equal share. Sarah intermarried to Daniel Hoffert now deceased she or the heirs shall have equal share. Susanna intermarried to Daniel Hatt shall have equal share. Magdalena intermarried to John Frederich shall have equal share. Cassia intermarried to David Fisher shall have her equal share or her heirs or children and not her husband at any rate. Lydia my daughter intermarried to Daniel Eshleman shall have her equal share to be divided share and share alike after my decease. Also I direct that the money or moneys standing out on notes or bond or otherwise and also the money which I at present possess and owe shall be defrayed and divided equally amongst my children but none to Fisher in equal shares after my decease except two hundred dollars therefrom my surviving widow shall keep thereof for her use as long as she lives. Also, I do further ordain that widow Anna Maria shall keep all my personal property such as farming utensils, household furniture and all (except what is mentioned above such as money) she shall keep as long as she lives and also what is mentioned in 1st item shall live at the same place where we now live and cannot be driven away. And I do hereby make and ordain my son William Haverling and my son in law Daniel Hatt executors of this my Last Will and Testament deposing full confidence to perform the trust thus committed to them. In witness whereof I, Rudolph Haverlich the testator have this my will written on one sheet of paper set my hand this thirtieth day of March AD one thousand eight hundred and forty three.
