All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Barbara Mihalcik christielisabeth@yahoo.com August 17, 2009, 1:08 am Source: Berks County Courthouse Written: October 30, 1828 Will of Philip Klein 1828 Kutztown Berks County Pennsylvania I Philip Kline of the borough of Kutztown in the County of Berks do [order] and ordain this to be my last will and Testament ~~~~~ First I bequeath my soul to Almighty God and my body to my hereinafter named Executors to be buried in a Christian like manner – and as ...naly property with which I have been blessed I give and dispose [of] it as follows after my just debts have all been paid ~~~~~ Imprimis I give and devise to my hereinafter named Executors to wit John Palsgrove and George Bieber and their heirs all that Plantation or Tract of land on which my son John now resides and which he now cultivates, containing about seventy acres more or less, with the appurtenances – [in trust] nevertheless to hold the same to and for the use behoof and benefit of Deborah wife of my said son John to pay her the rents issues and profits during her natural life for her sole use and behoof so long as she continues the wife or unmarried widow of my said son John – and should she ... my said son John then at her marriage or death I order and direct said Executors to sell the aforesaid Plantation or tract of land for the best price that can be gotten for the same and divide the proceeds among ... living children of my said son John and Deborah his wife – Should ... son John survive his wife Deborah I order my Executors to hold the said Plantation to his use and behoof during his natural life – and after his death to dispose of it by sale and divide the proceeds as above stated. Nevertheless my said Executors shall not rent away the said Plantation [to] other persons as long as my son John or Deborah his wife wish to remain on it – but of the said Plantation or the profits thereof my Executors shall retain and deliver to my wife Catherina yearly four cords of wood (which however shall be cut from that tract of land formerly belonging to John Kramer) cut as cord wood generally is and delivered at her door – Five bushels of wheat and five bushels of rye – delivered at her dwelling house and ground – Indian meal buckwheat meal and potatoes one third as much as she can use or have need for – Eighty Pounds of Pork ... and cleaned and also one load of corn leaves or fodder – and this should be a lien on the land so long as my wife lives ~~~~~ Item I give and bequeath to my said Executors John Palsgrove and George Bieber and their heirs all that certain Plantation or tract of land which my son William now lives and which he farms with the appurtances – In trust nevertheless to hold the same for the use behoof and benefits of Elizabeth Kline wife of my said son William to pay the rents issues and profits thereof during her natural life to her sole use behoof so long and she continues the wife or the unmarried widow of said son William - and should she survive him then at her death or marriage I order and direct my executors to sell the last aforesaid Plantation or tract of land for the best price that can be gotten for same and divide the proceeds among the living children of my said son William and Elisabeth his wife – should my son William survive ... wife Elisabeth I order my Executors to hold the Plantation to his ... and behoof during his natural life and to dispose of it after his death by sale as aforesaid and divide the proceeds among his living children ~~~~~ Nevertheless my Executors shall not rent away the said Plantation to other persons as long as my said son William and his wife wish to remain . . . Out of the said Plantation last devised shall my Executors in the . . . peace retain for the benefit of my wife Catharina yearly four bushels of wheat and four bushels of rye delivered ground at her door – one . . . as much indian meal, buckwheat meal and potatoes as she has need for – and they shall have the four cords of wood which I have before bequeathed cut fine and piled away when my wife wishes – all of which shall be a lien on the land so long as my wife lives ~~~~~ Item I give and bequeath to my son Benjamin Kline and his heirs and assigns all that certain Plantation or tract of land with the appurtenances on which he now resides – containing sev... acres or thereabouts to hold to him and his heirs forever – And Benjamin Kline shall pay to my wife Catherina yearly seven bushels of wheat and seven bushels of rye delivered at her dwelling house ground six cords of wood cut into cord wood and delivered at her house - as much as she wants – and two loads of good hay for the cows – keep one cow for her in feed and pasture whenever she requires it – her one hundred Pounds of Pork cleaned and killed – and this shall be a lien on the land ~~~~~ My Executors shall also furnish from the land held in trust for the .... Elisabeth wife of my son William – yearly to my wife Catherina eighty ..... of Pork – and shall have the last mentioned six cords of wood .... and piled where my wife shall wish – which shall be a lien on said .... Item I give and bequeath to my beloved wife Catherina during her life the house in Kutztown where we now reside and also the other house [in Kutztown] in the back street now occupied by Benjamin Bachman – this ... rent out or otherwise as she thinks proper – I also give her ... ... furniture and personal property in the house where we now reside to do ... she pleases with -–that is beds chairs tables etc. – I also give to my wife Catharina during her natural life my tract of woodland in Greenwich Township containing five acres to cut thereoff yearly as much wood as she need if what I have heretofore ordered to be given to her should not be enough – and at her death this last mentioned tract shall be ... my Executors and the proceeds given to my son in law Jacob Adam and his wife Susannah or their children if they be dead ~~~~~ Item The house in the back street in Kutztown now occupied by Benjamin Bachman I give and devise on the death of my wife Catherina to my daughter Elisabeth Swoyer to her and her heirs forever – if she be dead at the decease of my wife then to her children and their heirs forever – The house in Kutztown where we now reside with the appurtenances after my wife’s decease I give and devise to my son in law Jacob Adam and his wife Susannah to them and their heirs forever – if they be dead at the decease of my wife then to their children and their heirs forever.
