All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Barbara Mihalcik christielisabeth@yahoo.com August 12, 2009, 8:37 pm Source: Berks County Courthouse Written: March 8, 1845 Recorded: April 7, 1845 Will of Thomas Miller March 8, 1845 In the name of God Amen I Thomas Miller of Windsor township Berks County & State of Pennsylvania, being Sick & weak in body, but of Sound mind and memory and understanding praised be to got for it and considering the certainty of death and the uncertainty of the time thereof and to the end I may be the better prepared to leave this world wherever it Shall please God to Call me hence do therefore Make and declare this my Last will and testament in manner following, that is to say, First and principally I commend my Sole in to the hands of Almighty God my Creator hopeing for full pardon and remission for all my Sin, and to injoy everlasting happiness in the heavenly kingdom through Jesus Christ my Saviour, my body I commit to the earth at discretion of my Executors herein after mentioned Item I Give and bequeath unto my beloved Wife Catharene the Sole use of all my real Estate together with all my personall property as the are now or may be at the time of my decease to have and to injoy till to the age of my youngest Son Charles if he Should survive, in case that he Should be deceased before the time Should com that the said Charles be twenty one years of age the ….. mentioned time of the use of the real and personall Estate Shall be to the Sole use of the widow, but Should She be marriet before the time would com that Charles would be twenty one years then all my Real and personall Estate Shall fall to my Children Sheare and Sheare alike, since I have the above Stated I have made up my mind and think it best to Let my Real and personall Estate to remain in the hands of my wife Catharene as Long as She Should live an remain my widow. 2 my wife Catharene Shall Sent the children to School and to the minister at Such time She may think proper and the Cost thereof to be paid out of the proceeds of the Estate. 3 I apoint my beloved wife Catharen one of my Executors and ally neighbour David Zettlemyer one other Executor with my wife, omited to mention before, it is my will that after the death of my widow all my Real and personall Estate shall be sold and the proceeds of the Sale Shall be for my Children Shear and Shear alike In Witness whereof I the said Thomas Miller to this my Last will and testament Containing one Sheat of paper I have Set my hand and Seal thereof and declareing it to be my Last will and Testament Dated the Eight day of March A. D. 1845 Signed Sealed and acknowledged by the testator in the presents of the Subscribers As his Last will and Testament Thomas Miller Henry Lewars Isaac Miller Jr Berks County ss On the 7th day of April A.D. 1845 appeared Henry Lewars Esqr. and Isaac Miller Jr. Witnesses to the foregoing Will, and being sworn according to Law, did depose and say that they were present and did see and hear the Testator Thomas Miller sign seal, publish, pronounce and declare the foregoing instrument of writing as and for his last Will and Testament and that at the time of the doing there of he the said Testator was of sound mind memory & understanding to the best of their knowledge observation and belief. – Michael Kraemer Depy Regr.
