All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Barbara Mihalcik christielisabeth@yahoo.com August 12, 2009, 10:43 pm Source: Berks County Courthouse Written: July 28, 1794 Will of David Muller 1794 Tulpehocken Township Berks County Pennsylvania In the Name of God Amen The twenty eighth day of July in the year of our Lord one thousand seven hundred and ninety four I David Muller of Tulpehoccon Township in the County of Berks in the State of Pennsylvania Farmer, being at present aged weak and sickly, in Body but yet of good understanding and memory God be thanked therefore, but having taken into consideration the Mortallity of my Body, and knowing it is appointed for all Men once to die Make and ordain therefore this my last Will and Testament that is to say Principaly and firstly I give and recommend by Soul into the Hands of God who gave the same, and order my Body to be Buried, according to the Christian manner, not doubting that in the general resurrection, I shall receive the same ~ through the almighty power of God; and concerning such my Wordly Estate, wherewith God has been pleased to ~ bless me with in this life. I give devise and bequeath in the following order and manner ~~~~~ Item It is my will and I order that my Just debts shall be ~ paid and sattisfied ~ Item It is my Will and Testament that my beloved Wife Anna Catherina shall have every Year twelve bushels of Wheat and 3 Bushels Rye - this grain must be put for my Wife into the Mill and returned unto her. Further I bequeath unto my Wife, yearly twelve pound in Cash, further one Cow, and that Cow the same must provide for forage and grazing, and if in case said Cow should be lost by accident, then the possessors of my Land shall give my Wife another Cow, and that a good fresh milking Cow. Further one hundred pound of Pork and fifty Pound of Beef each Year, and each year there shall be given unto my Wife12 # Hatcheled Flax, further one good and compleat Bed with all the appurtenances, further every year 4 # of Wool and one Chest one Iron Pot there she has the choise among them 6 pewter plates 6 spoons and three large dishes among which She has her choise, and Fire Wood must be given unto her cut small and brought unto her House, one piece of the Garden behind the House, and place in the Spring House, further the the large Iron Kettle and one Bucket, and one small Backing Table; Further a large Nuremberg Bible my Wife has for her use as long as she lives and after her death my Son Benjamin shall have the same, and the seat in the House, this all I bequeath unto my married Wife, and yet further if in case should become sick then the Possessors of the Land must give unto my Wife ~ good nursing, and yet is to mention if the Cow which I divised unto my Wife should stand dry, then the Possessors of the Land must give unto my Wife as much Milck as she has need of, this is my Will that all this my wife shall have as long as she bears my name. ~~~~ Item It is my Will that my eldest Son Simon shall have beforehand for his first Birthright, one english shilling, and then to inherit with his Brothers and sisters. It is my Will that my Son David, has already received beforehand Forty six Pounds ~ and this my Son David shall receive no Money sooner, until the other Brothers and Sisters have also as much as him ~ It is my Will that my Son Peter has already received beforehand the sum of Fifty Pounds, and this my Son Peter shall receive no Money sooner ~ until the other Brothers and Sisters have also as much as him ~~~ It is my Will that my two Sons, namely Benjamin and Michael, shall have all my Land which I have in possession for eight Hundred pounds, and these my two Sons shall have this my land or Plantation, and to maintain the Mother as long as she lives from the Land ~ to be shared into two shares as they can, they have their shares in these Eight Hundred pounds like their other Brothers and Sisters, this is my Will that my two Sons shall pay each year to their Brothers and Sisters twenty four pounds, firstly my Son Simon shall receive the first Money, as much as his Brothers have beforehand, one year after my death, but in this point it is reserved ~ that because the Land is rented for yet two Years, so shall my two Sons pay no Money Sooner, until they have the Land one year in Possession. It is my Will that my Son Hermanus shall have the second Money as much as his Brothers have beforehand. It is my Will that my Son John George shall receive the third year as much as his ~ Brothers have beforehand. It is my Will that my Son Benjamin shall receive the fourth year in Money, as his Brothers have beforehand. It is my Will that my son Michael the fifth year shall receive, so much as his Brothers have beforehand. It is my Will that my Daughter Margaretha Elisabeth shall receive the sixth year in Money, as much as her Brothers have before-hand. And my Daughter Anna Christina shall receive the seventh year as much as her other Brothers and Sisters. It is my Will that I bequeath unto my deceased Daughter Anna Margaretha’s Child fifteen pounds, and this Money shall be paid the last, for this Money I ordain as Guardian for my Daughters child namely David Bechtel and this Money shall be put on resury until the Child becomes of Manhood, but if in case the Child should die, then this bequeathed Money shall revert to my Heirs. It is my Will that my two Sons Benjamin and Michael, what yet is left of Hatcheled Hemp shall have beforehand, and my Daughter ~ Christina shall have beforehand the unswingeled Flax. It is my Will that the Possessors of the Land, must keep for my Wife a Horse, but in case said Horse which she has should ~ unluckily be lost, then the Possessors of the Land must give unto my Wife a Horse whenever she requests the same for her use, and my Wife has a right always to keep six Hens on the Land. This Horse and Saddle I bequeath unto my Wife for her use ~ And lastly I appoint and constitute my Son Benjamin and my Wedded Wife Anna Catherina, to be my sole and only ~ Executors of this my last Will and Testament, and I hereby revoke and make null and Void, all other Wills and Testaments which I have heretofore made, ratifying and confirming this and no other to be my last Will and Testament.
