Brown This Indenture made the first day of December in the year of our Lord, one thousand eight hundred and eighty-six Between Lydia Burkholder widow, John J. Burkholder, Perry G. Burkholder and Dora his wife, Margaret J. Mark and Anthony S. Mark her husband, Mary E. Hawk and Norville Hawk her husband, Henry C. Burkholder and Mary his wife, Thomas J. Burkholder and Minerva J. Burkholder his wife, W. Lloyd Burkholder and Sivanna his wife, Venneta H. Funk and James P. Funk her husband and John Martin Burkholder and Louisa his wife heirs of John J. Burkholder late of Antis Township, Blair County Penna. now deceased and Perry Burkholder and Thomas Burkholder Executors of the last will and testament of said John J. Burkholder deceased, all of Blair County Penna of the first part and George H. Brown of Altoona, Blair County Penna. of the second part. Witnesseth: that the said parties of the first part, for and in consideration of the sum of Two Thousand and six dollars and sixty seven cents lawful money of the United States of America unto them in hand paid by the said party of the second part at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released, conveyed, and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said party of the Second part his heirs and assigns forever. All that certain lot or piece of ground on the South West corner of Chestnut Street and Eighth Street in the city of Altoona, Blair County Penna and being lot No. 16 on the old town plot of Greensburg now Altoona City fronting fifty feet on Chestnut Street and running back along Eighth Street formerly Walnut Street one hundred and thirty three feet to an alley and being of same width from front to rear, and being apart of a tract of land which became vested in Michael Grazier deceased, and by his heirs conveyed to Robert Andrew Green and by said Andrew Green and wife conveyed to L. H. McCormick and wife to James Thompson by Deed March 9th 1855 and being the same lot which James Thompson and Mary A. his wife sold and conveyed to Jacob S. Burkhart by deed dated 13th November A. D. 1860 and which the said Jacob S. Burkhart by deed dated 28th December 1870 conveyed to John J. Burkholder which Deed is recorded in Deed Book Vol 61 page 370 among the records of Blair County and being same lot in which Magdelina Burkhart wife of Jacob S. Burkhart was decreed a life interest in one third of said property which will more fully appear by reference to No. 39 April Term 1879 and Judgment entered thereon March 17th 1885 in the Common Pleas of Blair County Penna. Together with all and singular the buildings, improvements woods, ways rights, liberties, privileges, hereditaments and appurtenances to the same belonging or in anywise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof and of every part and parcel thereof, possession, claim and demand whatsoever both in law and equity of the said parties of the said first part of and in to the said premises with the appurtenances. To have and to hold the said premises with all and singular the appurtenances unto the said party of the second part his heirs and assigns to the only proper use and benefit and behoof of the said party of the second part, his heirs and assigns that they the said parties of the first part and their heirs all and singular the hereditaments and premises herein above described and granted or mentioned or intended to be so with the appurtenances unto the said party of the second part his heirs and assigns against them the said party of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof. They the said parties of the first part shall and will warrant and forever defend. Clark Magistrate Court No. 23 in and for said City on the Tenth day of December AD 1886 personally appeared the above named Anthony S. Mark, Maggie J. Mark his wife, James P. Funk and Vinettia H. Funk his wife who in due form of law acknowledged the foregoing indenture to be act and Deed, and desired that the same might be recorded as such. The said Maggie J. Mark and Vinettia H. Funk being of full age and by me examined separate and apart from their said respective husbands and the contents of the foregoing Indenture being first made fully known to them declared that they did voluntarily and of their own free will and accord seal and as their act and deed deliver the same without any coercion or compulsion of their said husbands. The said Mary Burkholder being of full age and by me examined separate and apart from Henry Burkholder her said husband and the full contents of the foregoing Indenture being first made fully known to her declared that she did voluntarily and of her own free will and accord sign, seal, and as her act and deed deliver the same without any coercion or compulsion of her said husband.
