Burkholder et ux to James P. Funk in townships of Logan and Antis This Indenture made the fifteenth day of November in the year of our Lord One thousand nine hundred and nine between Henry C. Burkholder and Mary E. Burkholder, his wife of Houtzdale, Clearfield County, Pennsylvania parties of the first part, and James P. Funk, of Logan township, Blair county, Pennsylvania part of the second part. Witnesseth: that the said parties of the first part, for and in consideration of Two hundred dollars and other goods and valuable considerations, the former being dollars, lawful money of the United States of America unto them in hand well and truly paid by the said party of the second part, at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed, and by these presents do grant, bargain, sell alien, enfeoff, release, convey and confirm unto the said party of the second part his heirs and assigns, forever, all the right, title, and interest, of the said parties of the first part, of in, and to, all that certain tract or piece of land, situate, lying and being part thereof in the Township of Antis, and the remaining part thereof in the Townships of Logan in the County of Blair, and state of Pennsylvania, bounded and described as follows, to wit: Beginning at a pine, a corner of the Jesse Davis Tract and running thence along said tract north thirty degrees west two hundred and thirty perches to a pine thence south sixty degrees west, three hundred and twenty perches to a white oak; thence south thirty degrees east two hundred and thirty perches to a pine, and thence north sixty degrees east three hundred and twenty perches to the point, the place of beginning containing four hundred and thirty three acres and one hundred and sixty three perches and the usual allowance for roads, be the same more or less. It being one of the tracts of land known as the Morgan Lands, surveyed on a warrant granted to Jesse Wells in the month of November A. D. 1794. The said tract of land is now bounded by lands owned or claimed by Hewit's heirs (formerly Joseph Seguine) William Loudon's heirs (formerly William Coleman) David Mauley, Clara Bell, John Sheets, and others -- Being a portion of the real estate of which John J. Burkholder, late of the said Township of Antis, County of Blair, died, seised - See proceedings in partition of the estate of John J. Burkholder to Vol. 79-1888 January Term, Orphan's Court of Blair County Partition Docket "J" page 288; also declaration of Trust from Perry G. Burkholder to Mary Hawk et al, dated January 14, 1889, recorded in the office of the Recorder of Deeds and in Deed Book, Vol 72 at page 211. Together with all and singular the improvements, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders rents, issues and profits thereof, and all the estate, right, title, interest, property, claim and demand whatsoever of the said parties of the first part, in law, equity or otherwise howsoever, of, in and to the same and every part thereof. To Have and To Hold the said right, title and interest of parties of the first part in and to above tract of land hereditaments and premises hereby granted or mentioned and intended so to be, with the appurtenances, unto the said party of the second part his heirs and assigns to and for the proper use and behoof of the said party of the second part his heirs and assigns, forever. Subject, however, to the payment by the said James P. Funk, his heirs and assigns, of one sixth of the dower money and interest (now due and payable from said Henry C. Burkholder to Vinetta Funk and Margaret Mark) as per report of Maxine Bell, auditor, in estate of John J. Burkholder, filed in the Orphans Court of Blair County Pennsylvania in Docket K page 183, which upon the death of the widow of said John J. Burkholder became due and owing to said Vinetta Funk and Margaret Mark. And, Henry C. Burkholder and Mary E. Burkholder his wife, the said parties of the first part, for themselves, their heirs, executors and administrators, do by these presents covenant grant and agree to and with the said party of the second part, his heirs and assigns, that they the said parties of the first part, their heirs, all and singular the hereditaments and premises herein above described and granted or mentioned, and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against the said parties of the first part, and their heirs, and against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof. Shall and will warrant and forever defend In Witness Whereof, the said parties of the first part have to these presents set their hands and seals Dated the day and year first above written. Henry C. Meyers State of Pennsylvania County of Clearfield ss: On the 29th day of November Anno Domini 1909, before me the undersigned authority in and for said county and state came the above named Henry C. Burkholder and Mary E. Burkholder, his wife, and acknowledged the foregoing Indenture to be their act and deed, and desired that the same might be recorded as such.
