Wallace deceased formerly Susan Jackson, Robert S. Sacket and Sarah (sic) and Sarah Ann his wife formerly Sarah Ann Jackson, Margaret Jackson and Samuel Johnston all of the counties of Huntingdon and Blair and state of Pennsylvania of the first part and William Shaffer Senior of the Township of Morris in the County of Huntingdon and state aforesaid of the second part. Witnesseth, whereas John Penn the younger and John Penn the elder by their attorney Anthony Butler duly constituted by their deed dated the 21st day of March 1794 Recorded in the office for recording of deeds in and for said County of Huntingdon in Book E page 10 and did grant and convey unto William Templeton and William Porter a certain trace of land situate Tyrone Township in the County of Huntingdon aforesaid (now the County of Blair) being a part of the late proprietary Manor of Sinking Valley and a part of the lot marked in the plan thereof No. 33 containing twenty nine acres and forty eight perches and allowances etc and whereas the said William Templeton by his deed dated the eleventh day of January 1800 to be recorded for the consideration therein mentioned did grant and convey unto James Johnston, all of the one undivided one half part of a certain trace of land containing one hundred and eleven acres and one hundred and fifteen perches situate on the Arch Spring Run in the said Township of Tyrone and County of Huntingdon (now the County of Blair) adjoining the lands of Jacob Isett, Michael Fisher, Caspar Weight and the said James Johnston which said tract of land was surveyed to the said William Templeton on the thirteenth day of March 1793 "The one half part held by improvement right and the one half of the undivided part of the above mentioned tract of twenty nine acres and forty eight perches held by the deed from said late proprietaries of Pennsylvania dated the 21st day of March A.D. 1794 as aforesaid is included in the trace above mentioned surveyed to William Templeton. And whereas the Commonwealth of Pennsylvania by their Patent dated the fifteenth day of December 1815 Enrolled in Patent Book H Volume 11 page 498 did grant and convey unto James Johnston a certain tract of land situate in Tyrone Township in the County of Huntingdon (now the County of Blair) adjoining Canoe mountains, vacant lands, lands of Caspar Weight and lands of James Johnston and John Gill containing seventy four acres and fifty four perches and allowances etc surveyed on Warrant dated the thirteenth day of February 1801 granted to the said James Johnston. And whereas William Spear Sheriff of the said County of Huntingdon by virtue of a writ of venditioni Exponas of the said Commonwealth issued out of the Court of Common Pleas of the said County of Huntingdon tested the nineteenth day of November 1825 to him directed did on the eleventh day of January 1826 sell and by his deed dated the ___ day of April 1826 conveyed unto Samuel Johnston all of the interest of the said Thomas Jackson (said interest being his life estate) in and to one hundred and fifty six acres of lands be the same more or less. And whereas the said James Johnston made his last will and testament in writing bearing date the fourteenth day of May 1814 wherein and whereby amongst other things therein mentioned did will and bequeath unto his said daughter Jane Jackson and her heirs said lands in the following words to wit "I do leave and bequeath to my well beloved daughter Jennet Jackson and her heirs all my tract of land situate in Sinking Valley and where Thomas Jackson now lives adjoining the Canoe mountains" as by reference to said will proven registered and filed in the Registers office in and for the said County of Huntingdo appear etc., and whereas the said John Jackson and Philip Bridenbaugh constructed and agreed with each other to exchange certain parts of the aforesaid lands and lands of Philip Bridenbaugh adjacent, and on the twenty fourth day of August 1847 carried said contract into effect by surveys and drafts of their respective portions of lands. The said John Jackson as tenant in common with the party of the first part in said exchange took and received of the said Philip Bridenbaugh one hundred and sixty eight perches of land which is included in the tract of land hereby conveyed unto the said William Shaffer Junior the party of the second part. Now this indenture Witnesseth that the said party of the first part for and in consideration of the sum of Three Thousand nine hundred and forty five dollars lawful money of the United States to them in hand paid or secured to be paid by the said party of the second part at and before the sealing and delivery of these presents the receipt and payment whereof is hereby acknowledged and thereof acquit and forever discharge the said party of the second part his heirs executors and administrators by these presents have granted, bargained, sold, aliened, enfeoffed, released and confirmed unto the said party of the second part and to his heirs and assigns all of the following described trace and parcel of land situate in the township of Tyrone in the County of Huntingdon (now County of Blair) Beginning at a white oak corner by lands of Daniel Fisher thence by said Fishers lands north sixty eight degrees East eighty six perches to a post; thence by lands of Philip Bridenbaugh South forty nine degrees East twenty eight and five tenth perches to a post. South thirty nine degrees East sixty two and five tenth perches to a post. South eighty seven degrees east fifty perches to a post thence by lands of Michael Wallace heirs South fifteen degrees East twenty eight perches to a post. South fifty three degrees East twelve perches to a post thence South thirty six degrees East twelve perches to a post. South twenty eight degrees East twenty nine perches to a post South forty six degrees West seventeen perches to a post thence north sixty seven degrees West twenty one perches to a post, thence by Brush Mountain South fifty nine degrees 27 degrees West one hundred and twenty eight and one tenth perches to a post thence by lands of Samuel Isett North ten and one half degrees West sixty eight perches to a black oak North forty one degrees West sixteen perches to a post North five degrees West five perches to a post North forty one degrees East seven perches to a post north forty seven and one half degrees west twenty one perches to a post North forty six degrees West thirty four perches to a post North eighty four and one half degrees West fifteen perches to a post thence by the said David Fishers land North fourteen and one half degrees West forty nine perches to the place of beginning containing (agreeably to a plot or draft thereof signed William Reed and dated the twenty fourth and twenty fifth day of August one thousand eight hundred and forty seven which said draft includes the said small triangle piece of land of one hundred and sixty eight perches taken in exchange aforesaid by the said John Jackson from the said Philip Bridenbaugh and for which no title has yet been given) one hundred and thirty one acres and eighty perches and allowances of land. The same being the lands herein before mentioned as granted and conveyed unto the said James Johnston deceased. Together with all and singular the buildings improvements, woods, ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining (Excepting and reserving nevertheless out of this present grant to and for the only proper use benefit and behoof of the aforenamed late proprietaries their heirs and assigns all the rights, reservation and restrictions contained and reserved in the aforementioned deed to the said William Templeton and William Porter also all the rights , reservations and exceptions contained and reserved by the Commonwealth of Pennsylvania on their behalf in their patent aforesaid to the same James Johnston deceased and also excepting and reserving for the only proper use and benefit of the party of the first part all the grain that is now in the ground on said tract of land with all necessary privileges of securing and taking away the same in the bushel) and the reversions and remainders, rents issues, and profits, thereof and also all the estate, right title, interest, property, claim and demand whatsoever of them the said party of the first part in law or equity or otherwise howsoever of in to or out of the same. To have and to hold the said tract and parcel of land containing one hundred and thirty one acres and eighty perches and allowances hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances (Excepting and reserving nevertheless as is herein before excepted and reserved) unto the said party of the second part his heirs and assigns. To and for the only proper use and behoof of him the said party of the second part his heirs and assigns forever and the said party of the first part for themselves respectively their respective heirs, executors and administrators Do hereby covenant, promise, grant and agree to and with the said party of the second part his heirs and assigns by these presents that they the said party of the first part and their heirs the aforementioned and described tract and parcel of land hereby granted or mentioned or intended so to be with the appurtenances (Excepting and reserving nevertheless as is herein before excepted and reserved) unto the said party of the second part his heirs and assigns against the said party of the first part and their heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend by these presents. Before me the subscriber one of the Justices of the Peace in and for said county of Blair personally appeared Jane Jackson, John Jackson, James Jackson, Susan Wallace, Robert S. Sacket and Sarah Ann his wife, Margaret Jackson and Samuel Johnston the parties of the first part and grantors in the foregoing indenture named and in due form of law acknowledged the said indenture to be their act and deed to the end that the same might be recorded as such according to law. She the said Mary Ann being of lawful age and being by me first examined and separate and apart from her said husband and the full contents thereof being by me first made known to her upon such separate examination did declare that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the same without any coercion or compulsion of her said husband. In testimony whereof I have hereunto set my hand and seal the day and year last herein above written. The said Robert S. Sacket and Sarah Ann his wife acknowledgement is not taken by me as above stated. John A. Sacket and Sarah Ann his wife the parties of the first part and grantors in the foregoing indenture named and in due form of law acknowledged the said indenture to be their act and deed to the end that the same might be recorded as such according to law, she the said Sarah Ann being of lawful age and being by me first examined and separate and apart from other said husband and the full contents thereof being by me first made known to her upon such separate examination did declare that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the same without any coercion or compulsion of her said husband.
