All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/blair/ _________________________________________ Allegheny Township Written: December 5, 1889 Recorded: June 3, 1890 Blair County Deed Book 79 page 636 Deed from David Koon Sr's Exec. to David Koon, Jr. This Indenture made the Fifth day of December in the year of our Lord one thousand eight hundred and eighty nine between Joseph Hutchinson Executor of the last Will and Testament of David Koon Sr, late of Allegheny Township, Blair County, Pennsylvania deceased, party of the first part and David Koon Jr. of the township, county, and state aforesaid party of the second part -Whereas the said David Koon Sr in his lifetime and at the time of his death was seized in his demesne as of fee, inter alia, of the real estate herein after described. And whereas by his last will and testament duly probated since his death before the Register of Wills &c for Blair County & recorded in in [sic] Will Book E page 599 he did after making certain bequests direct that all the balance of his estate real and personal be appraised and the proceeds divided share and share alike between his wife & children and in the next clause did direct that his son David should have the first chance to accept or purchase his farm or farms at the appraisement and of his said will appointed Joseph Hutchinson & Saml. B. Confer the Executors and the said Saml. B. Confer having renounced, letters testamentary were granted to the said Joseph Hutchinson and the said land of the said David Koon having been divided & appraised, that hereinafter described was taken by David Koon at the appraisement of $2356.12 and whereas the said will not having specifically authorized the said Executor to execute and deliver a deed therefore, now the other heirs and legatees of said David Koon decd viz Mrs. Levania Wilt and Jacob Wilt her husband, Francana Otto and Samuel Otto her husband and Mrs. Clayanna Kinsel, widow, all of Blair County, Penna do hereby join in this conveyance to show our assent and convey all our right, title & interest in said property as herein described to the said David Koon Jr his heirs and assigns. Now this Indenture Witnesseth that the said Joseph Hutchinson, Executor & Mrs. Levania Wilt, Mrs. Francana Otto, & Mrs. Clayanna Kinsel heirs &c for and in consideration of the sum of Two Thousand Three Hundred & fifty six & 12/100 Dollars lawful money of the United States to them in hand paid by the said David Koon Jr. at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, released and confirmed, and by these presents do grant, bargain, sell, alien, release and confirm unto the said David Koon Jr his heirs and assigns All that certain tract of land situate in Allegheny Township, Blair County, Pennsylvania described as follows: Beginning at a post in the public road thence running South 43 degrees West one hundred and sixty 5/10 perches along land sold to John Haller to post on land of Michael Zigler; thence along lands of said Zigler and E. Sherman North 40 1/4 degrees West sixty one and 3/10 perches to land of Jacob H. Stiffler's heirs; thence along land of said Jacob H. Stiffler's heirs, North 26 degrees East one hundred and twenty three perches; thence by land of Alexander Wilt & public road S. 68 1/2 East forty two perches; Thence South 40 1/4 degrees East along land of Jno. P. Levan one hundred & twenty four and five tenths perches to land sold to John Haller; thence by said Haller South 42 degrees west forty five and 5/10 perches to the public road; the place of beginning containing according to survey of O. M. Irvine Esq one hundred acres and forty nine perches. Together with all and singular the buildings, improvements, ways, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues, and profits thereof, and also all the estate, right, title, interest, use, trust, property, possession, claim and demand whatsoever of him the said David Koon Sr decd or of us as his Executor and heirs in law, equity or otherwise howsoever, of, in, to, or out of the same: To have and to hold the said tract of land as above described hereditaments and premises hereby granted and released, or mentioned and intended so to be with the appurtenances, unto the said David Koon Jr his heirs and assigns, to and for the only proper use and behoof of the said David Koon Jr. his heirs or assigns forever. And the said parties of the first part covenant, promise and agree, to and with the said David Koon Jr his heirs and assigns, by these presents, that they the said parties of the first part have not done, committed, or knowingly or willingly suffered to be done or committed any act, matter or thing whatsoever whereby the premises hereby granted, or any part thereof, is, are, shall, or may be impeached, changed or incumbered [sic] in title, charge, estate, or otherwise howsoever. In Witness whereof, the said parties of the first part have hereunto set their hands and seals the day and year above written. Lowry State of Pennsylvania Blair County SS. On the 5th day of December in the year one thousand eight hundred and eighty nine before me, the subscriber, a Justice of the Peace in and for said County came the above Joseph Hutchinson Executor of David Koon Sr and acknowledged the above Indenture to be his act and deed, and desired the same might be recorded as such. Witness my hand and seal C. G. Lowry JP State of Pennsylvania County of Blair SS. On the _____ day of December Anno Domini 1889 before me, a Justice of the peace in and for said County came the above named Mrs. Levania Wilt, Jacob Wilt her husband, Mrs. Francana Otto and Samuel Otto her husband, and Mrs. Clayanna Kinsel, widow and acknowledged the foregoing Indenture to be their act and deed, and desired that the same might be recorded as such. The said Mrs. Levania Wilt and Mrs. Francana Otto being of full age, and by me examined separate and apart from their said husbands and the full contents of the foregoing Indenture being first made known to them declared that they did voluntarily and of their own free will and accord, sign, seal, and as their act and deed, deliver the same without any coercion or compulsion of their said husbands.
