Kuhn admr to W. Harry Miller This Indenture, made the 22nd day of January, A.D. 1902 between R. A. Henderson Administrator de bonis non cum testamento annexo of the estate of C. Kuhn, late of Frankstown township, Blair County, Pennsylvania, deceased, of the one part, and W. Harry Miller of Frankstown township, Blair County, Pennsylvania of the other part. Whereas, the said C. Kuhn was, in his lifetime, lawfully seized in his demesne as of fee, to and in a certain tract of land, situated in Frankstown, in the Township of Frankstown, Blair County, Pennsylvania and bounded and described as follows, "one lot of ground fronting and one hundred (100) feet on the Frankstown Road and extending back at equal wide a distance of one hundred twenty five (125) feet, more or less, to the Williamsburg Branch of the Pennsylvania Railroad begin bounded on the North by the Frankstown Road; on the East by Main Street; on the South by the Williamsburg Branch of the Pennsylvania Railroad; and on the West by the lot of Mary Kuhn, having erected thereon a two story frame dwelling house, and necessary out buildings," and being so thereof seized as aforesaid, by his will, the said C. Kuhn devised and bequeathed to his daughter Jane Eliza, the afore described tract of land, for the lifetime of said Jane Eliza Kuhn, and directed at her death that the said tract of land be sold, and the proceeds thereof be divided among his heirs. An whereas, upon the said death of said Jane Eliza Kuhn the said R. A. Henderson was appointed Administrator de bonis non cum testamento annexo of the estate of the said C. Kuhn, deceased, by the Register of Wills of the County of Blair. And whereas, at an Orphans' Court held at Hollidaysburg, for and in the County of Blair, the 30th day of September, A.D., 1901, the said R. A. Henderson was authorized and empowered to sell the said tract of land at public sale and made return of said sale to the said Court on the second Monday of January A. D., 1902. And whereas, the said R. A. Henderson, Administrator, in pursuance of the said order of sale, did expose the said tract of land to public sale on the 7th day of December, A. D. 1901 and did sell the same, on the said date, to the said W. Harry Miller, party of the second part, for the sum of Four hundred and ten dollars ($410), he being the highest and best price bidder for the same, which sale, the return thereof made to the Orphans' Court, as aforesaid, was on the 13th day of January, A. D. 1902, confirmed on the 18th day of January, A. D. 1902, confirmed absolutely, and it was considered and adjudged by the said Court, that the said tract of land, with appurtenances, sold as aforesaid should stand firm and stable to him, the said W. Harry Miller, his heirs and assigns forever, and that upon receipt of the purchase money by the said R. A. Henderson, Administrator that be execute to the said W. Harry Miller a deed of conveyance of the said premises, so as aforesaid purchased by him. Now this Indenture witnesseth, that the said R. A. Henderson, Administrator, as aforesaid, for and in consideration of the sum of Four Hundred and ten dollars (410), to him in hand paid by the said W. Harry Miller party of the second part, at and before the unsealing and delivery hereof, the receipt and payment whereof he does hereby acknowledge, does grant, bargain, sell, alien, release, confirm and convey and by these presents (by virtue of the powers and authority to him given by the will of said C. Kuhn, deceased, and by the aforesaid order of the Orphans' Court, and pursuant to the directions thereof) does grant, bargain, sell, alien, release and confirm and convey unto the said W. Harry Miller, his heirs and assigns, all the above mentioned and described tract of land, with appurtenances. Together with all and singular the rights, liberties, privileges, hereditaments, and appurtenances whatsoever, thereunto belonging or in anywise appertaining and the reversions remainders, rents, issues, and profits thereof and also all the estate, rights, title, interest, property, claim and demand, whatsoever, of the said C. Kuhn, in his lifetime, at and immediately before the time of his death, of, in, to or out of the same period. To have and to hold the said tract of land, hereditaments and premises hereby granted or mentioned or intended so to be, with the appurtenances, unto the said W. Harry Miller, his heirs and assigns, to the only proper use, benefit and behoof of the said W. Harry Miller, his heirs and assigns forever. In witness whereof R. A. Henderson, the said party of the first part, has to these presents set his hand and seal the day and year above written. R. A. Farrell State of Pennsylvania SS County of Blair On the 22nd day of January A.D. 1902 before me a Justice of the Peace, in and for said county, came the above named R. A. Henderson Administrator de bonis non cum testamento annexo of the estate of C. Kuhn, late of Frankstown township, Blair County, Pennsylvania, deceased, who in due form of law acknowledged the above indenture to be his act and deed as such administrator, to the end that the same might be recorded as such, according to law.
