Marriott and Wife to The Burgess and Town Council of the Borough of Altoona This Indenture, Made the First day of June in the year of our Lord one thousand eight hundred and fifty seven Between William T. Marriott and Harriett his wife of the Borough of Altoona County of Blair & State of Pennsylvania of the first part, and James Louther, Jacob Hesser Archa Maxwell R. H. McCormick, William Boyden & A. McMillin -- and their successors in office of the same Borough County and State, of the second part, Witnesseth, That the said Parties of the first part, for and in consideration of the sum of Forty Dollars, lawful money of the United States of America, unto them well and truly paid by the said parties of the second part at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, Have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents do grant, bargain, sell alien, enfeoff, release and confirm unto the said parties of the second part their heirs and assigns all of that certain lot or piece of ground in the Borough of Altoona County of Blair and State of Pennsylvania, Being the South Corner of lot No. 8, in block A on Anna Street, containing in front or breadth sixteen feet (16 feet) on said Anna Street, and extending in length or debth [sic] bindeing [sic] on alley Twenty five feet (25 ft.) being part of the lots formerly owned by William Domer, and by him conveyed to the present grantors - Together with all and singular the improvements, ways, waters, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging, or in any wise appertaining; and the reversions and remainders, rents issues and profits thereof; and all the estate, right, title, interest, property, claim and demand whatsoever of them the said parties of the first part, in law, equity or otherwise howsoever, of, in, and to the same and every part and parcel thereof, to have and to hold the said lot or piece of ground hereditaments and premises hereby granted or mentioned and intended so to be, with the appurtenances, unto the said parties of the second part their heirs and assigns, to and for the only proper use and behoof of the said parties of the second part their heirs and assigns forever. And the said William T. Marriott and Harriett his wife their heirs, executors and administrators, Do by these presents covenant, grant and agree to and with the said parties of the second part, their heirs and assigns, that they, the said parties of the first part, their heirs, all and singular the hereditaments and premises hereby described and granted, or mentioned, and intended so to be, with the appurtenances, unto the said parties of the second part, their heirs and assigns, against them [page 413] the said parties of the first part, their heirs, executors and administrators, Do by these presents, covenant, grant and agree to and with the said parties of the second part, their heirs and assigns, that they the said parties of the first part, their heirs, all and singular, the hereditaments and premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said parties of the second part their heirs and assigns against them the said parties of the first part, their heirs, and against all and every other person or persons whomsoever, lawfully claiming and to claim the same or any part thereof, shall and will Warrant and forever Defend. The First day of June Anno Domini one thousand eight hundred and fifty seven before me, the subscriber a Justice of the Peace in and for Blair County, personally appeared the above named William T. Marriott and Harriet his wife, and in due form of law, acknowledge the above Indenture to be their act and deed, and desired the same might be recorded as such, and the said Harriet, being of full age, and separate and apart from her said husband, by me thereon privately examined, and the full contents of the above Deed being by me first made known unto her, did thereupon declare and say, that she did voluntarily, and of her own free will and accord, sign, seal, and, as her act and deed, deliver the above Indenture without any coercion or compulsion or her said husband.
