L. Morrow to Christian Koon This indenture made the 9th day of May in the year of our Lord one Thousand eight hundred sixty between B. M. Morrow Executor of the last will and testament of James L. Morrow late of Frankstown township in the County of Blair and state of Pennsylvania of the first part and Christian Koon of the same place of the second part. Whereas the said James L. Morrow by force and virtue of divers good conveyances and assurances in the law duly had and executed became in his lifetime lawfully seized in his demesne as of fee of and in a certain messuage of land situated in the township, county, and state aforesaid described as follows, viz Two lots of ground adjoining each other in the town of Frankstown, on the southside of Front Street each of them being fifty feet and running back at right angles one hundred and seventy five feet on one of which is erected a two story frame house, said lots being numbered six and seven in the plan of said town, with the appurtenances, and being so thereof seized, did on the 23rd day of January A. D. 1837, enter into a written contract, with a certain Elizah Boring for the sale of two lots of ground herein before described, for the sum of six hundred and fifty dollars and whereas the said Boring afterwards to wit on the 14th day of February A. D. 1859 sold said lots of ground unto the said Christian Koon in exchange for other property. and whereas the said B. M. Morrow, Executor as aforesaid did on the 3rd day of May A. D. 1860 present his petition to the Orphans Court of said county setting forth the facts herein before recited and that the said James L. Morrow and the said Elizah Boring have both since died the said Elizah Boring having taken possession of the said lots of ground purchased from said James L. Morrow as aforesaid and having delivered possession to said Christian Koon in pursuance of said exchange that said Koon, since he took possession as aforesaid has paid to said Morrow, or his said executor all of the purchase money but about sixty five dollars, that said contract has been so far executed, that it would be against equity to rescind the same and prayed the court to decree specific performance of said contract according to the true intent and meaning, thereof, so that a conveyance may be made by said petitions the said B. M. Morrow, Executor as aforesaid, on the payment to him by the said Christian Koon of the balance of the purchase money. Thereupon the said court, on the 3rd day of May A. D. 1860, having considered the prayer of the said petitioner and the evidence of the contract aforesaid, ordered and decreed that the said B. M. Morrow, Executor aforesaid should make and execute a deed to the said Christian Koon his heirs and assigns of the hereinafter, described lots of ground, agreeable to the terms of the contract, as by the records of the said court, relation being thereunto had, more fully and at large appears. Now this indenture wittnesseth that B. M. Morrow, for and inconsideration of the sum of sixty five dollars (being the balance of the purchase money) unto him in hand well and truly paid by the said Christian Koon at and before sealing and delivery thereof, the receipt whereof is hereby acknowledged, have granted, bargained and sold, aliened, released and confirmed, and by these presents, by virtue and in pursuance of the said decrees, doth grant, bargain, and sell, alien, release and confirm unto the said Christian Koon, and to his heirs and assigns, all that the aforesaid piece of land, being two lots of ground situated in the town of Frankstown, in the township of Frankstown, county and state aforesaid fronting fifty feet each on the southside of Front Street and running back at right angles one hundred and seventy five feet and numbered six and seven (6 & 7) in the plan of said town on which is erected a two story frame dwelling house. It being the same which was conveyed by William McNamara, Mary R. Lytle, Eliza D. McNamara and Joseph Patten to James L. Morrow by deed recorded in the office for the Recording of Deeds in and for Blair County in Book E page 334 on 20th day of April Anno Domini 1853. Together with all and singular the rights, liberties, privileges, hereditaments, and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainder, rents, issues, and profits thereof, and also all the estate, rights, title, interest, property, claim and demand whatsoever of the said James L. Morrow at and immediately before the time of his decease in law or equity otherwise howsoever of, in, to, or out of the same. To have and to hold, the said granted premises to the said Christian Koon his heirs and assigns forever. And the said B. M. Morrow for himself, his heirs, executors and administrators, doth covenant with the said Christian Koon his heirs and assigns as aforesaid, that the said James L. Morrow died seized of the granted premises, that they are free from all encumbrance done or referred by him, and that he will warrant and defend the same to the said Christian Koon and his heirs and assigns against the lawful claims and demands of all persons claiming from, or under the said James L. Morrow or him the said B. M. Morrow. In Witness thereof the said B. M. Morrow the said party of the first part hath hereunto set his hand and seal. Dated the year, first herein before written. B. M.
