Woods Merritts This Indenture made the first day of April A. D. one thousand eight hundred and ninety between William Shinafelt and Mary Ann his wife of Allegheny township, Blair County, Pennsylvania of the first part: and Geo. Woods Merritts of Hollidaysburg Pennsylvania of the second part. Witnesseth, that the said parties of the first part for and in consideration of the sum of one hundred and twenty five dollars lawful money of the United States of America unto them (parties of the first part) well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm unto the said party of the second part his heirs and assigns forever-- All that certain piece or parcel of ground situate in Allegheny township, Blair County, Pennsylvania described as follows. Viz. Beginning at a point in the center of the public road leading from the plank road toll gate to Bennington Bridge a cor. of Saml Robinson's land and running thence by Robinson South 25 1/2 degrees West 41.30 perches to center of a ditch thence by said ditch and other lands of the said William Shinafelt North 49 2/4 degrees West 4.10 perches: thence by same north 25 1/2 degrees East 39.60 perches to center of the public road before mentioned: thence by the same South 74 1/2 degrees East 4.03 perches to the place of beginning. Containing one acre. This being part of a larger piece of land which Dr. Crawford Irwin and wife by deed dated April 1st 1880 and recorded in the office for recording deeds in Blair County in Deed Book Vol 47 page 195 conveyed to William Shinafelt party hereto. Reference being had thereto will more fully and at large appear. Together with all and singular the improvements, ways, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever, thereunto belonging or in anywise appertaining and the reversions and remainders rents issues and profits thereof and all the estate, right title, interest, property, claim and demand whatsoever, of the said parties of the first part in law equity or otherwise howsoever of, in and to the same and every part thereof. To Have and to hold the said piece of ground hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances unto the only proper use and behoof of the said party of the second part his heirs and assigns forever. And William Shinafelt and Mary Ann his wife the said parties of the first part for themselves their heirs executors and administrators do by these presents covenant grant and agree to and with the said party of the second part his heirs and assigns all and singular the hereditaments and premises herein above described and granted or mentioned so to be, with the appurtenances unto the said party of the second part his heirs and assigns against the said parties of the first and their heirs and against all and e3very other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, shall and will warrant and forever defend. In witness whereof the said parties of the first part have to these presents set their hands and seals dated the day and year first above written. D. 1890 before me a Justice of the Peace came the above named William Shinafelt and Mary Ann his wife and acknowledged the foregoing indenture to be his (sic) act and deed, and desired that the same might be recorded as such. The said Mary Ann Shinafelt being of full age and by me examined separate and apart from her said husband and the full contents of the foregoing Indenture being first made known to her, declared she did voluntarily and of her own free will and accord, sign, seal and as her act and deed, deliver the same without any coercion or compulsion of her said husband. Witness my hand and seal the day and year aforesaid. C.
