All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/blair/ _________________________________________ 5th Ward City of Altoona Written: April 3, 1871 Recorded: April 14, 1871 Blair County Deed Book 84, pages 544-545 Abraham Yingling to James Hutchinson This Indenture made the Third day of April in the year of our Lord one thousand eight hundred and seventy one between Abraham Yingling and Esther his wife of the 5th Ward City of Altoona, Blair County, Pennsylvania of the first part, and James Hutchinson of the said Ward, City, County & State aforesaid of the second part. Witnesseth, That the said party of the first part in consideration of the sum of one thousand dollars good and ($1000.) lawful money of the United States of America, well and truly paid by the said party of the second part to the said party of the first part at and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released, conveyed and confirmed and by these presents doth grant, bargain, sell alien, enfeoff, release, convey and confirm, unto the said party of the second part, their heirs and assigns. All that Lot or certain piece of ground situate in the said 5th (Fifth) Ward in the City of Altoona in the County of Blair and State of Pennsylvania. Beginning at a post or line of Lands of Patrick Farrell Thirty feet from the western line of the Hollidaysburg Branch of the Pennsylvania Railroad and thence paralel [sic] to and thirty feet from the said Rail Road South thirty seven degrees West fifty feet to a post, thence by other lands of the said party of the first part, North forty six degrees west, one hundred & twenty feet to a post thence North thirty seven degrees East fifty feet. Thence by Lands of said Patrick Farrell south South [sic] forty six degrees East one hundred and twenty feet to the place of beginning. The same being part of a larger tract of land warranted in the name of John Boynton and Samuel Wherton by warrant dated the 28th day of July A.D. 1766. The title to which said described Lot or piece of ground became vested in the present grantor by Deed of Conveyance dated the 4 (Fourth) day of August A. D. 1869 by George W. Metzger and his wife Sarah A. Metzger his wife. Reference being had thereto will more fully appear. Together with all and singular the buildings, improvements, woods, ways rights, liberties, privileges, hereditaments and appurtenances, to the said belonging, in anywise appertaining, and the reversion and reversions, remainder and remainders, rents issues, and profits thereof, and of every part and parcel thereof. And Also, all the estate, right, title, interest, property, possession, claim and demand whatsoever both in law and equity of the said party of the first part of, in, and to the said premises, with the appurtenances. To have and to hold the said premises with all and singular the appurtenances unto the said party of the second part, his heirs and assigns to the only proper use benefit and behoof of the said party of the second part his heirs and assigns forever. And the said Abraham Yingling and Esther his wife their heirs, executors and administrators, do by these presents covenant, grant and agree to and with the said party of the second part, his heirs and assigns, that they the said Abraham Yingling and Esther his wife and their heirs all and singular the hereditaments and premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, against them the said Abraham Yingling & Esther his wife heirs and against all and every other person or persons, whomsoever lawfully claiming or to claim the same or any part thereof, shall and will by these presents, warrant and forever defend. In Witness Whereof, the said part of the first part to these presents hereunto set their hands and seals Dated the day and year first above written. McCormick On the Third day of April Anno Domini 1871 before me, an Alderman in, and for Altoona City, Blair County, Pa. personally appeared the above named Abraham Yingling and Esther Yingling his wife and in due form of law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such. The said Esther Yingling being of full age, and by me examined separate and apart from her said husband, and the full contents of the foregoing Indenture being first made known to her, declared that she did, voluntarily and of her own free will and accord, sign, seal, and as her act and deed, deliver the same, without any coercion or compulsion of her said husband.
