All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/blair/ _________________________________________ MAYBERRY CHERRY INSTANTLY KILLED Mayberry Cherry, aged 17 years, a resident of Bellwood, R.F.D., met instant death in a peculiar manner yesterday afternoon at 3.20 o'clock while at work at a saw mill in Antis township. He was employed by the Eller Lumber company which operates a saw mill in the township and while engaged at his work of sawing mine ties, the carriage on the mill was returned too quickly and the saw caught a tie which was not removed, hurled it toward Mr. Cherry, striking him on the head and crushing his skull, causing almost instant death. Coroner Chester Rothrock of this city was summoned and went to Bellwood and had the body removed to the funeral parlors of Undertaker George E. Fuoss, where he empanneled a jury and held an inquest. The jury, composed of W. F. Balsbach, foreman, George H. Lehrsch, David W. Posten, Thomas L. Wilson, M. H. Morrow and Clarence Burns, after hearing the evidence of a number of witnesses, returned the following verdict: "We find that Mayberry came to his death at a saw mill owned by the Eller Lumber company, the carriage being returned too quickly, upon which was a tie, the same coming in contact with the saw, throwing the tie and striking Mr. Cherry. No blame can be attached to anyone." Mr. Cherry was born on April 10, 1873, the son of J. P., deceased, and Lillian Mary Cherry, and is survived by his wife, Mrs. Mattie Nelson Cherry, his mother and eight children: Ernest, Raymond, Mrs. Grace Miller, Harold, Victor, Della, Ethel and Veida, all at home, and five brothers, F. E., B. F., H. T., W. R. and H. D. Cherry, all of Altoona, and three sisters, Mrs. Samuel Ban[ks],* Mrs. W. G. Smith and Miss Emma Cherry, all of Altoona. He was a member of the Church of the Brethren at Riggles Gap where the funeral services will be conducted on Saturday afternoon at 2.30 o'clock. Interment will be made in the Antis cemetery. Mr. Cherry was a sawyer on the mill he was operating and was cutting mine ties. An offbearer was taking the ties from the carriage and as the mill was being operated very fast, the last tie was not removed when the carriage returned with the result that it was caught by the saw and hurled to the side, striking Mr. Cherry.
