I, Lewis Gwin of Logan Township in the County of Blair and State of Pennsylvania, considering the uncertainty of this mortal life, and being of sound and disposing mind, memory and understanding, and being desirous to settle my worldly affairs and thereby be better prepared to leave this world, when it shall please God to call me hence, do therefore make and publish this my Last Will and Testament in manner and form following that is to say: First and principally, I commit my soul into the hands of Almighty God who gave it, and my body to the earth to be decently buried. And as to such worldly affairs as it hath pleased God to bestow upon me and that I may be possessed of at the time of my decease, it is my will and desire to dispose of in the following manner. Item: I give and devise unto my eldest son James L. Gwin the following described part of a tract of land whereon he now resides in said Township of Logan. Bounded and described as Follows; Beginning at a white-oak, a corner of land now owned by John Coleman, said corner stands nearly east of my dwelling house, thence from said white oak by my other land, North forty-five degrees West and to continue that course of the fence of the small field north of my barn, thence in a Northward direction on the West side of the meadow land, to a point about West of the middle of the field farthest north of my said barn, thence in a North direction to a point three perches east of a bridge of logs over a small run on the road to Jacob Yingling's, thence to continue North so as to leave the said run about three perches to the West until that course intersects the line of John Coleman's land thence by said line south seventy- five degrees east to a small Black Oak east of the road leading to Coleman's Mill, thence by land of said John Coleman and land lately sold by me to George W. Nelson, to the aid white-oak of Beginning, to him the said James L. Gwin and to his heirs and assigns forever in fee simple subject to the payment of the legacies herein after named, which are to be Liens against the same until paid and discharged Item: I give and devise unto my youngest son, Alexander Gwin the remainder of my said Tract of land wherein I now reside bounded on the East by land of said John Coleman, on the south by land of Abraham Rees, on the west by the claim of Frederick and Jacob Yingling, on the North by said Coleman on the North East by the land already devised to my said eldest son James L. Gwin to him the said Alexander Gwin and his heirs and assigns forever in fee simple subject to the payment of the legacies, and the provisions herein after mentioned which are to be liens against the same until paid and discharged. Item: I do give and bequeath unto my Eldest daughter Emily Gwin the sum of Seven hundred and fifty dollars as her share of the real estate, to be paid to her by my said sons, James L. and Alexander Gwin, each annually paying her after my decease the sum of sixty two dollars and fifty cents until paid. Item: I do give and bequeath unto my youngest Daughter Maria the sum of Seven hundred and fifty dollars as her share of the said Real Estate to be paid to her by my said sons James L. and Alexander Gwin, each annually after my decease paying her the sum of Sixty two dollars and fifty cents until paid. Item: It is my will and desire, that after my decease, all my just debts and funeral expenses and the expenses of settling of my affairs, together with the following names legacies shall be paid out of my personal estate. Item: I do give and bequeath unto my little Grandson Marion Scott Gwin the sum of ten dollars with which my executors shall purchase for him a Bible Testament and other religious books to be paid out of my said personal estate. Item: I do give and bequeath unto my brother Dougal Gwin the sum of Twenty dollars to be paid him by my Executors out of my personal estate, within one year after my decease and also the further sum of eight dollars by each of my sons to be paid him annually during his natural life commencing on year after my decease, to be paid by my said sons out of my said real estate. Item: I do give and bequeath unto my said Daughters Emily and Maria all of my personal estate at the time of my decease after paying the payment of my debts, expenses and the legacies herein named being first deducted, and also that they shall have my lot in the Town of Fairmont, by them paying the amount due thereon. And also it is my will and desire that they shall have privilege of such parts of my dwelling house as the may designate so long as they or either of them choose to live therein, and so much fruit out of my orchard on the land devised to my said son, Alexander Gwin as the may need for their immediate use. And it is further my will and desire that if either of my said Daughters should die previsions to the payment of the said legacies (or a part thereof) leaving no issue then the survivor of them shall retain the share of the other. Item: It is also my Will and desire that the School house and lot of one fourth of an acre adjoining which is on my said land already devised to my said son Alexander Gwin - that so long as said house shall be needed and used for common schools and for Religious Worship, it shall be set apart for said uses, and should circumstances so arise that said house would not be used or needed for said purposes then the same shall belong to my said son Alexander Gwin, by him paying to the directors of said Schools a fair compensation for said house. And lastly, I do hereby constitute and appoint my said sons James L. Gwin and Alexander Gwin, Executors of this my last Will and Testament hereby revoking all former wills by me made. In Witness Whereof I have hereunto set my hand and seal this twenty first day of April in the year of our Lord one thousand eight hundred and fifty two. Signed and Sealed by Lewis Gwin Signed and Sealed and declared by the above names Lewis Gwin to be his Last Will and Testament in the presence of us, who at his request and in his presence and in the presence of each other have subscibed our names as Witnesses thereto John Hagerty Thomas Coleman Blair County fs: Before me, the Register for the Probate of Wills and granting Letters of Administration in and for the said county, personally appeared John Hagerty and Thomas Coleman, who being duly sworn by me, did depose and say that they were personally present, and say and heard Lewis Gwin sign, seal, [exscnie], publish, pronounce and [ ] the hereunto attached instrument of Writing as and for his Last Will and Testament; that they signed their names as Witnesses thereto in the presence of each other and in the presence and at the request of the said Testator, and that at the time of signing the same the said Testator was of sound and disposing mind, memory and understanding to the best of their knowledge and belief. Sworn and Subscribed before me, this 5th day of December AD 1863 H. A. Caldwell Register Blair County fs: On the 5th day of December AD 1863, personally appeared before me the Register of Wills in and for Blair County, Alexander Gwin, who being duly sworn according to law did depose and say that as Executor of the Last Will and Testament of Lewis Gwin, deceased he will well and truly administer the goods and chattels, rights and credits which were of the said deceased, agreeably to the provisions of the said Last Will and Testament and according to law. AD 1863 personally appeared before me the Register of Wills, in and for said County, James L. Gwin, one of the Executors of the Last Will and Testament of Lewis Gwin, deceased, who being duly sworn according to law did depose [and} say that he will administer the goods and chattels, rights and credits of said Deceased agreeably to said Last Will and Testament, and according to law. [Fees 4.50, Tax .50 Rev. .50 $5.50 Memorandum: Letters [of] Testamentary were this day issued to James L. Gwin and Alexander Gwin, Executors of the Last Will and Testament of Lewis Gwin, late of Logan Township, Blair County, Penna, deceased. An Inventory of the goods and chattels, rights and credits which were of the said Deceased, to be exhibited in thirty days, and a just and true account, calculation and reckoning of their said Administration within one year of the date hereof or when thereunto legally required.
