In the name of God Amen, I James Shaw of Freedom Township in the County of Blair and State of Pennsylvania being of sound Mind Memory and understanding, do make and publish this my last will and Testament, hereby revoking and making void all former Wills by me at any time heretofore made. And first I direct that my body be decently interred in the Cemetery at Marionsville in the said Township of Freedom County of Blair and State of Pennsylvania that my funeral be conducted in a manner corresponding with my estate and condition in life. As to such Estate as it hath pleased God to intrust me with I dispose of the same as follows to wit: First. I direct that my Executors herein after named take proper care of my beloved wife Catharine Shaw (should she survive me) to maintain and support her, and to provide for her all the necessaries and comforts of life out of my estate for and during her natural life in a manner corresponding with her age and circumstances in life in lieu of her dower and at her death to provide for her a decent and suitable burial. Second. I direct that the house and lot which I now occupy situate in the said village of Marionsville County of Blair and State of Pennsylvania bounded on the East by lot of Henry M. Stiffler, on the North by Township Road, on the West by lot owned by Rebecca Harlin, and on the South by land belonging to the heirs of Conrad Hite deceased; be sold by my Executors hereinafter named as soon as conveniently can be done after the death of my said wife Catharine Shaw at either public or private sale or sales, for the best price or prices that can be gotten for the same, and for that purpose I hereby authorize and empower my said Executors hereinafter named and the survivor of them by proper deed or deeds conveyances or assurances in the law, to be duly executed acknowledged and perfected, to grant & convey, and assure the same to the purchaser or purchasers thereof in fee simple. Thirdly. I give and bequeath to Sarah F[ine?]gan (daughter of my daughter Margaret) one fourth the amount to which any one of my children shall be entitled to of my estate under this my will as herein after provided for. Fourthly. All the rest and residue of my Estate of whatsoever nature and kind the same may be and wherever the same may be immediately after the decease of my said beloved wife (Catharine Shaw) and after my said real estate shall have been converted into money by my said Executors herein after named, and the survivor of them, I give and devise and bequeath to my children and grandchildren, their heirs and assigns forever as follows to wit: To my son Henry Shaw one eleventh part of the said residue of my Estate; to my son John Shaw one eleventh part; to my daughter Elizabeth intermarried with Solomon Smith Jr.; one eleventh part to my son Samuel K. Shaw one eleventh part to my son James Shaw; one eleventh part to daughter Annie intermarried with William Cassidy. - One eleventh part to my daughter Margaret intermarried with William Robinson -- One eleventh part (which being to my said now surviving children share & share alike) to the children of my deceased son William Shaw, that is to say Catharine Ann Shaw, Henry Shaw, Mary Elizabeth Shaw, and Annie Shaw, jointly one eleventh part of the said residue of my estate to be equally divided among them their heirs and assigns the survivors or survivor of them; - - To the Children of my deceased son Joseph Shaw that is to say to Mary Catharine Shaw and Elizabeth Shaw jointly one eleventh part of the said residue of my estate, their heirs and assigns to be divided equally among them, the survivors or survivor of them; to the Children of my deceased son Alexander Shaw jointly one eleventh part of the said residue of my estate that is to say Lloyd Shaw, Flora Shaw, Wilson Shaw, Willis Shaw, James Shaw and Edward Shaw to be divided equally among them their heirs and assigns the survivors or survivor of them: -- And to the children of my deceased daughter Mary who in her lifetime having been intermarried with Jacob Stultz that is to say Margaret Ann Stultz, Orlanda Stultz, Matilda Jane Stultz, Marcus Townsend Stultz, Howard Stultz, Mary Catharine Stultz, Julia Bell Stultz and Lizzie May Stultz, jointly one eleventh part of the said residue of my estate to be divided equally among them their heirs and assigns the survivor or survivors of them. Lastly. I hereby constitute and appoint my sons Henry Shaw and John Shaw to be the executors of this my last will and testament In Witness whereof I James Shaw the testator have to this my will written on one sheet of paper set my hand and seal this Seventeenth day of November A.D. One Thousand eight hundred and Seventy Seven. James "his X mark" Shaw {Seal} Signed Sealed, published and declared by the above named James Shaw as and for his last will and Testament in the presence of us who have hereunto subscribed out names at his request as witnesses thereto in the presence of said testator and of each other. Lingenfelter Register for the Probate of Wills and granting Letters of Administration in and for the County of Blair personally came Joseph Fichtner and Geo. H. Barrow two of the subscribing witnesses to the above will and being duly sworn according to law did depose and say, they were personally present and saw and heard James Shaw the testator, sign, seal, publish, pronounce and declare the above instrument of writing as and for his testament and last will, that they signed their names in the presence and at the request of the said Testator, and in the presence of each other and that at the time of so doing he the said Testator was of perfect and sound mind memory and understanding to the best of their knowledge and belief. Blair County SS Before me the Register for the Probate of Wills and granting Letters of Administration in and for the County of Blair personally came Henry Shaw and John Shaw who being duly sworn do depose and say that as Executors of the last Will and Testament of James Shaw deceased they will well and truly administer the goods and chattels, rights and credits of said deceased according to law also that the estate and effects real and personal for or in respect of which the above Probate is applied for does not in value exceed the sum of Three Thousand dollars to the best of their knowledge and belief. Memorandum Proof of Death filed Letters Testamentary were this day issued to Henry Shaw and John Shaw Executors of the last Will and Testament of James Shaw late of Freedom Township Blair County deceased. Inventory and appraisement to be filed within thirty days from this date and a just and true account and [*****] of their said Administration to be filed within one year from the date hereof.
