John Brown aged 18 years, and Mercy Brown Daughter of the aforesd John Brown Aged 14 years, and Benjamin Brown a Minor about 9 years old Prays the Court would be pleased to appoint them Guardians & yr Petrs. shall Pray Hanah Palmer Esther Brown Mercy Brown Decmbr. Brown Entrd. in Book E page 80-- AT an Orphans Court held at Newtown In and for the said County of Bucks the 11th Day of December Anno Domini 1754 The Petition of Hannah Brown Widow and Administratrix of John Brown Late of Makefield Deceased was presented to the Court and Read in these Words Viz.& Humbly Shews That the said John Brown Died Intestate, Leaving a Considerable Real Estate. Your Petitioner therefore prays that the Court will appoint proper Persons to View and put a value on the Yearly Income of the said Estate whereof the said John Brown Died so seized as aforesaid & your Petitioner shall &: Hannah Brown And it is thereupon Ordered by the Court that that John Palmer, Edmond Roberts and Hezekiah Anderson Do View the Lands and Plantation whereof the said Peitition's Late Husband John Brown Dyed Zeized, And that they Report tot he Next Court, what they shall Judge to be the True Value of the Yearly Income and Rent thereof. Read and allowed Tasd 28 Record in Book E page 05 Lawrence Growden Esq. at Newtown March 8th 1755 Pursuant to an Order of an Orphans Court held at Newtown In and for the County of Bucks the 11th Day of December 1754 The Petition of Hannah Brown being considered by the said Court Ordered that We the subscribers should view the premises and report make to the next Court And in Obedience to the said Order having viewed the premises and Carefully Deliberated thereupon, Doe Humbly Report According to the best of our understanding that the Yearly value thereof to be Twenty six pounds current money of abovesaid province John Palmer Edmond Roberts Hez. Anderson Bucks County Orphans Court File 209 To the Worshipfull his Majesties Justices of the Orphans Court now sitting at Newtown for the County of Bucks the 14th Day of June Anno Domini 1761 The petition of Amos Palmer and Hannah his wife late Hannah Brown one of the daughters of John Brown late of Lower Makefield in the county aforesaid Yeoman Deceased, Humbly Sheweth That the aforesaid John Brown died Intestate Seized of a certain messuage Plantation and Tract of 220 acres of Land Situate in Makefield aforesaid, Leaving a Widow to witt Hanah Brown now the wife of Benjamin Cutler, and Five Children viz. John Brown, Hannah your Petitioner, Esther, now the wife of James Thackery, Mercy the wife of Jonathan Carlisle and Benjamin Brown, and as Partition of the the aforesd. Tract of Land have not yet been made, Your Petitioners - therefore Pray that the Court will appoint Four or more Persons to View Deivide and make Partition of the aforesaid Tract of 220 Acres ofLand According to the Act of the Assembly or to Direct or Inquire for that purpose But if it should be found that the said Land cannot be so Divided Between the Intestates Children without spoiling the whole thereof Pray that the same Persons so appointed to Divide the said Land, may be ordered to put a Just and True Value upon the said Messuage Plantation and Tract of 220 Acres of Land, That the Land my be adjudged to the Eldest son, at the Price the same shall be valued at, he paying to his Brothers and Sisters their Respective Proportions according to Valuation aforesaid, and Your Petitioners Shall Pray, etc. Amos Palmer Hannah Palmer George the Third by the Grace of God of Great Britain France an dIreland King Defencer of the Faith &c. to the Sheriff of the county of Bucks Greeting Whereas Amos Palmer and Hannah his Wife Late Hannah Brown One of the Daughters of John Brown late of Lower Makefield Yeoman Deceased Presen'd a Petition before our Justices of the Orphans Court for the County of Bucks aforesaid on the Tenth Day of June in the Year of Our Lord One thousand seven hundred and Sixty One, Setting forth That the aforesaid John Brown Died Intestate Seized of a Certain messuage Plantation and Tract of Two hundred and Twenty Acres of Land Situate in makefield aforesaid, Leaving a Widow to wit Hannah Brown, Now the Wife of Benjamin Cutler, and Five Children Vizt. John Brown, Hannah the Petitioner, Esther now the Wife of James Thackery, Mercy the wife of Jonathan Carlisle, And Benjamin Brown, and as Paretition of the afsd Tract of Land have not yet been made, the Petitioners Pray the Court will appoint Four or more Persons to View Deivide and make Partition of the aforesaid Tract of Two hundred and Twenty Acres of land According to the Act of Assembly, Or to Direct and Inquest for tht purpose, And if it should be found that the said Land cannot be so Divided Between the said Intestates Children without spoiling the whole thereof, Then they further Pray that the same Persons appointed to Divide the said Land, may be ordered to Put a Just and True Value upon the sid Messuage Plantation and Tract of Two hundred and Twenty Acres of Land, That the same may be Adjudged to the Eldest Son at the Price the same shall be so Valued at, He paying to his Broterh, and Sisters their Respective Proportions According to the Valuation aforesaid &c. which being considered by this Court and John Brown the Eldest Son not appearing to consent It is ordered that the Sheriff be Commanded that taking with him twelve Honest and Lawful men of this County He do go to the Messuage Lands and Plantation whereof the Said John Brown Lately Dyed Seized as aforesaid and there in the Presence of the Parties if they will be present by the Oaths and Affirmations of the said Twelve Men View and Divide the said Plantation Lands and Presmises by an Equal and Just Partition Between all the Children of the said Deceased, allowing the Widow her Thirds, and the Edlest son two Shares according to Law, But if they shall find that the same cannot be so divided,That they by Oaths and Affirmations of the same Twelve Honest and Lawfull Men, He do cause a Just Valuation or Appraisement to be made thereof allowing the Widow her Thirds, which they are also to Value, and make Return of Such Partition or Valuation to the next court, and it is alsow Ordered That the said Sheriff Do Give Sufficient Notice to the Wido and to all the Children of the said Intestate or their Guardians of the Time when he will proceed upon the Division or Valuation aforesaid, that they may be Present if they think Proper so to do, and that the Sheriff do Return a Plan or Draught of the said Lands to the said Court, Wherefore we command you that taking with wyou Twelve Honest and Lawfull Men of the said County You go to the Messuages Lands and Tenements aforesaid, and there in the Presence of the Parties or their Gurardians by you them to be Warn'd if upon being Warn'd they will be Present, by the oaths and Affirmations of the said Twelve Men you View and Divide the said Plantation Land and Premises by and Equal and Just Partition between all the children of the said Deceased, Allowing the Eldest son Two Shares, and allowing the Widow her Thirds According to Law, And if you shall find that the same cannot be so Divided as aforesaid - That then you shall there by the Respective Oaths and Solemn Affirmations of the same Twelve Honest and Lawful Men, Cause to be made a True Valuation and Appraisement of the said Messuage Lands and Plantations Pursuant to the Laws of this Province --- to the Partitions and Distriubtuions of Intestate estates --- there out for the Widows Dower which --- to be valued, and after Such Partition or Valuation made you shall make Return thereof Under your hand and Seal and under the hands and Seals of those by whose oaths or affirmations the said Partition, or Valuation is to be made Before our Justices of the Orphans Court to be held at Newtown the Siteenth day of September next, and have you then and there this writt Witness Gilbert ---, Esqr. at Newtown aforesaid the Thirteenth Day of June in the First Year of our Reign. Court 1765 Copy of the Order on the Pet. of John Brown At an Orphans Court held at Newtown for the County of Bucks the Tenth Day of September in the Year of Our Lord one Thousand Seven hundred and Sixty five The Petition of John Brown was presented to the court and Read in these words viz. Humbly Sheweth That your Petitioner is now Ready to Settle his accounts of his Guardianship whilest he was Guardian for his Brother Benjamin Brown and humbly Prays that you would please to Inspect the said accountsa nd grant him such allowance as you in Your Wisdom may see most meet or appoint auditors to settle the said Accounts and make Report to the next court, and Your Petitioner as is Duty Bound will Ever Pray John Brown which being considered by the court it is thereupon ordered that John Kirkbridge, Joseph Palmer, and Stacy Kirkbridge Do Examin State and --- the said Petitioners account of his Guardianship to his Brother Benjamin Brown and Report to the next Court Lawrence Growdon Esq.
