Bucks County Deeds, Book 29 page 46 Deed Barber to Mitchell This Indenture Made the Twenty fourth day of March in the year of our Lord one Thousand Seven Hundred and Seventy four Between James Barber of the Township of Bristol in the County of Bucks and Province of Pennsylvania Mason, Joseph Barber of the city and County of Burlington in the western Division of New Jersey Carpenter Henry Barber of Bucks County Mill Wright Sons of James Barber late of Bristol Township deceased and Elizabeth his wife and Elizabeth Moore Widow and Relict of Peter Moore late deceased and Mary Sands widow and Relict of Stephen Sands Daughters of the said Deceased James Barber and Elizabeth his wife which said Elizabeth was one of the Daughters and coheirs of Henry Mitchell the Elder late of the Township of Bristol Carpenter deceased of the one part and Henry Mitchell of the Township of Bristol in the County of Bucks and Province of Pennsylvania Mason Richard Mitchell of the said Township County and Province Mason John Mitchell of Middletown Township in the said County and Province Carpenter and Joshua Wright and Sarah his wife formerly Sarah Mitchell Children of Henry Mitchell late of Bristol township Blacksmith deceased and Grand children of the first mentioned Henry Mitchell of the other part - Whereas the aforesaid Henry Mitchell the Elder and Grand Father to the Several parties to these Presents In his life Time and at the Time of his Decease by diverse --- Convenyances available in law stood legally seized and possessed in his own D-- as of--- in two Several Tracts pieces or Parcels of Land Situate Lying and being within the Township of Bristol aforesaid in the County and Province aforesaid one of the Beginning at a Post being a corner of Land formerly belonging to John Town thence Extending by the same west fifteen Degrees South Four Hundred and Eight Perches to a Small White Oak for a corner thence by a line of Marked Trees about Twenty four perches from Neshaminy Creek Sixty Two perches to another Corner Black oak Thence East thirteen Degrees North Three Hundred and Sixty perches to another Corner Black Oak Thence South fifteen Degrees East fifty perches to the Place of Beginning Containing one Hundred and Twenty five acres of Land which Joseph Growden of Trevose in the County of Bucks aforesaid Esq. by Indenture of Lease & Release for the consideration Therein Mentioned did Bargain Sell, Release and Convey to the said Henry Mitchell the Grandfather in fee. The other Tract Beginning at a Black Oak Standing by Neshaminy Creek thence East Twelve Degrees North Eighty Six perches by Land formerly belonging to Robert Hall to a Post, Thence by the same East Twenty five Degrees North one Hundred and Twenty six perches to a Spanish Oak by Bristol Road Thence by the Said Road South East by South one Hundred and five Perches to a Spanish Oak, thence west Thirteen Degrees South three Hundred and Ten perches to a White oak by the aforesaid Neshaminy Creek Thence --- the said Creek the Several Courses --- --- before Mentioned Spanish Oak the place of Beginning Containing one Hundred and Six Acres and one Quarter of an Acre of Land which Hannah Carpenter late of the City of Philadelphia Widow and Sole Executrix of the Testament and Last Will of Carpenter late of the aforesaid City Deceased by Indenture of lease and Release duly executed under her hand and Seal for the Consideration Money therein Mentioned did bargain, Sell, Release and Convey to the said Henry Mitchell the Grandfather in fee~And the said Henry Mitchell the grandfather being so Thereof Seized Died Intestate leaving --- lawfully --- Three Sons & Four Daughters (Vizt. John the Eldest Son, Henry the Father to the Grantees abovenamed Richard (who died in his minority) Martha Intermarried with Thomas Janney Mason, Elizabeth Intermarried with James Barber Mother to the Grantors herein Named, Sarah Intermarried with Joseph Clark Taylor and Mary Intermarried with Renaldo Burden since Deceased having one only Son named John) heirs to his said Estate John being Entitled to Two Shairs according to a law of the Province of Pennsylvania for Dividing Intestate Estates And Whereas the Said John (Eldest Son as aforesaid) And the said Thomas Janney Mason and Martha his wife, and the said Joseph Clark and Sarah his wife some Time after to witt on the Sixth Day of September in the year of our Lord one Thousand Seven Hundred and forty Two Did Release unto the aforesaid Henry Mitchell all their Right, claim property and Possession of in and to the said Two Tracts of Land and Every part Thereof Together with the Buildings Improvements and appurtanats Thereunto belonging and to his heirs and assigns forever --- by the said Release Duly Executed under their respective Hands and Seal for the Consideration therein mentioned and Recorded in the --- Office for the County of Bucks Book B. Vol. 3 page 528&c. Reference thereunto had will more fully appear ~ And whereas the said John Burdon Son of the said Renaldo Burden and Mary his wife Sometime after the Death of his father and Mother to witt on the fourteenth Day of June in the year of our Lord one Thousand Seven hundred and forty Six Did Release unto the above said Henry Mitchell all his right claim property possession and Demand of him the said John Burden representative and sole heir of his Deceased Mother Mary Burden of in and to the Two above described Tracts of Land and being part Thereof Together with the Buildings, Improvements and Appurtenances thereunto belonging and to his Heirs and assigns forever as in and by the said Release Duly Executed under his hand and Seal for the Consideration therein Mentioned and Recorded in the ___ Office for the County of Bucks Book B. Vol. 3 page 528 Reference Thereunto being had will more fully appear. By means of Which Several Releases and Quit claims and in Virtue of his own Right as one of the Children and Coheirs of the said Henry Mitchell the Elder, he the said Henry father to the above mentioned became Legally Seized and possessed of the two above Described Tracts of Land with the Buildings Improvements and Appurtenances thereunto belonging Excepting the share or ---part of Elizabeth one of the Daughters of the first Named Henry Mitchell the Elder and Mother to the above named Grantors ~ And the said Henry Mitchell being one of the said Several Shares so Seized died Intestate leaving three sons and one Daughter the grantees above mentioned all of them at this having attained their full age of Twenty one years not having Effected a Division with his said Sister Elizabeth now this indenture witnesseth that the said James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands Sons & Daughters of the said Elizabeth begotten on her body by Husband James Barber the Elder and GrandChildren of Henry Mitchell the Elder Carpenter In order that a Perpetual Division may be made of the Above described Two Tracts of Land and that Each of them they Severally Hold and enjoy their respective shares or purparts in their own D--- as of-- And for further Consideration of the Sum of five Shillings lawfull Money of Pennsylvania to therein hand will and Freely paid by the said Henry Mitchell and the said Richard Mitchell and the said John Mitchell and the said Joshua Wright and Sarah his wife (sons and Daughter of the said Henry Mitchell Blacksmith and Grandchildren of the first named Henry Mitchell the Elder and before the ensealing and delivery hereof the Receipt whereof they the said James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands Doth hereby Respectively Acknowledge and of all and Every part thereof accept and forever Discharge the Said Henry Mitchell , Richard Mitchell, John Mitchell, and Joshua Wright and Sarah his wife and Every of their Heirs by these presents Hath and by these Presents with fully clearly and absolutely Promise, Release and forever Quit Claim unto the said Henry Mitchell Richard Mitchell John Mitchell and Joshua Wright and Sarah his wife Two Hundred and Twenty four acres of land, part of the above Described Tracts Beginning at a Black Oak on Neshaminy Creek thence by Land formerly Robert Hall North Seventy five Degrees East Eighty Nine perches to a stake thence along the Township line North fifty Two Degrees East one Hundred and Eighty three Perches & four links of a perch to the Newtown Road thence down said Road South Thirty Seven degrees East one Hundred and five perches and Two Tenths of a perch to a Spanish Oak the same being a Corner of Bondines Land and in the line of Barbers land thence by the same South Seventy two Degrees Thirty Minutes West Six Perches to a stake thence by Said Barbers land South S--teen Degrees East Fifty Eight perches to a Marked Tree in the line of Land formerly John Towns Thence South Seventy Degrees Thirty ---tes West about Tree Hundred and Thirty five perches to a stake Thence by a line of about Twenty four perches Distant from Neshaminy Creek Sixty Two perches to a stake thence South Seventy Two Degrees Thirty Minutes West about twenty four perches to Neshaminy Creek thence --- the said Creek the --- --- Thereof to the first mentioned corner the Place of Beginning In full for their Shares in Right of their Father Henry Mitchell as --- of the Several Share he purchases as aforesaid of his Brother --- and Sisters son aforesaid the above Described Two Tracts of Land do f which the said Henry Mitchell the Elder Died Seized and Possessed Together with all and Singular the Buildings, Improvements, Ways, Woods, Water Courses, Rights, Liberties, Privileges, Endowments, Hereditments and appurtenances to the Said Two Hundred and Twenty four acres of Land belonging or in any wise appertaining and the reversions and remainders, Rents, --- and Profits thereof and a--- Every of the Estate Right Title Interest Property Claim and Demand whatsoever of them the Said James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands of in and to the said Two Hundred and twenty four acres of Land Hereditaments and Premises as above Described To have and to hold the said Two Hundred and Twenty four acres of Land Hereditaments an premises hereby granted and Released or mentioned to intended to be Granted and Released with the appurtenances unto the said Henry Mitchell, Richard Mitchell, John Mitchell and Joshua Wright and Sarah his wife and their Heirs to the only Proper use benefit and Behoof of the said Henry Mitchell, Richard Mitchell, John Mitchell, Joshua Wright and Sarah his wife and their Heirs and assigns forever under the Proportional Part of the Quit Rents now are or hereafter to become Due for the Hereby Granted Premises to the Chief Lord or Lords of the fee thereof to that Nither the said James Barber, nor his Heirs nor the said Joseph Barber, and his Heirs nor the said Henry Barber and his Heirs nor the said Elizabeth Moore and her heirs nor the said Mary Sands or her heirs or any other Person or Persons in their or any Either or their Names, Right or Title or in the Right Name of Stead of any or Either of them shall or will be any way or means hereafter have claim Challenge or demand any Estate Right --- or --- in or to the --- or any part thereof--- from the same and Every part and Parcel Thereof Shall be De--- and forever Excluded by these Presents. In witness whereof the said Parties to these presents have Interchangable set their Hands and Seals hereunto the Day and year first above written James Barber Joseph Barber Henry Barber Elizabeth Moore Mary Sands Be it Remembered that on the 15th day of March in t he year of our Lord 177- Sealed and Delivered in the presence of John M. DeNormandie, John Bodine Be It Remembered that on the 15th day of March n the year of our Lord 177- before me John A. Denormandie Esq. one of the Justices for the County of Bucks personally appeared James Barber, Joseph Barber, Henry Barber, Elizabeth Moore and Mary Sands who severally acknowledged the above Release and Quit Claim to be their act --- --- the Same be Recorded as Such Witness my hand and Seal the day and year above Written John A.
